NO, 2325-1968, CCNMMY KN0"un AS THE ZONING ORDINANCE OF THE CITY OF
RIC1MND, Il'NDIANA ADOPTED JUKE 3, 1968, PROVIDING MR THE REZONING OF
mDPERTY Loa= ON BOSToN PIKE FROM R-2 SINGLE FAMILY RESIDENCE DIS-
TRICT TO C-4 GENERAL BUSINESS DISTRICT.
WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968 desig-
nates and describes as R-2 Single Family Residence District,
certain property located on Boston Pike situated in the City
of Richmond, Indiana's two-mile jurisdictional area; and,
WHEREAS, it is the intent and purpose hereof to change the zoning classi-
fication of said property located on Boston Pike from R-2 Single
Fanily Residence District to C-4 General Business District-, and,
WM EAS, a study of this Ordinance was conducted by the Richmond City
Plan Commission the 27th day of May, 1980, at which time re-
monstrances were heard fray all parties interested in or
affected by this Ordinance.
WHEREAS, the vote of the Richmond City Plan Commission was seven (7) to
zero (0) in favor of reccnrbmding the passage of Ordinance No,
54-1980.
NOW 'THEREFORE BE IT ORn4n+ED by the CommCouncil of the City of Richmond,
Indiana, as follows:
SECTION 1. That the zoning classification of the property described below
be, and the sane is hereby changed to C-4 General Business Dis-
trict, and that said property be regulated in accordance with the
Zoning Ordinance of the City of Richmond, Indiana and all auend-
ments thereto:
Lot Number 26 in the Willie Smith Subdivision, being
of record at Plat Book 9, Page 84 of the records of
the Recorder of Wayne County, Indiana.
SECTION 2, This Ordinance shall be iii full force and effect f= and after
its passage and approval as by law -required.
PASSED AND ADOPTED by the Cantu uncil of the City of Richwnd, Indiana,
this day of 1980.

The Richwind City Plan ammission conducted a public hearing on
Ifuesday, May 27, 1980, an the petition of Willie Smith, owner;
Paul F. Vertesch, Agent, requesting a cb nge in zoning from R-2
Single Family Residence District to C-4 General Business District
for Lot IP25 in the Willie Smith Subdivision, said property being
located on the west side of Boston Pik approximately 1500 feet
south of the Straightline Pike and Boston Pike intersection.
minty (20) notices of public hearing were sent to surrounding
property owners with none returned in favor and one (1) returned
in opposition to the request. At the public Dearing, one (1)
area resident spoke in favor of granting the request. MQ0 (2)
area residents remonstrated against the request citing a concern
that the proposed use, farm irnplenent sales and service, mould
add to long-standing storm *Aster drainage problems in the area.
In making its determination, the. Plan C mAssion considered the
following;
1. Prior to the issuance of permits for any new use
or structure, the developer nust prepare a site
drainage plan for the review and approval of the
City Engineer.
2. The properties. along Smith Mne now adjoin C-4
zoning so that the requested rezoning would not
be expected to harm neighboring property values.

3. The lot in question presently adjoins C-4 zoning
to the north and west so that the rezon g request
is a logical continuation of the existing C-4 zone.
Therefore, the. Plan Comnission voted seven (7) to zero (0) to for-
ward Ordinance M . 54-1980 to Common Council with a recomiendation
for approval.
