AN ORDIhiANCE AMENDING CIIAPTER 22 OF THE M[I+7ICIPAL CODE, BEING ORDI-
NANCE NO. 2325-1968, COMMONLY KNOWN 4S THE ZONING ORDINANCE OF THE
CITY OF RICiMND, INDIAN& ADOPTED JUNE 3, 1368, PROMUU FOR THE
REZONING OF FORTY -(40) ACRES OF NE44.Y AN[U= TERRITORY FROM R-1
SINGLE FA14nx RESIDENCE DISTRICT TO R-4 ImLTI-FAMILY RESIDENCE DIS-
TRICT LTON T3iE EFFEG'IVE DATE OF A2IMMION.
WHEREAS, Ordinance No. 32-1980 annexed forty (40) acres on the
southeast side of Richnund; and,
WiIEREAS, pursuant to Article 14.06 of the Zcning Ordinance newly
annexed territory is placed in. the It 1 Single Family
Residence District as a temporary zoning classification
until such time as the Plan Commission small reconrnend
to Common Council a pe=men.t zoning district plan; and,
WIIiS, it is the intent and purpose hereof to change the zoning
classification of the newly annexed territory upon the
effective date of the atmexation from R-1 Single Family
Residence District to R-4 Multi -Family Residence District;
and,
UMREAS, a study of this Ordinance was conducted by the RichwrO
City Plan Commission the 27th day of May, 1980, at which
time remonstrances were heard from all parties interested
in or affected by this Ordinance.
WHER E.4S, the vote of the Richmond City Plan Commission was seven (7)
to zero (0) in favor of recommending the passage of Ordinance
No. 55-1980.
NOW THEL'SFORE BE 1T ORDAIM by the Ccxn€man Council of the City of
Richmond, Indiana, as follows:
SECTION 1. That the zoning classification of the property described
below be, and the same is hereby changed to R-1 Multi -Family'
Residence District upon the effective date of Annexation
Ordinance No. 32-1980, and that said property be regulated
in accordance with the Zoning Ordinance of the City. of Rich-
mond, Indiana and all amendaernts thnroto:
Being a part of the Southeast Quarter of Section Thirty-
five (35), Township Fourteen (14) North, Range One (1)
West, and a part of the Northeast Quarter of Section Two
(2), Township Thirteen (13) North, Range One (1) West,
in Wayne Tb mship, Wayne County, Indiana and being more
particularly described as follows:
Beginning at a point on the present corporation line of
the City of Richmond, Indiana, said point being north
zero (0) degrees and thirty-eight (38).rdmtes west, one
hundred thirty-one and eight tenths (131.80) feet and
south eighty-eight (88) degrees and thirty-four (34)
minutes east four hundred and fifty (450) feet from the
southwest corner of the southeast quarter of said Section
Thirty-five (35) to a point in the present corporation
line, and rL=dng thence, from said beginning point along
the said corporation line south eighty-eight (88) degrees
and thirty-four (34) minutes east five hundred twelve and
seventy-four hundredth (512.74) feet; thence along the said
corporation Buie south zero (0) degrees and thirty-eight

hundredths (243.45) feet; thence along the said corporation

SECTION 2. This Ordinance shall be in full force and effect from and
after its passage and approval as by law required.

The Rielmond City Plan Cormi.ssion conducted a public hearing on
Tuesday, May 27, 1980, pursuant to Article 14.06 of the Zoning
Ordinance regarding the zoning district plan for the forty (40)
acres newly annexed by Ordinance No. 32-1980. Article 14.05
specifies that newly annexed territory shall be zoned R-1 Single
Family Residence District as a tcrnporary zoning classification
until such time as the Plan Commission shall recommend to Comwn
Council a final zoning district plan.
Prior to being annexed, the subject forty (40) acres w1=re located
within the Plan Commission's two node fringe jurisdictional area
and zoned R-4 Multi -Family Residence District.
The Plan Commission voted severe (7) to zero (0) to recommend to
Council that upon the effective date of the a<ueDmtion, chi cl► is
July 21, 1980, the newly annexed territory shall be rezoned to
R-4 as provided in Ordinance No. 55-1980-
