Minutes On a motion by Vice-Mayor Jackson, seconded by Councilmember Martinez, the minutes of the April 7, 2003 worksession were approved with minor edits by a 7- 0 vote. On a motion by Councilmember Buttery, seconded by Councilmember Kramer, the minutes of the April 8, 2003 Council meeting were approved with minor edits by a 7-0 vote. Presentations a. Proclamation - Korean Visitors On a motion by Councilmember Martinez, seconded by Councilmember Zoldos, the following proclamation was approved by a 7-0 vote and presented to the Korean Visitors. A PROCLAMA TZON TO WELCOME THE HONORABLE DELEGATZON OF SAIVlCHEOK~ REPUBLZC OF KOREA WHEREAS, on January 28, 2003 the Leesburg Town Council passed Resolution #2003-20 authorizing the Town Manager to establish a sister city relationship with the City of Samcheok, Republic of Korea; and WHEREAS, this relationship was established to foster international communication as well as the exchange of ideas and governmental practices; and Town Council minutes for April 22, 2002 Page 2 WHEREAS, the Honorable Mayor Kim II-Dong and his delegation of civic officials have honored the Town of Leesburg with a visit to begin this sister city relationship and to officially ratify it with a signing ceremony. THEREFORE~ the Mayor and Council of the Town of Leesburg in Virginia hereby welcome the honorable delegation from the City of Samcheok, Republic of Korea to the Town of Leesburg and look forward to a long and prosperous sister city relationship. Presentation of Honorary Citizenship to the Korean Visitors Mayor Umstattd presented Certificates of Honorary Citizenship to the following members of the delegation from Sam Cheok, Korea: the Honorable Kim Il-Dong, the Honorable Shin Sung Kyeun, the Honorable Kim Sang Chan, the Honorable .leong ]in Gwon, the Honorable Klm Dae Ung, and the Honorable Kim Han Gu. The Honorable Kim II-Dong, with interpretation by Master Choi, thanked the Town of Leesburg for their hospitality and the establishment of a sister city relationship. He expressed their desire to exchange ideas about public administration and the cultures of the two countries. Mayor Dong invited the Town Council to visit his city. Mayor Umstattd thanked the Korean delegation for their visit and expressed her hope that we will foster future relations between Leesburg and Samcheok. c. Proclamation - National Day of Prayer On a motion by Vice-Mayor 3ackson, seconded by Councilmember Martinez, the following proclamation was adopted by a 7-0 vote and presented to Rev. Proclamation - National Occupational Safety and Health Week On a motion by Councilmember Zoldos, seconded by Councilmember Schmidt, the following proclamation was adopted by a 7-0 vote. The proclamation was presented to Bonnie Darr, Secretary to the Leesburg Health and Safety Committee. PROCLAMA TZON NA TZONAL OCCUPA TZONAL SAFETY AND HEAL TH WEEK MAY 4-:1.0, 2003 WHEREAS, the American Society of Safety Engineers, in partnership with the Canadian Society of Safety Engineers, designated May 5-:~:[, 2002 as North American Occupational Safety and Health Week; and WHEREAS, in response the United States Senate passed a resolution designating this week as National Occupational Safety and Health Week in 2002; and WHEREAS, more than 6,000 people die yearly from job-related injuries and millions more suffer injuries or illnesses; and WHEREAS, nationwide safety professionals work to prevent accidents, injuries, and occupational diseases creating safer work and leisure environments, and developing safer products; and WHEREAS, the purpose of National Occupational Safety and Health Week is to increase understanding of the benefits of investing in occupational safety and health, to raise the awareness of the role and contribution of safety, health, and environmental professionals, and to reduce workplace injuries and illnesses by increasing awareness and implementation of safety and health programs; WHEREAS, in an endeavor to ensure the maximum level of safety for employees and its citizens, the Town of Leesburg has reestablished its Safety and Health Employee Advisory Committee and has increased training opportunities for all employees throughout the Town. Proclamation - Public Service Recognition Week On a motion by Vice-Mayor .lackson, seconded by Councilmember Buttery, the following proclamation was adopted by a 7-0 vote and presented to Robert PROCLAMA TZON PUBLZC SERVZCE RECOGNZTZON WEEK MAY 5-11, 2003 WHEREAS, Public Service Recognition Week has become an annual national celebration since 1985; and WHEREAS, each year the week is set aside to honor the men and women who serve America as federal, state and local government employees; and WHEREAS, throughout the nation and around the world, public employees use the week to educate citizens about the many ways in which government serves the people and how government services make life better for all of us; and WHEREAS, the theme for the 2003 Public Service Recognition Week celebration is "Celebrating Government Workers Nationwide"; and WHEREAS, the vital work of our public servants enhances the quality of life for families and communities throughout Leesburg; and WHEREAS, the excellence in the delivery of public service helps keep Leesburg strong and prosperous. Proclamation - National