Councilmember Zoldos arrived at 7:55 p.m. D. Minutes - June 11, 2001 Work Session On a motion by Councilmember Schmidt, seconded by Councilmember Jackson, the minutes of the ,lune 11, 2001 work session were approved on a 5-0-2 vote. E. Presentations a. THEREFORE, the Mayor and Town Council of the Town of Leesburg in Virginia hereby proclaim the month of July 2001 as Parks and Recreation Month. Citizens are encouraged to celebrate by participating in their choice of quality of life activities and experiences, as well as maintaining these healthy and happy activities and attitudes throughout the year. PASSED THIS l0TM DAY OF July, 2001. F. Petitioners Kenneth Hubbard, 41951 Saddlebrook Place, addressed Council representing the Loudoun County PTSA. Mr. Hubbard thanked the Town of Leesburg for their support of the all night graduation party by providing the use of Ida Lee Recreation Center. Kelly Howeter, 703 Country Club Drive, SW, addressed Council thanking them for the recent 4th of July fireworks display and the bus transit service. She stated that her family has been visiting and the bus service was very helpful to them. G. Public Hearing None Nm Council Comments Councilmembers Atwell and Jackson had no comments. Councilmember Schmidt expressed concern with the transportation planning the Loudoun County Board of Supervisors is undertaking and their proposal to remove roads. Vice-Mayor Umstattd reported she had attended a reception at the Mt. Zion Methodist Church for the new minister, Reverend Thompson. ]:. Mayor's Comments Mayor Webb reported the Town of Leesburg would be the recipient of a HUD grant in the amount of $643,000 for restoration of the house at Dodona Manor. The mayor read a letter from Douglas L. Fleming, Jr., counsel for Arcadia Development Company. Mr. Fleming's letter confirmed Arcadia's request to postpone the consideration of the Potomac Crossing Rezoning and Town Plan amendment until a later date. They will contact the town when a date is finalized. Manager's Report Bob Noe reported that the Current Planning Division activity on the Manager's Report has been revised. Town Council Minutes for July 10, 2001 Paqe :3 Councilmember Atwell asked Mr. Noe to clarify the status of the Economic Development Director and secretary vacancies. Mr. Noe advised the Economic Development Commission would be providing a recommendation to Council for an alternative solution. K. Legislation: POTOMAC CROSSING The following proposed legislation was postponed at the request of the applicant, Arcadia Corporation. ORDINANCE Approving Rezoning Application ZM-2000-05 - Potomac Crossing PRC - Concept Plan and Proffer Amendment RESOLUTION Denying Rezoning Application ZM 2000-05, Potomac Crossing PRC, Concept Plan and Proffer Amendment ORDINANCE Approving an Amendment to the Land Use Element of the 1997 Town Plan, TP 2000- 02, in conjunction with ZM 2000-05 Potomac Crossing PRC, Concept Plan and Proffer Amendment RESOLUTION Denying an Amendment to the Land Use Element of the 1997 Town Plan, TP 2000- 02, in conjunction with ZM 2000-05 Potomac Crossing PRC, Concept Plan and Proffer Amendment ORDINANCES ] ORDINANCE Amending Chapter i0, Article VI, Division 3, Sections 10-187 & 10-188, of the Town Code for hours of free parking and for parking fees for spaces rented on a monthly basis in the parking garage. Councilmember Schmidt made a motion, seconded by Mayor Webb, proposing an amendment to the proposed ordinance to eliminate the discount for renting 8 parking spaces in the parking garage. The motion to amend was adopted by the following vote: Aye: Atwell, McDonald, Schmidt and Mayor Webb Nay: Jackson and Vice-Mayor Umstattd Vote: 4-2-1 (Zoldos absent) Councilmember Atwell made a motion, seconded by Councilmember Jackson, to amend the proposed ordinance to leave the two free hours of parking in the parking garage. The motion to amend was adopted by the following vote: Aye: Atwell, .lackson, McDonald, and Vice-Mayor Umstattd Nay: Schmidt, and Mayor Webb Town Council Minutes for July 10, 2001 Paqe 4 Vote: 4-2-1 (Zoldos absent) The amended motion to eliminate the discount for renting 8 parking spaces in the parking garage and retention of the 2-hour free parking was adopted as follows: 2001-O-9 ORDINANCE Amending Chapter 10, Article VT, Division 3, Section 10-188, of the Town Code for parking fees for spaces rented on a monthly basis in the parking garage. Aye: Atwell, .lackson, McDonald, Schmidt, Vice-lVlayor Umstattd, and Mayor Webb Nay: None Vote: 6-0-1 (Zoldos absent) CONSENT AGENDA On a motion by Vice-Mayor Umstattd, seconded by Councilmember .lackson the following consent item was proposed: 2001-124 RESOLUTION Accepting public improvements, releasing the performance guarantee and approving a maintenance guarantee for public improvements at Potomac Station/Xerox Sewer Outfall. The motion was adopted by the following vote: Aye: Atwell, Jackson, McDonald, Schmidt, Vice-Mayor Umstattd and Mayor Webb Nay: None Vote: 6-0-:1 (Zoldos absent) REGULAR AGENDA The following motion was proposed: RESOLUTION Rescinding Resolution No. 2000-244 approving engineering services for the Chancellor Street extension. This motion was tabled at the request of Councilmember McDonald until the next council meeting to allow all councilmembers to be present for a vote. On a motion by Councilmember Jackson, seconded by Councilmember McDonald, the following motion was proposed. 