Gy 65.E The Council of the City of Medina met in regular session on Monday, April 6, 1992 at 7:30 p.m. Present: Mayor, Gary Acromite; Councilmembers, Robert Mitrhr11 Ann C. Thies, Philip Zietlow; Acting Clerk -Treasurer, Laura Monroe; Public Works Director, James Dillman; Police Chief, Richard Rabenort; Engineer, Glenn Cook; Attorney Ron Batty Absent: Councilmember Wilfred Scherer 1. ADDITIONAL TO AGENDA ITEMS Robert Mitchell asked to remove the Minnegasco permit off the consent agenda. Laura Monroe asked that the Park Commission item on Hunter Farms Park be added to the agenda, per Fred Keller's, chair, request. 2. MINUTES OF MARCH 17 AND MARCH 26, 1992 Ann C. Thies said that on Page 50 of the March 17 minutes, it should read "declaration" for recording, instead of "document". On the March 26 minutes, on page 52 where she said the "amount should be included" the "$98,000" figure should be included for "Phase 4". Phil Zietlow said that on page 49 of the minutes of March 17, that it should read that Fenning will sign a petition and waiver for $2,000 per lot for "Medina" road improvements. Moved by Thies, seconded by Mitchell to approve the minutes as amended. Motion declared carried. 3. LAKE MINNETONKA CABLE COMMUNICATIONS, JIM DANIELS,ADMINISTRATOR, CITY COUNCIL SUPPORT OF H.R.3560 Jim Daniels talked about the proposed resolution. He explained that cable rates have increased 300% or more. This resolution is to urge Congressman Gerry Sikorski to co-sponsor and support the "Cable Consumer Protection Act of 1991". Moved by Mitchell, seconded by Acromite to adopt Resolution 92-24 as proposed, urging support of the Cable Consumer Protection Act of 1991, to appoint an ad hoc committee of Ann C. Thies to talk to Congressman Sikorski as to his position on this issue. Motion declared carried. 4. CONSENT AGENDA CDBG Moved by Mitchell, seconded by Thies to adopt Resolution No. 92- 23 approving projected use of funds for Year XVIII of the Urban Hennepin Co. Community Development Block Grant Program. Motion declared carried. Park Ordinance Moved by Mitchell, seconded by Thies to adopt Resolution 92-21 Authorizing Publication of Ordinance #265, City's Park Ordinanc, by Title & Summary. 58 Motion declared carried. Election Judges' Salary Moved by Mitchell, seconded by Thies to approve the election judges' salaries for 1992, $7.25 for chairs and $6.00 for the rest of the judges. Motion declared carried. PLANNING & ZONING DEPARTMENT Jeff Sisk Final Subdivision Resolution Moved by Mitchell, seconded by Thies to adopt Resolution 92-22 Granting Final Approval for Jeffrey Sisk, 1750 Homestead Trail for a subdivision of 7.5 acres. Motion declared carried. 5. PROPOSED SEWER TRUNK LINE, HWY 55, RESIDENTIAL ASSESSMENT Glenn Cook said that along the proposed Highway 55 corridor it was proposed to assess $2,000 per acre for residential and $4,000 to $6,000 for commercial property per acre. The Doerr property has 165 gross buildable acres after taking out the wetlands and before hardcover is taken into consideration. Gary Acromite asked if this was the methodology for the sewer assessment, and if this was the figure that was going to be assessed. Glenn Cook said that he said that he would try to come up with the methodology this week, but wanted to meet with the seven businesses involved, and Bob Vieau of Loram was gone until next week. Ron Batty said that this was what would go on the petition and waiver agreements. Glenn Cook said that he would take the petition and waiver agreements to the meeting with the businesses. Gary Acromite said that he wanted the trunk line figures and the lateral figures separately, and not to combine the two. He said that he thought they were paying for the trunk. Robert Mitchell said that nothing should be withheld from them. Gary Acromite said that everything will be presented to them in the group setting. Glenn Cook said that there would be three lateral assessments to properties abutting the line. They would try to trade off for easement signings. He said that there were 800 acres of Tax Increment property of commercial/industrial land $2,000 per acre, and 500 acres of $1,000 per gross acre. Gary Acromite said that the TIF numbers should be reviewed with Jeanne Vanda of Ehler's. Terry Forbord of Lundgren Brothers said that he didn't understand what was going on as far as the assessments for the residential property. Gary Acromite suggested that he contact Glenn Cook regarding his specific questions. 