Councilmembers Present: George Atwell, Mervin Jackson, Leonard McDonald, David Schmidt, Kristen Umstattd, Robert Zoldos, and Mayor Webb. Minutes: On a motion by Councilmember Schmidt, seconded by Councilmember Jackson, the minutes of the March 11, 2002 Work Session and March 12, 2002 Regular Session were approved as presented. Presentations: a. Public Health Week - Proclamation Dr. David Goodfriend of the Loudoun County Health Department was present to accept this proclamation for Public Health Week. PROCLAIVlA TZON PUBLZC HEALTH WEEK APRZL 1-7, 2002 WHEREAS, over the past year, our public safety and health departments have been working closely with our medical community, schools and elected and appointed officials to keep our citizens safe from anthrax and other forms of bioterrorism; and WHEREAS~ over the past year, the Health Department has taken the lead in keeping our residents safe from West Nile virus and contributed to keeping our environment and our water supply safe for ourselves and our children; and WHEREAS, over the past 50 years, the United States and Leesburg have achieved significant increases in life expectancy and reductions in the incidence of infections, childhood deaths, and disease; and WHEREAS, National Public Health Week provides the focused opportunity for our residents to learn about public health success stories, including the fight against bioterrorism, protection of our environment, and continued frontline efforts to immunize all our children against infectious disease, maintain good nutritional standards and promote healthy women having healthy babies; and Town Council Minutes for March 26, 2002 Page 2 WHEREAS, the National Public Health Week theme - Healthy People in Healthy Communities - encompasses our goals as a community that our homes, neighborhoods and communities are places we all, especially children, can thrive. THEREFORE, the Mayor and Town Council of Leesburg in Virginia hereby proclaim the week of April 1-7, 2002 as National Public Health Week, and urge the citizens of Leesburg to join in recognizing the dedication and numerous accomplishments of the Loudon County Health Department and all public health workers throughout the area. PROCLAIMED this 26th day of March 2002. F. Petitioners There were no petitions. Gm Public Hearing a. Leesburg Station Car Wash - SE-2001-08 Nancy Kitchens gave a brief presentation of this application. provided photos from the yard of a house in the adjoining Oakview neighborhood showing the proximity of the car wash to the homes. She Further, Ms. Kitchens outline staff's recommendation. Council raised questions about wastewater and whether it will have any impact on the creek; will the car wash accommodate anything larger than pickup trucks; and what is the minimal temperature at which the car wash will operate. Tom Magazine, the applicant, addressed Council explaining how this full service car wash would operate. He stated the car wash would have 33 car stacking spaces. There will be very little chance of run-off, as the cars will come out 95% dry. The water will be treated using a water reclaim system. Mr. Magazine added the car wash theme is that of an antique railroad station. Mayor Webb verified the car wash would use approximately 2,000 gallons in a 24 hr. period. Councilmember McDonald expressed concern with the impact of any mandatory water restrictions on the car wash. The applicant stated the industry is always looking at ways to minimize water usage. Councilmember Schmidt verified this site would only be used for car washing. The public hearing opened at 8:05 p.m. Ann Marie Davis, 141 Oakview Drive, addressed Council in opposition to the car wash citing inadequate screening, noise and light spilling into her neighborhood. Town Council Minutes for March 26, 2002 Page 3 Further, she had concerns with the additional traffic that would be generated onto the already overloaded Catoctin Circle. The public hearing closed at 8:07 p.m. Council further discussed screening at the car wash site. Ms. Kitchens added that the distance between the property line of the neighborhood and car wash is 130 feet and that the lighting at the property line will not exceed 0.5 foot-candles. Lynda Kemp, with Reed Smith, addressed Council stating at the source the lights will be 5 ft. candle. She said the lights at the site are decorative and not as intense as the ones next door at Dulles Jeep Eagle. Councilmember Zoldos recommended possibly shielding the lights. Mr. Magazine stated his intent to plant 10-12 foot Leland Cypress trees. Councilmember Zoldos suggest possibly using a temporary fence until the trees have matured. Councilmember Schmidt asked that buffering and screening recommendations be more specific when this special exception returns for approval. Council Comments Councilmembers McDonald, Atwell, and Zoldos had no comments. Vice-Mayor Umstattd