Present: Mayor, Thomas Anderson; Councilmembers, Thomas Crosby, William Reiser, Wilfred Scherer; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, JoE11en Harr; Police Chief, Charles Hoover; Attorney, Richard Schieffer; Engineer Glen Cook Absent; Councilmember, Sarah Lutz 1. MINUTES OF MARCH 16, 1982 Motion by Reiser, seconded by Crosby to accept minutes of March 16, 1982, as presented. Motion declared carried 3. POLICE DEPARTMENT Suburban Police Recruiting Service Council asked that attorney review contract for police officer recruiting for Council action at the April 20th meeting. 4. WCCO Thomas Anderson asked that the WCCO matter be tabled because the attorney had been asked for advice on several matters and because one Councilmember was absent. Motion by Reiser, seconded by Crosby to table action on the WCCO matter until April 20th. Motion declared carried Tom Supel asked what type of information was being requested. Thomas Crosby stated that WCCO has said that the 1972 permit still pertains and; that the Council has asked the attorney to look into the matter. 6. BLACK MAGIC, DUST CONTROL Donna Roehl reported that the city has been charged $85.00 per load for Black Ms.gic and that Council should decide the amount that residents should be charged. Motion by Scherer, seconded by Reiser to charge $95.00 per load for Black Magic. Motion declared carried 7. LIQUOR LICENSE FEES Club licenses Donna Roehl reported that the American has 245 members. Motion declared carried Sunday Liquor Licenses Donna Roehl stated that Medina Recreation has asked for a permit to sell liquor on Sundays beginning at 10:00 A.M. Motion by Crosby, seconded by Scherer to ask that the attorney prepare an amendment to the cities ordinance providing for sale of liquor on Sunday, at 10:00 A.M.,according to State law. (9A4n:amt,c_ aogd.3 Motion declared carried Off -Sale Liquor Licenses Donna Roehl stated that she had received a request for information regarding hours of operation at an Off -Sale establishment. Richard Schieffer stated that he would contact the Liquor Control Commission regarding the law as it relates to distance from Minneapolis. On -Sale Liquor Licenses Motion by Reiser, seconded by Crosby charge the same fee for 1982-83 licenses as was charged in 1981-82 but to review for a change in 1983-84. Motion declared carried 8. PLANNING AND ZONING DEPARTMENT Larry Man.thei, Variance JoEllen Burr explained that Mr. llanthei has requested a 6.3 ft. front yard setback var- iance to allow him to build an addition to his house at 1392 Deer Hill Rd. She stated that a 30 ft. road easement should be secured, at this time, if it does not exist and that the Planning Commission has recommended granting the variance. Motion by Reiser, seconded by Scherer to grant a 6.3 ft. front yard variance to Larry Nlanthei to construct an addition onto his house at 1392 Deer Hill Rd.; hardship being the location of the existing house on the property; on the condition that Mr. Manthei provide the city with a 30 ft. easement on Deer Hill Rd. if it does not now exist; and to authorize the city engineer to assist in the location of the Deer Hill Rd. right-of- way. Motion declared carried Anne Theis, Tax Forfeit Lots Mrs. Theis appeared to discuss her Independence Beach lots and abutting tax forfeit prop- erty that have a severe high water problem that cannot be built upon unless drainage is corrected. She stated that she is paying an assessment on property that she will probably never use. Glen Cook explained that he had reviewed the property and that the problem could be corr- ected by a storm sewer which would take care of water as it flows down the hill and on into Lake Independence. He estimated the cost for material to drain the site at $7500 and an approximate cost of 322,500 for both material and labor. Richard Schieffer stated that a policy for storm sewer correction should be established at this time, for future use, allowing for costs to be spread over the entire drainage basin. Thomas Anderson stated that the city could remove special assessments on the properties or study the possibility of a storm sewer project. Glen Cook stated that it would cost approximately $1000 for a feasibility study. Motion by Crosby, seconded by Reiser to authorize a storm sewer feasibility study, by Bonestroo and Associates, of the area of Independence Beach, in question, after a deter- mination is made as to whether or not the city can acquire the tax forfeit lots for resale. Motion declared carried 9. ALLEN ELSENPETER, INDEPENDENCE BEACH STREET LIGHTS 35 Allen Elsenpeter stated that 10-12 additional street lights in the Independence Beach area would make a safer neighborhood and lighten police work. He reported that a representative of NSP had stated that there would be no installation charges for additional street lights unless poles were needed. Chief Hoover stated that there are nine lights in the area at this time and that he could not see where 10-12 more would be needed. Council asked Donna Roehl to check with NSP as to whether or not a survey would 'be done by them and asked Chief Hoover to look at the area again for critical locations that might need lighting. 