Adjournment ti TIFFIN CITY COUNCIL REGULAR MEETING APRIL 14, 2010 TIFFIN FIRE STATION MEETING ROOM Mayor Royce Phillips called meeting to order at 6:30 pm. Roll Call of members present Chris Ball, Jim Bartels, Mike Gericke, Mark Petersen and Travis Weipert. Also present: City Attorney Steve Greenleaf, Engineer Doug Frederick, Public Works Brett Mehmen, and City Clerk Ruth Demuth. Motion made by Petersen and seconded by Weipert for approval of the agenda as printed. All following actions described in the minutes approved by all ayes unless so noted other. Community Forum: Bob Sentman, representative of Tiffin Community Fund, updated City Council on the progress of the Fundraising for the Picnic Shelter planned to be constructed in City Park. Sheriff Department was represented and Deputy inquired of concerns in City. Motion made by Gericke and seconded by Bartels for approval of minutes for March 10 and March 24, 2010 City Council meetings. Motion made by Gericke and seconded by Bartels for approval of Revenues and Expenditures. Council person Petersen questioned cell telephone monthly invoice and previous agreement with Little Clippers Child Development Center for city share of parking and sidewalk paving. Old Business: Motion made by Bartels and seconded by Petersen to open Public Hearing for North Liberty Annexation Moratorium. Bob Sentman asked Council members to re-consider the boundary line with North Liberty involving approximately eighty acres along the Jasper Ave and 270th St area. Mayor Phillips reported that North Liberty City Council had approved the proposed agreement on Tuesday April 13, 2010 and that the agreement is for possible future growth and development between the two cities. Motion made by Bartels and seconded by Gericke to close the Public Hearing. Discussion held on the proposed agreement. Motion made by Weipert and seconded by Bartels to approve Resolution 2010-14 For Approval of Annexation Moratorium Agreement Between the City of Tiffin, Iowa and the City of North Liberty, Iowa Regarding the Future Annexation of Properties Subject to Provisions of Iowa Code Chapter 368, with the amended boundary to allow the approximately eighty acres near Jasper Ave and along 250th St. NW. to be within the proposed future growth area for North Liberty. Ayes: Chris Ball, Jim Bartels, Mark Petersen and Travis Weipert. Nays: Gericke. Motion made by Gericke and seconded by Bartels to read and approve the third reading of Ordinance 2010-300 for Adoption of Code of Ordinances for the City of Tiffin, Iowa. Ayes: Chris Ball, Jim Bartels, Mike Gericke, Mark Petersen and Travis Weipert. Nays: None. Five members of the Council being present and voted Aye, Mayor Phillips declared the motion carried and signifies approval of same by affixing his signature thereto. Motion made by Ball and seconded by Petersen to set Public Hearing and possible first reading of Ordinance 2010-301 Planned Area Development Amendment for Woodfield Ridge for April 28, 2010. Greg Allen, representing Ned and Ann Allen in the matter of a request for the City of Tiffin's assistance in restructuring driveway after the Hwy 6 Widening Project, requested City to pay engineering costs and re-construction costs for project. Motion made by Petersen and seconded by Gericke to table action and move for further discussion at April 28, 2010 Work Session. Ayes: Ball, Gericke, Petersen and Weipert. Bartels abstained from vote. Motion made by Ball and seconded by Weipert to authorize Public Works Mehmen to proceed with electrical installation at City Park. Motion made by Bartels and seconded by Petersen to approve the personnel evaluation and the Mayor's recommendation for a 1%wage increase for Deputy City Clerk Caroline Koon effective July 1, 2010. New Business: Mayor Phillips read and declared a proclamation to establish the month of May as Older Americans Month in the City of Tiffin, Iowa. Proclamation submitted by Supervisor Rod Sullivan representing Johnson County Livable Community Initiative. Mayor Phillips reported that a re-zoning request, from residential zoning to commercial zoning, had been submitted by Tom Scheetz, owner of The Depot, for property to the south of The Depot. Planning and Zoning Commission would further review request in May and make a recommendation to City Council. Motion made by Ball and seconded by Weipert to approve membership of the City of Tiffin on the Iowa City Coralville