HomeMy Public PortalAbout1999_07_13TOWN COUNCIL MEETING MINUTES OF JULY 13, 1999 A regular meeting of the Leesburg Town Council was held on Tuesday, July 13, 1999, at 7:30 p.m., in the Council Chambers, 25 West Market Street, Leesburg, Virginia. The meeting was called to order by Vice Mayor Webb. COUNCILMEMBERS PRESENT Frank Buttery (absent) Mervin Jackson Leonard McDonald (arrived at 7:35 p.m.) Kristen C. Umstattd B. J. INVOCATION: Councilmember Zoldos 2. SALUTE TO THE FLAG: Councilmember Umstattd 3. ROLL CALL: All members of Council were present except Councilmember Buttery and Mayor Clem. 4. APPROVAL OF MINUTES: MOTION: On motion of Jackson, seconded by Umstattd, the regular meeting minutes of June 22, 1999 and the special meeting minutes of June 29, 1999 were approved as written. Vote: 4-0-3. VOTE: Aye: Councilmembers Jackson, Umstattd, Webb, Zoldos Nay: None Absent: Councilmembers Buttery, McDonald, Mayor Clem 5. PROCLAMATION: MOTION: On motion of Jackson, seconded by Zoldos, the following proclamation was proposed and adopted. PROCLAMATION p, ARKS AND RECREATION MONTH JULY, 1999 VOTE: Aye: Councilmembers Jackson, Umstattd, Webb, Zoldos Nay: None Absent: Councilmembers Buttery, McDonald, Mayor Clem 6. OPEN FOR BUSINESS: Dr. Dilorenzo was not present. 7. PETITIONERS: Mr. Sidney Lissner, representing the Loudoun Jewish Congregation,' addressed the Council requesting consideration of a special exception application to permit a House of Worship at 10-C Cardinal Park Drive. This matter was referred to the August 3, 1999, Planning and Zoning Committee agenda. Mr. Donald Stebbin, a resident of 302 Edwards Ferry Road, submitted a petition from residents along Edwards Ferry Road, proposing "a quick, cost effective solution to hazards created by the ever-increasing traffic on Edwards Ferry Road." A copy of the petition was handed to each Councilmember. Ms. Kelly Gower a resident of Clubhouse Drive, S.W., addressed the Council requesting installation of sidewalks on Clubhouse Drive. Mr. Rick Knight, a resident of 202 Fairview Street, submitted a petition from residents of Fairview Street and Normandy Village requesting improvements to Fairview Street. A copy of the petition wa~ handed to each Councilmember. 8. PUBLIC HEARINGS: a. To consider Special Exception Application #SE-99-0-02 Mini-warehouse facility on Lot 9, Cardinal Park Industrial Park - Ms. Rothfuss provided the staff report. Mr. Robert Sevila representing the applicant was present to address any questions. No public comment was received. The public hearing was closed. This item was referred to the July 20, 1999, Planning and Zoning Committee meeting for further consideration. b. To consider Special Exception Application #SE-99-0-03 Goodyear; building expansion, 314 East Market Street - Ms. Rothfuss provided the staff report. Mr. Robert Sevila representing the applicant was present to address any questions. No public comment was received. The public hearing was closed. This item was referred to the July 20, 1999, Planning and Zoning Committee meeting for further consideration. c. To consider Special Exception Application #SE-99-0-04 Accessory dwelling, 208 Edwards Ferry Road, N.E. - Ms. Rothfuss provided the staff report. No public comment was received. COUNCILMEMBER COMMENTS Councilmember McDonald reported on the Cable Commission meeting held with Adelphia Communications. Councilmember Umstattd had no comment. Councilmember Jack~on had no comment. Councilmember Zoldos congratulated Parks and Recreation employee B!lly King and his wife on the arrival of their first child. He commended the Parks and Recreation Department and the Police Department on the successful 4th of July event. He reported on the ongoing ITC meetings. A public input session on Information Technology is scheduled on Tuesday, July 27, 1999, as part of the regular Council meeting. Mr. Zoldos wished his wife a happy 31st anniversary. 10. MAYOR'S COMMENTS Vice Mayor Webb stated she had an accident on the W&OD Bike trail while roller blading and an unknown family came to her rescue. Ms. Webb thanked this family. 11. MANAGER'S REPORT Mr. York highlighted items in the Manager's Report. He commended the Parks and Recreation Department for the successful 4~h of July event. He reminded the Council of the joint meeting with the County Board of Supervisors on July 21, 1999, at 4:00 p.m. Mr. York stated the FY 2000 Budget is now available. 12. LEGISLATION: a. MOTION: On motion of Councilmember Jackson, seconded by Councilmember McDonald, the following ordinance was proposed and adopted. 99-0-19 - ORDINANCE - AMENDING ARTICLE VI, STOPPING, STANDING AND PARKING, OF THE LEESBURG TOWN CODE TO INCLUDE DIVISION 4, PERMIT PARKING ZONES VOTE: Aye: Councilmembers Jackson, McDonald, Umstattd, Webb, Zoldos Nay: None Absent: Councilmembers Buttery, Mayor Clem b. NEW BUSINESS: MOTION: On motion of Councilmember Umstattd, seconded by Councilmember Zoldos, staff is directed to expedite the special exception request by the Loudoun Jewish Congregation. A public hearing is scheduled for August 10, 1999. Legislation is to be prepared for Council consideration on August 10, 1999. VOTE: Aye: Councilmembers Jackson, McDonald, Umstattd, Webb, Zoldos Nay: None Absent: Councilmembers Buttery, Mayor Clem Mr. Dentler provided the staff report for the proposed legislation on the Route 621 park site. Ms. Cindy Welsh, Director of Parks and Recreation for Loudoun County also provided comments. Mr. Fred Hetzel, representing the Loudoun County Parks and Recreation Commission stated everyone is enthusiastic about this project. He encouraged the Council to move quickly to create additional park facilities for the children of Leesburg. Councilmember Umstattd asked the Council to consider the possibility of the referendum failing. She asked that this scenario be incorporated into the Memorandum of Understanding. Councilmember Zoldos stated he will support the resolution although he has several concerns. He stated the town needs to be prepared to move forward on this project if the bond referendum fails. Vice Mayor Webb stated balls fields need to be built that are sufficient to accommodate the youth of the Town of Leesburg. MOTION: On motion of Councilmember Jackson, seconded by Councilmember Umstattd, the following resolution was proposed and adopted as amended. 99-215 - RESOLUTION - ENDORSING A PRELIMINARY AGREEMENT WITH THE COUNTY OF LOUDOUN FOR FUTURE DEVELOPMENT AT THE ROUTE 621 PARK SITE VOTE: Aye: Councilmembers Jackson, McDonald, Umstattd, Webb, Zoldos Nay: None Absent: Councilmembers Buttery, Mayor Clem On motion of, and duly seconded, the meeting was adjourned at 9:00 p.m. Clerk of Council ..J~es E.
