HomeMy Public PortalAbout1999_09_07SPECIAL MEETING MINUTES OF SEPTEMBER 7, 1999 A special meeting of the Leesburg Town Council was held on Tuesday, September 7, 1999, at 8:00 p.m., in the Second Floor Councilmember's meeting room, 25 West Market Street, Leesburg, Virginia. Notice having been delivered to all members of the Leesburg Town Council prior thereto. The meeting was called to order by Mayor Clem. Hamilton Lambert Personnel Director Nancy Fixx MOTION: On motion of Webb, seconded by McDonald, the following motion was made: Pursuant to Section 2.1-344 of the 1950 Code of Virginia, as amended, I move that the Leesburg Town Council convene in a closed meeting. The authority for this closed meeting is found in Section 2.1-344 (a), Subsections (1) and (7), respectively, of the 1950 Code of Virginia, as amended. The purpose of the meeting is to discuss personnel issues relating to the Police Department, potential appointment to fill the Town Council vacancy created by the resignation of Frank Buttery, and potential litigation involving acquisition of right-of-way on Fort Evans Road. Those to remain for the closed meeting are: Deputy Town Attorney Deborah Welsh, Acting Town Manager, J. Lambert and Director of Personnel Nancy Fixx. VOTE: Aye: Jackson, McDonald, Webb, Zoldos, Clem Nay: None Absent: Umstattd MOTION: On motion of Webb, seconded by Zoldos, the following motion was made: I move that the closed meeting be adjourned, that the Leesburg Town Council reconvene its public meeting and that the minutes of the public meeting reflect that no formal action was taken in the closed meeting. VOTE: Aye: Jackson, McDonald, U.,Fastattd, Webb, Zoldos, Clem Nay: None MOTION: On motion of Webb, seconded by McDonald, the following resolution was proposed and adopted: 99-259-RF_~OLUTION- CERTIFYING THE CLOSED MEETING OF SEPTEMBER 7, 1999 WHEREAS, the Town Council of the Town of Leesburg, Virginia, has this day convened in a closed meeting in accordance with an affirmative recorded vote of the Leesburg Town Council and in accordance with the provisions of the Virginia Freedom of Information Act: NOW, THEREFORE, BE 1T RESOLVED that the Leesburg Town Council does hereby certify that to the best of each member's knowledge, 1) only public business matters lawfully exempted from open meeting requirements under the Freedom of Information Act were discussed in the closed meeting to which this certification applies; and 2) only such public business matters as were identified in the Motion by which the said closed meeting was convened were heard, discussed or considered by the Leesburg Town Council. VOTE: Aye: Jackson, McDonald, Urnstattd, Webb, Zoldos, Clem Nay: None MOTION: On motion of Webb, seconded by Jackson, the following ordinance was proposed and adopted. 99-0-26 - ORDINANCE - AMENDING CHAPTER 12.1 OF THE TOWN CODE REVISING THE PAY AND CLASSIFICATION PLAN WHEREAS, the town's pay and classification plan has been reviewed by the Acting Town Manager; and WHEREAS, in order to maintain a consistently high level of service the number of positions should be revised. THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. Section 12.1-13 of the Town Code, classification of town employees by occupational group and pay grades, is amended to read as follows: Sec. 12.1-13. Adoption. MOTION: On motion of Umstattd, seconded by Webb, the following resolution was proposed and adopted. 99-261 - RESOLUTION - APPOINTING COUNCILMEMBER ZOLDOS CHAIRMAN OF THE ADMINISTRATION AND PUBLIC WORKS COMMITTEE WHEREAS, Frank Buttery resigned from the Leesburg Town Council on August 16, 1999, to accept a position with the Commonwealth Attorney's Office; and WHEREAS, the resignation of Mr. Buttery created vacancies on various town committees, boards and commissions. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: Councilmember Zoldos is appointed Chairman of the Administration and Public Works Committee. VOTE: Aye: Nay: Jackson, McDonald, Umstattd, Webb, Zoldos, Clem None Discussion was held regarding the Town Council vacancy. MOTION: On motion of Umstattd, seconded by Zoldos, the following resolution was proposed and adopted. 99-262 - RESOLUTION - APPOINTING GEORGE F, ATWELL TO THE LEESBURG TOWN COUNCIL WHEREAS, Frank Buttery resigned from the Leesburg Town Council on August 16, 1999, to accept a position with the Commonwealth Attorney's Office; and THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: George F. Atwell is appointed to the Leesburg Town Council to fill the unexpired term of Frank Buttery whose term of office shall expire on June 30, 2002. VOTE: Aye: Jackson, McDonald, Umstattd, Webb, Zoldos, Clem Nay: None Discussion was held regarding the appointment of a chairman of the Public Safety Committee. MOTION: On motion of, and duly seconded, the following resolution was proposed and adopted. 99-263 - RESOLUTION - APPOINTING COUNCILMEMBER MCDONALD CHAIRMAN OF THE PUBLIC SAFETY COMMITTEE WHEREAS, Frank Buttery resigned from the Leesburg Town Council on August 16, 1999, to accept a position with the Commonwealth Attorney's Office; and WHEREAS, the resignation of Mr. Buttery created vacancies on various town committees, boards and commissions. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: Councilmember McDonald is appointed Chairman of the Public Safety Committee.