10. GARBAGE TRUCKS ON CITY STREETS Rodney Kager of Woodlake, appeared to discuss tickets he had received from the Medina police for their using city roads with overweight garbage trucks. Discussion of the need to keep heavy trucks off of the roads and to keep trucks on the des- ignated roads and not to take short cuts through the city. Thomas Crosby stated that perhaps licensing should be considered so as to know who is pick- ing up garbage and what routes they are taking. Mr. Kager stated that he could provide routes for Woodlake. Richard Schieffer stated that a city could take bids and have one contractor pick up garbage in the entire city. Mr. Kager stated that they have contracts in some developed cities but not in a city similar to Medina. Thomas Crosby stated that he would want to know what companies serve Medina. Mr. Kager stated that he would find out from other landfills who is picking up garbage in Medina. Thomas Anderson stated that the police should enforce the overweight regulations on those trucks that are seen using the city streets as a direct route to the landfill. 11. LONG LAKE/MEDINA MORNINGSIDE WATER William Reiser reported that Medina Morningside residents have said that they 'do not want to be involved in a merger of the Medina Morningside and the Long Lake water systems unless they have new water mains installed or that the existing mains be made part of the merger. Chuck Wilson stated that there is about 700 feet of bad pipe. Thomas Anderson stated that the Council would need to give Long Lake an answer to a possible merger. Thomas Crosby stated that due to the fact that the Medina Morningside system is an isolated system it would be in the best interest of the city to merge with the Long Lake system. Motion by Crosby, seconded by Reiser to hold a special meeting on Wednesday, April 14, 1982 at 7:30 P.M. to discuss further information with the Medina Morningside residents regarding the possible merger of the two systems. Motion declared carried 12. COMMUNITY DEVELOPMENT BLOCK GRANT Motion by Crosby, seconded by Reiser to make application for the following projects for Year VIII of Community Development Funding: S12,500 - Contingency; $8,000 - Rehab Grants; $5,000 - Independence Beach Special Assess- ment Assistance. Motion declared carried 13. MEDINA MORNINGSIDE SPECIAL ASSESSMENT ASSISTANCE Donna Roehl reported that there are five applicants who qualify for special assessment assistance in the Medina Morningside area and that there is $9500 in the fund.1 Motion by Scherer, seconded by Reiser to divide the amount equally among the five qualifying property owners, for a grant amount of $1900. each. Motion declared carried 14. MEDINA MORNINGSIDE EASEMENTS Motion by Reiser, seconded by Scherer to authorize payment of $500 each to Alma Qu.aa1 and DeWayne Berquist fo± storm sewer easements in connection with the Medina Morningside sewer project. Motion declared carried 36 15. BURLINGTON/NORTHERN RAILROAD Richard Schieffer was directed to review the Orono -Long Lake -Medina Morningside agreement as to procedure for sharing expenses due to the fact that a bill for $2222.54 is being paid to Burlington/Northern Railroad for pole rolocation. 16. M DINA CLEAN-UP DAY Motion by Crosby, seconded by Scherer to allow the Northwest Suburban Chamber of Commerce to establish a 'gash pick up day on City Hall property. Motion declared carried 17. CASH FLOW SEMINAR Motion by Reiser, seconded by Crosby to authorize Donna Roehi to attend a Cash Flow Seminar, in Plymouth, at a cost of $15.00. Motion declared carried 18. NORTHWEST AREA HOUSING PROJECT Motion by Reiser, seconded by Crosby to send a letter of support for the housing project being sponsored for the elderly in the cities of Rogers and Maple Plain. Motion declared carried 19. BILLS Motion by Crosby, seconded by Reiser to pay the bills with the exception of Check # 1171 in the amount of $ 429.00; Order Checks # 1139-1203 in the amount of $58,477.74 and Payroll Checks # 6617-6644 in the amount of $11,026.04. Motion declared carried 20. LAWCON GRANT Anne Heideman reported that she had researched the possibility of Medina's qualifying for a Lawcon park grant and had determined that Medina would not qualify for funds. She sugg- ested that an application not be made, at this time. 21. COLONIAL DRIVE IN THEATRE Police Officer, Michael Rouillard, stated that the fence at the Drive In Theatre is in need of repair but upon talking with the manager he did not know how long they would be operating because of a possible termination of their lease. Richard Schieffer stated that they are operating under a Use Permit and further stated that he would contact them regarding disrepair of the fence. Motion by Crosby, seconded by Reiser to adjourn.
