A CAPITAL PROJECT AUTHORIZING ORDINANCE OF
THE VILLAGE OF KEY BISCAYNE, FLORIDA, SELECTING
A CONTRACTOR FOR THE INSTALLATION OF
ARTIFICIAL TURF ON THE ATHLETIC FIELDS AT THE
VILLAGE GREEN; PROVIDING FOR A WAIVER OF
COMPETITIVE BIDDING; PROVIDING FOR
AUTHORIZATION; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Village of Key Biscayne, Florida (the "Village") recently contracted for
the replacement of natural turf on the athletic fields at the Village Green ("Fields"); and
WHEREAS, the natural turf on the Fields failed and was unacceptable to the Village; and
WHEREAS, it is critical that the Fields be resurfaced again and put into a condition
satisfactory for its intended use during the upcoming period of high usage and to avoid disruption
of the use of the Fields; and
WHEREAS, the Village Council has expressed a desire to consider the use of artificial turf
in lieu of natural turf for the resurfacing of the Fields; and
WHEREAS, the Village Manager recommends EasyGrass/Astro Turf for the installation of
artificial turf on the Fields; and
WHEREAS, the Village Council finds that this Ordinance is in the best interest and welfare
of the residents of the Village.
NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS':
Section 1. Recitals. The preceding "Whereas" clauses are ratified and incorporated as
the legislative intent of this Ordinance.

Section 2. Contractor Selected. The Village Council hereby selects EasyGrass/Astro
Turf for the installation of artificial turf on the Fields.
Section 3. Competitive Bidding Waived. The Village Council hereby waives
competitive bidding pursuant to Section 2-85 of the Village's Code of Ordinances as it is impractical
to conduct such procedures in a timely manner given the urgency to have the Fields replaced.
Section 4. Village Manager Authorized. The Village Manager is hereby authorized
to negotiate and execute an agreement with EasyGrass/Astro Turf consistent with the proposal
attached as Exhibit "A" for the installation of artificial turf on the Fields at a cost not to exceed
$1,358,680.00, subject to the Village Attorney's approval as to form, content and legal sufficiency.
Section 5. Effective Date. This Ordinance shall become effective immediately upon
adoption on second reading.

PUBLIC NOTICE
Notice is hereby given that the following ordinance will be considered or
Second Reading by the Village Council of the Village of Key Biscayne at a
Meeting to be held on Tuesday, June 28, 2016 at 7:00 p.m., in the Counci
Chamber, located at 560 Crandon Boulevard, Key Biscayne, Florida:
A CAPITAL PROJECT AUTHORIZING ORDINANCE OF THE VILLAGE
OF KEY BISCAYNE, FLORIDA, SELECTING A CONTRACTOR FOR
THE INSTALLATION OF ARTIFICIAL TURF ON THE ATHLETIC FIELDS
AT THE VILLAGE GREEN; PROVIDING FOR A WAIVER OF COMPETITIVE
BIDDING; PROVIDING FOR AUTHORIZATION; AND PROVIDING FOR
AN EFFECTIVE DATE.
The proposed Ordinance may be inspected by the public at the Office of
the Village Clerk. Interested parties may appear at the Public Hearing and
be heard with respect to the proposed Ordinance. Any person wishing to
address the Village Council on any item at this Public Hearing is asked to
register with the Village Clerk prior to that item being heard.
In accordance with the Americans With Disabilities Act of 1990, all persons
who are disabled and who need special accommodations to participate in
this proceeding because of that disability should contact the Office of the
Village Clerk, 88 West McIntyre Street, Suite 220, Key Biscayne, Florida
33149, telephone number (305) 365-5506, not later than two business days
prior to such proceeding.
Should any person desire to appeal any decision of the Village Council
with respect to any matter to be considered at this meeting, that person
shall insure that a verbatim record of the proceedings is made including
all testimony and evidence upon which any appeal may be based
(F.S. 286.0105).
Comments of any interested party relative to this matter may be submitted
n writing and or presented in person at the public hearing.
