Adjournment (Subject to Approval) City of Tiffin Regular City Council Meeting September 10, 2008 Tiffin Fire Department Meeting Room Mayor Royce Phillips called meeting to order at 6:31 pm. Roll call of City Council members present: Jim Bartels, Mike Gericke, Mark Petersen, and John Wright. Absent Chris Ball. Also present Attorney Steve Greenleaf, Engineer Mike Hart, Public Works Brett Mehmen, Building Inspector Ed Johnson and City Clerk Ruth Demuth. Approval of Agenda as printed, motion Gericke seconded by Petersen. All following actions approved by all ayes unless so noted. Council person Chris Ball entered at 6:34pm. Community Forum: . Jim Schoenfelder, of J.L. Schoenfelder&Associates, Inc. presented to City Council members, The Generational Village, a visionary future for Tiffin, future conceptual drawings for future planned neighborhoods. Kristina Bevans questioned why homes on Timber Ridge Ct and Cherry Ln were allowed to be occupied with no grass and landscaping not completed. Mayor Phillips said that it will be studied to remedy this situation. Attorney suggested sending letters to homeowners to knock down weeds and complete landscaping and sodding as soon as possible. Council members suggested that costs of finishing landscaping be escrowed when a temporary permit is issued. Motion Wright seconded by Gericke to approve minutes as written for August 13, 2008 meeting. Motion Wright seconded by Gericke to approve receipts and expenditures. Russ Hunger, Frontier Homes asked refund of$5,640.00 on 2005-580 Commercial Building Permit for his building at the Industrial Park. Building Two never built and 12 meters were never use. Motion Gericke and seconded by Wright to approve refund back to Frontier Homes. Gericke suggested in future to charge for water meters as installed and not charged on Building Permit. Council members discussed problem parking on Redbird Run and parking obstruction of sidewalks. Council members will continue work on updating ordinance regarding parking issues. Council members asked Attorney Greenleaf to research ordinance for more enforcement measurements. Motion Wright seconded by Ball to set date for Bid Letting for 2008 Water Main Extension Phase Two for October 8, 2008 at 6:30pm at regular City Council meeting. Motion Gericke seconded by Bartels to table setting date for Public Hearing on Amending Zoning Ordinance Regarding Changes Made to Zoning Map. Council members approved working with Eastern Iowa Council of Governments to update text to accompany zoning map. Motion Gericke seconded by Petersen to approve reading of second reading of Ordinance 2008-293 Amendment to Peddler and Solicitors Ordinance 1979-85. Third reading set for October 8, 2008. Council members discussed updates to Animal Ordinance 2008-295. Suggested to add specific language to include Pit Bulls and Rottweillers as banned animals. Motion made by Gericke seconded by Wright to not include specific naming of Pit Bulls and Rottweillers in Ordinance 2008-295. Ayes: Ball, Bartels, Gericke, and Wright. Nay: Petersen. Motion Gericke seconded by Wright to read by title only Ordinance 2008-295, An Ordinance Repealing Ordinance 1979- 80, 1984-136 and 1986-136, Establishing Regulations For the Control Of All Animals Within The City and Prescribing A Procedure for Disposition of Dangerous and Vicious Animals. Ayes: five members. Motion Gericke seconded by Wright to approve first reading of Ordinance 2008-295. Ayes: Wright, Gericke. Nayes: Ball, Bartels, and Petersen. Ordinance 2008-295 fails. Council members asked Attorney Greenleaf to revise Animal Ordinance to include wording to allow for three dogs and three cats in residence. Issue to be continued at regular October City Council meeting. Motion Wright seconded by Gericke to read by title only, Ordinance 2008-294, An Ordinance Establishing a Building Inspection Board of Appeals. Motion Gericke seconded by Wright to approve first reading of Ordinance 2008-294. Second reading set for October 8, 2008 regular City Council meeting. • Discussion held on re-appointment of Building Official. Suggested to appoint Ed Johnson as Building Official at$80.00 per week separate from the Residential Building Inspector Contract. Motion Wright seconded by Ball to approve Ed Johnson as Building Official. Council members requested detailed information on services provided by Building Official. Motion Wright seconded by Petersen to hold further discussions on future inspection and official responsibilities at Special Work Session October 13, 2008. Mayor Phillips asked Council members to set a time line on progress of Ireland Ave Extension regarding the following items; future use of City owned property south of Hwy 6 on north end of project, obtaining title to CCASD property on project, finalize Design of Project, decision of what property will need to be purchased on south end of project north of Railroad St., and improvements to Railroad St and 3rd St. involved in Project. Council members agreed to continue to rent city property until need to remove buildings. Motion Petersen seconded by Wright to appoint Mayor Phillips and Attorney Greenleaf to proceed with negotiations with property owners for purchase of property based on appraisals on right of ways for project.