thanked Senator Mims for sponsoring legislation setting up a pilot project with the Centers for Disease Control and Prevention to standardize geographic information system access across the country. She added this bill was co-sponsored by Delegate May, Senator Potts and Delegate Tom Rust. The Vice-Mayor reported attending a ceremony on African American Historical Sites Survey, which is being sponsored by Balch Library and attending a conference sponsored by the Sustainable Loudoun Network on slow vs. fast growth. She thanked the Chamber of Commerce for the Annual Valor Award Ceremony stating that three Leesburg police officers were honored. She thanked the Town Annexation Team for a good job on their presentation at the Greenway Farms Homeowners Association meeting. Councilmember Schmidt thanked Town staff for the budget presentation provided on March 22nd. He urged Council to consider the departments' requests and stated he could not support a cut in the tax rate. He reminded citizens of the public hearing for the FY 2003 budget on April 9th. ]:. Mayor's Comments Mayor Webb reported on a fund-raising event by the Loudoun County High School PTSA for their Ali-Night Graduation Party. Town Council Minutes for March 26, 2002 Page 4 Further, the Mayor reported on meeting two gentlemen visiting from Pakistan to learn more about how local government works. She thanked Councilmembers McDonald, Zoldos, Atwell, .lackson, and Schmidt for committing the entire day for a budget work session. She added it was was a most productive and useful session. The Mayor reported that she met with Congressman Wolf to talk about state transportation issues. .1. I~lanager'$ Report Bob Noe asked Council to provide staff with alternate dates for the Freedom Park groundbreaking ceremony. The Town Manager advised an offer for the Planning, Zoning, and Development Director position will be made in the coming week. Following that he will be interviewing for the Economic Development Director. K. Legislation: ORDINANCES On a motion by Councilmember McDonald, seconded by Councilmember Schmidt, the following motion was proposed: 2002-O-6 ORD:ZNANCE Amending Chapter 2, Articles VII, VIII, IX, X, XI; Chapter 2.1, Article 2.1; Chapter 5, Article XV; Chapter 5.2, Article I; Chapter 11.1, Article I; Chapter 13, Article 2 of the Town Code regarding Board and Commission Attendance and Compensation The motion was adopted by the following vote: Aye: Atwell, Jackson, McDonald, Schmidt, Vice-Mayor Umstattd, Zoldos and Mayor Webb Nay.' None Vote: 7-0 CONSENT AGENDA On a motion by Councilmember Zoldos, seconded by Councilmember McDonald, the following consent agenda was proposed: 2002-37 RESOLUT?ON Accepting public improvements, releasing the performance guarantee and approving a maintenance guarantee for public improvements at the Woodlea Hills Subdivision. 2002-38 RESOLUTI'ON Accepting public improvements, releasing the performance guarantee and approving a maintenance guarantee for public improvements at the Tavistock Offsite Waterline. 2002-39 RESOLUTTON Accepting public improvements, releasing the performance guarantee and approving a maintenance guarantee for public improvements at the Holiday Inn Waterline. The motion was adopted by the following vote: Aye: Atwell, .lackson, McDonald, Schmidt, Vice-Mayor Umstattd, Zoldos and Mayor Webb Nay: None Vote: 7-0 On a motion by Councilmember McDonald, seconded by Councilmember Schmidt, the following motion was proposed: 2002-42 RE$OLUTZON Establishing an attendance policy for standing committees of the Town. The motion was adopted by the following vote: Aye: Atwell, .lackson, McDonald, Schmidt, Vice-Mayor Umstattd, Zoldos and Mayor Webb Nay: None Vote: 7-0 On a motion by Councilmember Schmidt, seconded by Councilmember McDonald, the following motion was proposed: RESOLUTZON Selecting an architect (Bowie Gridley Architects of Washington, D.C.) for the West Loudoun Street addition to Town Hall. Mayor Webb, seconded by Councilmember McDonald, made a motion to table the motion to select an architect. The motion to table failed by the following vote: Aye: McDonald, Jackson, and Mayor Webb Nay: Atwell, Schmidt, Vice-Mayor Umstattd and Zoldos Vote: 3-4 Town Council Minutes for March 26, 2002 Page 6 The original motion to select to Bowie Gridley Architects of Washington, D.C. for the West Loudoun Street addition to Town Hall failed by the following vote: Aye: Schmidt and Atwell Nay: Jackson, McDonald, Vice-Mayor Umstattd and Mayor Webb L. Boards and Commissions M. New Business Councilmember Zoldos made a motion, seconded by Vice-Mayor Umstattd, to instruct the Town Manager to instruct Adelphia Cable to start broadcasting the Planning Commission meetings beginning April 4, 2002. Mayor Webb proposed a friendly amendment to start the broadcasting beginning April 18, 2002. Councilmember Zoldos did not accept the amended motion.