6. PUBLIC WORKS DEPARTMENT Minnegasco Permit, Hwy. 55 from Co. 19 to Willow Dr. Robert Mitchell asked that this item be pulled from the agenda because he wanted to know what was going on with Minnegasco in 59 the City as a whole, do we know that the plan is. Moved by Mitchell, seconded by Thies to table the Minnegasco Permit to the next meeting, to have a representative explain plan that Minnegasco has in Medina. Motion declared carried. 7. PLANNING AND ZONING DEPARTMENT Sewage Disposal Ordinance Ron Batty said that he had revised the Sewage Disposal System ordinance based on suggestions from the March 9 meeting. Robert Mitchell thought that a bond should be put up with the city that a system will be pumped. Ron Batty said that failing systems should be repaired. Robert Mitchell said that there should be standard maintenance to the septic systems. He said if the system stops running altogether it must be pumped. Ron Batty said that they changed the inspection from every two years to every four years. He said that Loren Kohnen said that in section 720.17 where it talks about six percent slope may not be utilized for the primary or secondary individual sewage treatment system, he thought it should say twelve percent instead. He said that under section 720.09 where it states the standards of the MPCA to make sure that it states "and Rule 7080". Moved by Zietlow, seconded by Acromite to adopt the ordinance as amended. Motion declared carried. Greg Scherer Conditional Use Permit Glenn Cook explained that Mr. Scherer is requesting a conditional use permit to construct a 4088 square foot barn on 17 acres to replace an existing barn. The planning commission recommends approval with eight conditions. Robert Mitchell said that it should be stated what the setbacks, size and total square footage of the building. Moved by Mitchell, seconded by Thies to direct staff to prepare a resolution granting approval for a conditional use permit to Greg Scherer to construct a barn at 1022 Medina Road, subject to the Planning Commission recommendations. Motion declared carried. W.G. Schroeder, Subdivision Glenn Cook explained that Dr. Schroeder is proposing to subdivide his property of 24.10 acres into 2 parcels. The Planning Commission recommends approval with six conditions. The property is located west of the intersection of Co. Rd. 19 and Hamel Road. He explained that Hennepin County needed a 50 foot right of way for Co. Rd. 19, which would be an additional 10 foot dedication. He said that the problem with this is that would make Lot A not meet minimum lot size requirements. He said that Hennepin County would be willing to only get the additional ten foot right of way on Parcel B. He stated that the applicant would also be willing to go with that option. Gary Acromite asked if that was a verbal statement from the county. Glenn Cook said that it was. Gary Acromite said that he would like to see it in writing. Jim Dillman said that the County had no plans to change County Road 19 at this time. Moved by Mitchell, seconded by Thies to authorize preparation of a resolution granting preliminary subdivision approval to W.G.Schroeder of 24.10 acres west of Co. Rd. 19 and Hamel road, according to the six Planning Commission conditions, and that Parcel B will have a 50 foot right of way for Co. Rd. 19 and Parcel A will have a 40 foot right of way for Co. Rd. 19. Applicant may have to review soils to make Parcel A bigger to meet our soils requirements, and the septic system sites are to be staked. Motion declared carried. 8. PARK COMMISSION Gary Acromite explained that the Park that the Hunter Farms Park be renamed Lions Park. Moved by Acromite, seconded by Zietlow to of a resolution approving the name change Park to the Hunter Lions Park. Motion declared carried.
