Members present: Mayor, Wayne Neddermeyer; Councilmen, Donald DeaLauriers, Arthur Theis, Robert Franklin, William Reiser; Clerk, Donna Roehl; Planning and Zoning Administrator, Anne Dorweiler; Attorney, Richard Schieffer. Motion by Arthur Theis, seconded by Donald DesLauriers to accept the minutes of meeting of March 16, 1976, as presented. Motion carried unanimously Motion by Donald DesLauriers, seconded by William Reiser to accept the minutes of March 22, 1976, with the correction in Item 1 to read"fence must not be closer than 3 feet to property line." Motion carried unanimously 1. ED SORGATZ, HENNEPIN COUNTY PARK Mr. Sorgatz explained that Park personnel had met iwth Don Anderson, and Ray Hoosier to out- line problem areas in regards to weed control in the park. Mr. Hoosier was satisfied with the plans. Park personnel are beginning to work toward better weed control. Regarding the Vo Tech School, he stated that they had met with Vo Tech people and Council would be receiving a letter regarding park concerns with water run-off, storm sewers, etc. CC) CRAIG SPENCER, HENNEPIN COUNTY HIGHWAY DEPARTMENT . Spencer explained the transportation study that had beenxecently completed, and the need for direction from the Council as to the study. The first indication they had from Medina was approximately 2 - 3 years ago when the Planning Commission stated a need for a North - South road through Medina. Studies were begun countywide and a guide has been developed. All future planning would need council approval. Some action must be taken as the study must be sent to the Metro Council for approval. They will consider any exceptions to the prepared resolutions. As Mr. Jubert, who had attended the study meetings, was not yet in attendance, and Council agreed to table until he arrived. 3. DOCKSIDE INN HEARING, 8:13 P.M. Mr. Schieffer stated that evidence would be presented from the City Clerk and the Chief of ^c-i, Police in the matter of revocation of liquor licenses of Dennis Sazenski. A Court reporter was present to record the testimony. Following the testimony the following findings were read by Mr. Schieffer: In the matter of the revocation of the On -Sale and Off -Sale liquor licenses of Dennis Sazenski, of the Dockside Inn by the City of Medina 1. The City Council granted On -Sale and Off -Sale liquor licenses to Dennis Sazenski for the Dockside Inn located at 2775 Co. Rd. 19, in the City of Medina 2. Pursuant to Section 1000.10, Subd.2 and Subd. 3 of the Medina Liquor license Ordinance, Mr. Sazenski filed with the City, a bond, in the amount of $1000.for his Off -Sale liquor license, with the Fidelity and Deposit Co. of Maryland, as surety; and a bond in the amount of $3000. for his On -Sale liquor license, with the Fidelity and Deposit Co. of Maryland as surety. 3. On. February 27, 1976, the City of Medina was notified that the On -Sale Bond would expire within 30 days and on March 15, 1976, the City of Medina was notified that the Off -Sale Bond would be cancelled as of March 29, 1976. 4. The City Council set a hearing to consider the revocation of said On -Sale and Off - Sale liquor licenses for April 6, 1976 and caused notice thereof to be sent to the last known address of Dennis Sazenski and caused notice thereof to be published in the Cities official newspaper, stating that the grounds of revocation are the fail- ure to keep on file with the city, valid bonds, pursuant to City Ordinance and State Law. 5. The Dockside Inn has been closed since day of February, 1976 and the residence of Dennis Sazenski has been vacant since the day of February, 1976 and the said Dennis Sazenski cannot be found. 26 6. The On -Sale and Off -Sale Bonds of Dennis Sazenski for the Dockside Inn, have been revoked and are of no further force or effect. 7. Wherefore, the On -Sale and Off -Sale liquor licenses of Dennis Sazenski are hereby revoked and the Chief of Police is hereby directed to post notice thereof on the Dockside Inn premises. Motion by Arthur Theis, seconded by Donald DesLauriers to adopt the findings of the hearing. Motion carried unanimously Motion by Donald DesLauriers, seconded by William Reiser, to close the revocation hearing. Motion carreid unanimously 1 4. ANNE DORWEILER Bizzano-Jackson, etcl, land division Report by Anne Dorweiler that the portion of land purchased by Mr. Bizzano amounted to 4.73 acres, according to report from Hennepin Co. She recalulated and found it to be 4.82 acres. Motion by Donald DesLauriers, seconded by Arthur Theis to approve the Jackson division because it is very close to 5 acres, is the most feasible division of the property and there is evidently a legal description error. Motion carried unanimously Gerald Dykhoff Mr. Dykhoff explained the contemplated division of his property to allow Medina Recreation to purchase a portion of his property that abuts theirs. Mr. Schieffer stated that Mr. Dykhoff had asked him to represent him and if it meant interpretation of Ordinance 118 he would ask Mr. Dykhoff to secure other legal counsel. Matter to be discussed at a later date. Scherer -Heideman Division Mr. Schieffer explained the Resolution and Agreement he had been instructed to draft. The agreement allows that when a 6th person applies for a building permit the road will need to be blacktopped by property owners. If agreement is approved it will be filed with the deed. Motion by Arthur Theis, seconded by Donald DesLauriers to approve Resolution 76-15, approving the Scherer -Heideman division upon payment of $46.66 in fees. Motion carried unanimously 5. WILLIAM COLEMAN Mr. Coleman requested instructions as to applying for the licenses of the Dockside Inn. Dis- cussion of liens and outstanding debts against the property. Mr. Coleman stated that he understood Mr. Baldwin and Mr. Anderson were to take care of the liens against the preperty. Council felt that they would need to be satisfied regarding debts before granting of a license. 