2001-125 RESOLUTION Setting the Town Council Calendar. Boards and Commissions Councilmember McDonald asked that the appointment to the Board of Architectural Review be deferred until the next Town Council meeting On a motion by Councilmember McDonald, seconded by Vice-Mayor Umstattd, the following motion was proposed: 2001-126 RESOLUT]:ON Making an appointment to the Planning Commission - Teresa Minchew The motion was adopted by the following vote: Aye: Atwell, Jackson, McDonald, Schmidt, Vice-Mayor Umstattd and Mayor Webb Nay: None Vote: 6-0-1 (Zoldos absent) M. New Business Mayor Webb referenced a letter from Drew Hiatt, Loudoun County Board of Supervisors, asking for Council's position on critical policy issues with reference to the County's comprehensive plan. After considerable discussion on policy issues, the following motion was proposed by Councilmember Jackson, seconded by Councilmember McDonald. 2001-127 RESOLUT]:ON: COMMUNZCATZNG THE TOWN OF LEESBURG'S COMMENTS ON THE LOUDOUN COUNTY DRAFT GENERAL PLAN AND DRAFT COUNTYWZDE TRANSPORTATZON PLAN WHEREAS, Loudoun County is in its last stages of review of the proposed revisions to the Draft General Plan and Draft Countywide Transportation Plan; and WHEREAS, the Loudoun County Board of Supervisors has recently made several changes to the Draft that directly impact the Town of Leesburg; and WHEREAS, the Town Council wishes to communicate to Loudoun County its comments and concerns regarding these revisions, and recommends the Board's serious consideration of the same. THEREFORE, RESOLVED the Council of the Town of Leesburg in Virginia hereby transmits its comments regarding the Draft General Plan and Countywide Transportation Plan as follows: Town Council Minutes for July 10, 2001 Page The current draft Countywide Transportation Plan (CTP) deletes the section of Crosstrail Boulevard between the Dulles Greenway and Route 15 south. The Town considers Crosstrail Boulevard to be of utmost importance to the future development of the Urban Growth Area (UGA) and to maintaining adequate levels of service to the Town's transportation system. The Town therefore opposes the deletion and/or relocation of any section of the roadway. The Council further recommends that its classification as a major collector be maintained. 2. The Draft Plan anticipates keynote employment land use generally located just east of Goose Creek, fronting on Route 7 and bounded on the east by Route 659 (Belmont Ridge Road). The Town does not support this use at this location. 3. The Draft Plan proposes the use of communal water and wastewater facilities for public institutions in the UGA. The Town reiterates its opposition to such facilities as stated in Resolution #2000-101 dated May 23, 2000. 4. Both Draft Plans propose the designation of Edwards Ferry Road as a two-lane facility with a bike path. The Town continues to support a four-lane roadway as shown in the existing Town and County transportation plans. The Town supports the Virginia Byway designation, provided that the Loudoun County section of Edwards Ferry Road is developed as a four-lane roadway as stated in Resolution #2001-73 dated May 22, 2001. 5. The Draft Plan supports a future study of extending the Dulles Corridor Bus Rapid Transit/Rail Project to Leesburg. The Town supports establishing BRT service west of Leesburg with a station in the Route 7/Route 9 corridor, and a station in Leesburg adjacent to the Dulles Greenway. 6. The Draft Plan proposes the remapping of zoning classifications around the Leesburg Executive Airport. The Town supports only zoning classifications that are in conformance with the non-residential land use designations in the Town Plan for the UGA. 7. The Draft Plan proposes deleting the portion of the UGA west of the Dulles Greenway. The Town has consistently opposed any alteration in the Leesburg UGA until the annexation study is completed. This objection was recently reiterated in the Mayor's comments (attached) to the Board of Supervisors on May 31, 2001. 8. The Draft Transportation Plan proposes the deletion of the Western Transportation Corridor thus ensuring Rt. 15 remains the Western Transportation Corridor by default. The Town continues to strongly support a Western Transportation Corridor, which provides a new river crossing of the Potomac. The vitality of the Town of Leesburg depends on a Western Transportation Corridor located to the east of Leesburg with a new river crossing. Closed Session Vice-Mayor Umstattd expressed concern with a closed meeting to discuss annexation matters. William Donnelly stated that our consultants, Carter Glass and Milt Milton, have recommend a closed session to discuss the pending petition to annex. On a motion by Mayor Webb, seconded by Councilmember McDonald, the following motion for a closed meeting was proposed: Pursuant to Sections 2.1-344 (A)(7) and 15.2-2907-(D) of the Code of Virginia, ! move that the Leesburg Town Council convene in a closed meeting for discussion of legal and annexation matters. The motion was adopted by the following vote: Aye: Atwell, Jackson, McDonald, Schmidt, and Mayor Webb Nay: Vice-Mayor Umstattd Vote: 5-1-1 (Zoldos absent) Council reconvened at 9:20 p.m. and Mayor Webb proposed the following motion, seconded by Councilmember McDonald. !n accordance with Section 2.1-344.1 of the Code of Virginia, ! move that Council certify that to the best of each member's knowledge, only public business matters lawfully exempted from open meeting requirements under the Virginia Freedom of !nformation Act and such public business matters as were identified in the motion by which the closed meeting was convened were heard, discussed or considered in the meeting by Council.