Chamber of Commerce. Discussion held on the continuation of Open Burning in the City limits. Suggested that City progress toward possible mulching and composting instead of burning yard waste. Motion made by Bartels and seconded by Ball to allow Open Burning in the city limits during the weekend days, during daylight hours of May and October 2010 and discontinue Open Burning in 2011. Recommended that yard waste be taken to City Burn Pile as much as possible. Concerns were voiced on the displeasure of many residents living on Kimberlite St. with the City Burn Pile. Public Works stated that as soon as seasonally possible they would relocate Burn Pile to the east end of the city property away from residential units. Projects: Engineer Frederick reported that Iowa Dept of Transportation conducted final inspection of Hwy 6 Widening Project and approved reimbursement to the City. Motion made by Petersen and seconded by Gericke to approve final pay estimate#4 to Dave Schmitt Construction in the amount of$25,145.19 for the 2009 Water and Sanitary Sewer along Ireland Avenue Project. Jlotion made by Gericke and seconded by Petersen to approve final pay estimate#3 to Drew Cook and Sons in the - amount of$12,591.97 for the 2009 Sanitary Sewer Park Improvements. Kum and Go and the Subway Sandwich Shop report to be on schedule weather permitting and still anticipate a mid-May 2010 opening date. LMR Development still in process to complete conveyance of land to City and granting easements for utilities to site of Bella Sala Banquet Facility. Attorney will check on completion of documents. Engineer Frederick reported that final testing of 2008 Water Main Extension to be completed as weather permits. City Wide Construction in final stages of completing seeding and punch list items for Trails Phase Three Project. Iowa Dept of Transportation will forward final reimbursement to City. Engineer Fredrick working on final designs of Trails Phase Four upon land acquisition with landowner. Mayor and City Council members will attend Clear Creek Amana School Board meeting on April 21, 2010 to represent College St residents regarding design of Ireland Ave Extension Project. Roberts Ferry Rd moved to April 28, 2010 Work Session discussion. Iowa Finance Authority approved a planning and design loan for Water Main Extension under 1-80 Project in the amount of$42,000. Further discussion on Municipal Building moved to April 28, 2010 Work Session. No new progress reported on five year Capital Improvement Plan. Reports: Bob Sentman reported on fund raising efforts for the Tiffin Community Fund Picnic Shelter to be built in City Park. Mayor Philliips reported on progress of TiffinFest planning. Athletic Field improvements were reviewed and report given on reservations scheduled for ball fields. City Council members appointed to represent Library Board reported that the Library had received a grant for improvements. Attorney Greenleaf reported on current update of legal litigation involving the LDR lawsuit. Engineer Fredrick reported that City Engineer still obtaining additional information on Water Pressure equipment. Public Works Mehmen presented proposals for emergency road work for Roberts Ferry Rd from Shamrock Construction Company and LL Pelling Inc. Discussion held on proposals and time line to make repairs. Motion made by Petersen and seconded by Gericke to award repairs to LL Pelling upon recommendation from Public Works for an estimated cost of $11,149. Public Works will addressdrainage concerns in area in need of repairs. Mayor pro-tern Petersen questioned the Mayor regarding the Money Market investments made by the City and questioned the employee handbook and it was suggested that these topics be placed on the Work Session for April 28, 2'010. Petersen also questioned decisions made by the Building Official, Ed Johnson regarding the Little Clippers Child Development Center. Attorney Greenleaf was asked to review procedures followed and determine if proper protocols were followed in the construction of the parking and landscaping at Little Clippers Child Development Center. Mayor Phillips approved Council person Bartels to proceed with checking on an appraiser to begin the process of land acquisitions for the Ireland Avenue Extension. Attorney Greenleaf reminded them the appraiser will need to be IDOT certified. Motion made by Gericke and seconded by Bartels for adjournment at 8:55pm.