6. NORTHWEST SUBURBAN CHAMBER OF COMMERCE Motion by Donald DesLauriers, seconded by Robert Franklin to pay the current dues of the NW Suburban Chamber of Commerce. Motion °armed. 7. VO TECH SCHOOL Mr. Neddermeyer stated that he had asked Mr. Schieffer to recheck advice he had given the Planning Commission regarding proper procedures. Mr. Schieffer said that his suggestion to the Planning Commission was based on the fact that the Vo Tech Schools would be using the land for agricultural use and they would have to decide whethe r that was the use the land would be put to or if a full campus should be considered. He felt that Vo Tech had not given sufficent information to decide whether a C-2 Zoning or R-A amendment was needed. Robert Franklin presented a resolution he had prepared regarding information to be gatherer by the Planning Commission to assist in making a proper decision. Wayne Neddermeyer felt that the Planning Commission had a right to act on rezoning and nevi n_tnot take advice from the attorney or the Zoning Admihistrator. Russell Krueger stated that if one part of the school were allowed to be put in then a hard- ship could be claimed and the remainder of the campus could be grandfathered in. Paul Bu.egler, attorney for To Tech stated that the application is to proceed with the 27 specialty crops building and they are not in a position to present full plans. Richard Marklund stated that the Park Board would be sending a letter to Metro Council recommending that no permit be issued until proper impact statement regarding the community, park, etc. wer submitted. Mr. Gresser gave names of officials they had met Stith: Hennepin Co. Highway, Hennepin Co. Park, Minnesota Environmental quality Control, Minnehaha Watershed. Names are on file with the District Office. He also said that they would address themselves to the Resolution of Mr. Franklin. Motion by Robert Franklin, seconded by Arthur Theis to adopt Resolution 76-16 regarding matters to consider concerning the Vo Tech application. Voting Yes, Donald DesLauriers, Robert Franklin, William Reiser. Voting No, Arthur Theis, Wayne Neddermeyer. Motion carried. 8. HENNEPIN COUNTY TRANSPORTATION STUDY Robert Franklin read prepared resolution regarding position Medina could take regarding the study. Discussion with Emil Jubert. Motion by Robert Franklin, seconded by Arthur Theis to adopt Resolution 76-17 regarding Hennepin County Transportation Study and how it applies to Medina. Motion carried unanimously 9. WILLIAM FENHOLT Discussion of request received from Hennepin County regarding release of tax forfeit lots at Lake Indpendenee. Mr. Fenholt explained what had happened regarding his attempt to pur- chase the lots from the owner and later found that they had been forfeited. If proper title can be obtained and baok taxes paid thespecial assessments could be figured into price of land. It was suggested that perhaps title could be gotten and no Council action would be necessary. Mr. Fenholt will discuss further with his attorney. 10. PERSONNEL Building Inspector Council discussed inspections, etc. that need to be done and whether Building inspector needed some sort of assistance from another person. Motion by Robert Franklin, seconded by Arthur Theis to ask Russ Bouley if he wants some assistance and if so, can he find the proper person. Motion carried unanimously Donald DesLauriers will discuss with Mr. Bouley Roads Discussion as to what manpower is needed on roads and work that needs to be done this spring. Motion by Donald DesLauriers, seconded by Arthur Theis to hire Robert Dressel as a full time street maintainence man and pay him $4.50 per hour. Motion carried unanimously Water and Sewer Discussion of 2 reports received from Lyle Swanson regarding the number of hours per month needed to service the Hamel and Ind. Beach utilities. Leo was asked to study the reports and discuss with Council at next meeting. Robert Franklin felt that a flat rate for work preformed might be a solution. Discussion of bill submitted for clothing of Don Kuckacka, damaged by acid. Council again stated their position regarding the decision previously made. 11. BILLS Motion by Arthur Theis, seconded by Robert Franklin to pay all bills except Stevens Well Co. Order Checks # 5910-5974 in the amount of $21,240.69 and Payroll #3988-4015 in the amount of $4746.94. Motion carried unanimously Motion by Donald DesLauriers, seconded by Arthur Theis to correct minutes of Feb. 3, 1976 order check amount addition of $20.00 to correct error in addition. -Motion carried unanimously Discussion of various radio systems that are available for city trucks. 12. INSURANCE BIDS Motion by Robert Franklin, seconded by William Reiser to accept the bid of Wayzata Agency Inc. and return checks of other bidders. Motion carried uananimously Motion by Donald DesLauriers,seconded by Arthur Theis to adjourn.
