HomeMy Public PortalAbout1999_03_30SPECIAL MEETING MINUTES OF THE TOWN COUNCIL MARCH 30, 1999 A special meeting of the Leesburg Town Council was held on Tuesday, March 30, 1999, at 7:30 p.m., in the executive conference room of the Municipal Government Center, 25 West Market Street, Leesburg, Virginia. Notice having been delivered to all members of the Leesburg Town Council prior thereto. The purposes of the meeting were to rescind adopted minutes of March 16, 1999, adopt amended minutes of March 16, 1999, and to discuss the acquisition of land for the high school site. The meeting was called to order by Mayor Clem. COUNCILMEMBERS PRESENT Frank Buttery (absent) Mervin Jackson Leonard McDonald (arrived at 7:45 p.m.) Kristen C. Umstattd B. J. Webb Bob Zoldos Mayor James E. Clem STAFF MEMBERS PRESENT Deputy Town Attorney Deborah Welsh Acting Town Manager Paul E. York The Council agreed that no executive session was needed. Brief discussion was held regarding the extension of the settlement contract for the high school site. MOTION: On motion of Vice Mayor Webb, seconded by Councilmember Zoldos, the following resolution was proposed and adopted: 99-95 - RESOLUTION - AUTHORIZING AN EXTENSION OF THE SETTLEMENT CONTRACT WITH THE MCINTYRE FAMILY TO APRIL 15, 1999 RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. An extension of the settlement contract, with the McIntyre family, for the purchase of a high school site to April 15, 1999, is hereby authorized. SECTION II. All other terms and conditions remain the same. VOTE: Aye: Councilmembers Umstattd, Webb, Zoldos and Mayor Clem. Nay: None Abstain: Councilmember Jackson Absent: Councilmembers Buttery and McDonald Discussion was held on the resolution rescinding the March 16, 1999 minutes. Councilmember Umstattd suggested that the resolution be amended to document the reason for rescinding the originally adopted minutes of March 16, 1999. MOTION: On motion of Vice Mayor Webb, seconded by Councilmember Zoldos, the following resolution was proposed and adopted as amended: 99-96 - RESOLUTION - RESCINDING TOWN COUNCIL SPECIAL MEETING MINUTES OF MARCH 16, 1999 AND APPROVING REVISED TOWN COUNCIL SPECIAL MEETING MINUTES OF MARCH 16, 1999 WHEREAS, the Town Council special meeting minutes of March 16, 1999, were unanimously approved on March 23, 1999; and WHEREAS, the March 16, 1999 special meeting minutes contained inaccuracies; and -2- WHEREAS, Deputy Town Attorney Deborah Welsh has requested that the March 16, 1999 special meeting minutes be amended to more accurately reflect discussions held during the special meeting. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The Town Council special meeting minutes of March 16, 1999, approved on March 23, 1999 are hereby rescinded. SECTION II. The March 16, 1999, Town Council special meeting minutes as amended by the Deputy Town Attorney are hereby approved. VOTE: Aye: Councilmembers McDonald, Umstattd, Webb, Zoldos and Mayor Clem Nay: None Abstain: Councilmember Jackson Absent: Councilmember Buttery Discussion was held to amend the special meeting minutes of March 16, 1999, whereby Resolution No. 99-70 appointing Mervin V. Jackson to the Leesburg Town Council was amended as follows: 99-70 - RESOLUTION: APPOINTING MERVIN V. JACKSON TO THE LEESBURG TOWN COUNCIL WHEREAS, in accordance with Section 2-6 of the Leesburg Town Code, vacancies in the office of council member for whatever cause shall be filled for the unexpired portion of the term by majority vote of the remaining members of the council; and WHEREAS, Joseph R. Trocino resigned from the Leesburg Town Council. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: Mervin V. Jackson is hereby appointed to the Leesburg Town Council to fill the unexpired term of Joseph R. Trocino. VOTE: Aye: Councilmembers McDonald, Umstattd, Zoldos and Mayor Clem Nay: None Abstain: Councilmember Jackson Absent: Councilmember Buttery On motion of, and duly seconded, the meeting was adjourned.
