Councilmembers Present: George Atwell, Mervin Jackson, Leonard McDonald, David Schmidt, Kristen Umstattd, Robert Zoldos, and Mayor Webb. Minutes: On a motion by Councilmember Zoldos, seconded by Councilmember Jackson, the minutes of the February 25, 2002 work session, February 26, 2002 regular session were approved with edits by Councilmember Schmidt. E. Presentations: a. Women's History Month - Proclamation Ms. Til Benny of the Loudoun League of Women Voters was present to accept the proclamation for Women's History Month. PROCLAMA T_rON WOAIEN'S Hr_STORY MONTH MARCH, 2002 WHEREAS, from the time of the Revolutionary War to the present, American women have worked for liberty and freedom for people around the world; and WHEREAS, in March of 1981 Congress passed a resolution declaring a National Women's History Week; and WHEREAS, in March of 1987, Congress passed a resolution that expanded the national celebration of Women's History Week to the entire month of March; and Town Council minutes for March 12, 2002 Page 2 WHEREAS, historically, the state of Virginia has been home to many notable women of great resolve and courage, such as Pocahontas, Clara Barton, Elizabeth Keckley and Elizabeth Van Lew; and WHEREAS, the state of Virginia is also the birthplace of many notable women of today, such as Shirley McLaine and Katie Couric. THEREFORE, the Mayor and Town Council of the Town of Leesburg in Virginia hereby proclaim the month of March of the Year 2002 as Women's History Month in the Town of Leesburg and urge the citizens of Leesburg join in recognizing the accomplishments and historical contributions made by women throughout the history of our nation. EAC Presentation to (Loudoun Environmental Zndicators Project) LEZP Mayor Webb, along with Scott McDonald and Sandy Kane of the EAC, presented a check to Cate McGinnis Wyatt and Dom McGraff of George Washington University. Council Comments Councilmember McDonald asked Council to proceed with the proposed annexation and to begin the process of involving citizens in the decision making process of what would be done with the property. Councilmember Zoldos stated that the Annexation Committee had received a request from Greenway Farms to have an information-sharing program at their HOA meeting on Thursday. He also stated that the Parks and Recreation Commission had visited the Balls Bluff Park site and that he would bring the video for Council to view at the next meeting. He further complimented the Parks and Recreation staff for their work at the Izaak Walton Park, and asked that a Certificate of Appreciation be awarded to those employees who participated in the rehabilitation. Councilmember Atwell and Councilmember .lackson had no comment. Vice-Mayor Umstattd stated that she had toured the Water Treatment Plant with her daughter and recommended that other citizens take advantage of that opportunity. Councilmember Schmidt thanked Troop 1159 for their interest in the town government. He further discussed the issue of litter around the town and reminded citizens of the Adopt-A-Street program, which the town could participate in. Town Council minutes for March 12, 2002 Paqe 3 Mayor's Comments Mayor Webb thanked Troop 1159 for their participation in the meeting. She addressed the economic state of the area in the wake of September 11th and stated that residents are concerned about tax increases. She further stated that with the state of the economy the town would have some tough decisions to make regarding the FY03 budget. Manager's Report a. FY-2003 Proposed Budget Mr. Noe stated that the common denominator of the budget is trying to balance staff needs with the expectations of the citizens and Council. He thanked staff members who helped with this year's budget. Mr. Noe then outlined his recommendations for this year's budget including a two-cent increase in real estate taxes and a .5% increase in the meals tax. He also addressed the town's debt situation and the amount of money required from the budget to pay it down yearly. Mike Freda discussed the impact of the tax increase on the average citizen and outlined the revenue sources and general fund expenditures. Mr. Noe concluded his report by asking for an executive session at the end of the meeting to discuss a legal matter. K. Legislation [ ORDINANCES On a motion by Councilmember Jackson, seconded by Vice-Mayor Umstattd, the following motion was proposed: 2002-0-4 ORD]:NANCE Approving a Joint Powers Association Agreement between the Town of Leesburg in Virginia and the Virginia Energy Purchasing Governmental Association. The motion was adopted by the following vote: Aye: Atwell, Jackson, Mcdonald, Schmidt, Zoldos, Vice-Mayor Umstattd and Mayor Webb Nay: None Vote: 7-0 On a motion by Councilmember Jackson, seconded by Vice-Mayor Umstattd, the following motion was proposed: 2002-O-5 ORDXNANCE Approving Special Exception SE-2001-05 - Jerry's Chevrolet/Oldsmobile to permit an auto sales/rental/and repair facility. The motion was adopted by the following vote: Aye: Atwell, Jackson, McDonald, Schmidt, Zoldos, Vice-Mayor Umstattd and Mayor Webb Nay: None Vote: 7-0 REGULAR AGENDA On a motion by Councilmember Schmidt, seconded by Vice-Mayor Umstattd the following motion was proposed: 2002-32 RESOLUTION Awarding a contract to Campbell & Paris Engineers to provide architectural, engineering and project management services at Leesburg Executive Airport. The motion was adopted by the following vote: Aye: Atwell, .lackson, McDonald, Schmidt, Zoldos, Vice-Mayor Umstattd and Mayor Webb Nay: None Vote: 7-0 On a motion by Vice-Mayor Umstattd, seconded by Councilmember Zoldos, the following motion was proposed: 2002-33 RESOLUTION Approving Change Orders 13 thru 18 for the South King Street Tmprovement project in the amount of $146,233.28. Boards and Commissions New Business On a motion by Councilmember Atwell, seconded by Councilmember Jackson, the following motion was proposed: 2002-35 RESOLUTION Authorizing Counsel to agree to a continuance of the Commission on Local Government's hearing on annexation. The motion was adopted by the following vote: Aye: Atwell, Jackson, McDonald, Schmidt, Zoldos, Vice-Mayor Umstattd and Mayor Webb Nay: None Vote: 7-0 On a motion by Councilmember Atwell, seconded by Councilmember Jackson, the following resolution was proposed: 2002-36 RESOLUTZON Authorizing financial assistance to Dodona Manor. On a motion by Vice-Mayor Umstattd, seconded by Councilmember Schmidt, an amendment was proposed to the resolution to change the word "will" to "may" The motion to amend was adopted by the following vote: Aye: McDonald, Schmidt, Zoldos and Vice-Mayor Umstattd Nay: Jackson, Atwell and Mayor Webb Vote: 4-3 The amended motion was adopted by the following vote: Aye: Atwell, .lackson, McDonald, Schmidt, Zoldos, Vice-Mayor Umstattd and Mayor Webb Nay: None Vote: 7-0 Town Council minutes for March 12, 2002 Page 6 Closed Session On a motion by Mayor Webb, seconded by Councilmember Zoldos the following motion was proposed: Pursuant to Section 2.2 -3711 of the Code of Virginia, T move that the Leesburg Town Council convene in a closed meeting for discussion of a legal matter. The motion was approved by the following vote: Aye: Atwell, .lackson, McDonald, Schmidt, Zoldos, Vice-Mayor Umstattd and Mayor Webb Nay: None Vote: 7-0 Council convened in a closed session at 9::~5 p.m. Council reconvened and Mayor Webb, seconded by Councilmember McDonald, proposed the following motion: In accordance with Section 2.1-344.1 of the Code of Virginia, I move that Council certify that to the best of each member's knowledge, only public business matters lawfully exempted from open meeting requirements under the Virginia Freedom of Information Act and such public business matters were identified in the motion by which the closed meeting was convened were heard, discussed or considered in the meeting by Council.