Volunteer Week On a motion by Councilmember Buttery, seconded by Councilmember Kramer, the following proclamation was adopted by a 7-0 vote and presented to the Leesburg Police Support Team: PROCLAMA TZON NATZONAL VOLUNTEER WEEK APRZL 27 - MA Y 3, 2003 WHEREAS, the week of April 27 - May 3, 2003 has been designated as National Volunteer Week; and Town Council minutes for April 22, 2002 Page 5 WHEREAS, volunteering of one's time and resources is an essential part of our country's tradition and is essential to its spirit; and WHEREAS, volunteerism is increasingly recognized as a central partner with government, education and industry in doing the work of our nation; and WHEREAS, the members of the Leesburg Police Citizens Support Team play an essential role in assisting the Leesburg Police Department and other departments within the Town of Leesburg; and WHEREAS, the men and women of the Leesburg Citizens Support Team provide a valuable public service at their own time and expense, and their exceptional work in the prevention of crime and the promotion of public safety that has benefited numerous citizens in the Town of Leesburg. Proclamation - Hunicipal Clerks Week On a motion by Councilmember Zoldos, seconded by Councilmember Martinez, the following proclamation was presented to Judy Ahalt by a 7-0 vote: PR 0 CLA MA TXON MUNZC. TPAL CLERK'S WEEK APRTL 27 - MAY 3, 2003 WHEREAS, the office of the Municipal Clerk, a time honored and vital part of local government exists throughout the world; and WHEREAS, the office of the Municipal Clerk is the oldest among public servants; and WHEREAS/the Office of the Municipal Clerk provides the professional link between the citizens, the local governing bodies and agencies of government at all levels; and WHEREAS, Municipal Clerks have pledged to be ever mindful of their neutrality and impartiality, rendering equal service to all; and WHEREAS, the Municipal Clerk serves as the information center on functions of local government and community; and Town Council minutes for April 22, 2002 Page 6 WHEREAS, Municipal Clerks continually strive to improve the administration of the affairs of the Office of the Municipal Clerk through participation in education programs, seminars, workshops and annual meetings of their state province, county and international professional organizations. Proclamation - Historic Preservation Week On a motion by Councilmember Buttery, seconded by Councilmember Schmidt, the following proclamation was adopted by a 7-0 vote and presented to Teresa Minchew, Board of Architectural Review member. PROCLAMA TZON HZSTORZC PRESERVA TZON WEEK MAY 5-12, 2003 WHEREAS~ educating Leesburg's citizens about their heritage will foster greater appreciation for the importance of the past; and WHEREAS, historic buildings and places connect us with that history, providing unique character to the town that enhances quality of life, economic development, education and tourism; and WHEREAS, historic preservation, because it helps instill a sense of community, is relevant for Leesburg's citizens of all ages, all walks of life, and all ethnic backgrounds; and WHEREAS, it is important to celebrate the role of history in our lives and the contributions made by dedicated individuals who preserve the tangible aspects of the heritage that shape us as citizens of Leesburg and Virginia; and WHEREAS, "Cities, Suburbs and Countrysides" is the theme for National Preservation Week 2003, co-sponsored by the Town of Leesburg, the Commonwealth of Virginia and the National Trust for Historic Preservation. THEREFORE, the Mayor and Council of the Town of Leesburg in Virginia hereby proclaim May 5-12, 2003 as Historic Preservation Week, and call upon the people of Leesburg to join their fellow citizens in recognizing and participating in this special observance. Resolution of Appreciation - Holy Family Council #6831 of the Knights of Columbus On a motion by Vice-Mayor Jackson, seconded by Councilmember Martinez, the following proclamation was adopted by a 7-0 vote and presented to Mr. Donofrio. RESOLUTZON OF APPRECZATZON HOLY FAMZL Y COUNCZL #6831 OF THE KNZGHTS OF COLUMBUS WHEREAS, in 1971 the Virginia Knights of Columbus founded the KOVAR charity to provide financial assistance through grants and home loans to tax exempt organizations who in turn provide training, and assistance to persons with mental retardation; and WHEREAS, KOVAR is the second largest financial supporter of the mentally retarded in Virginia and second only to contributions from the government of Virginia; and WHEREAS~ the Holy Family Council #6831 of the Knights of Columbus in Leesburg, Virginia has continually raised thousands of dollars during the annual KOVAR fund drive at select locations around the Town of Leesburg, ensuring that one hundred percent of the donations collected from citizens and businesses are used to help those with mental retardation; and WHEREAS, the members of the Holy Family Council #6831 and their families have donated significant hours of their own time and effort to support KOVAR each year. THEREFORE RESOLVED, the Mayor and Council of the Town of Leesburg in Virginia hereby extend their appreciation to the Holy Family Council #6831 of the Knights of Columbus for their charitable efforts on behalf of those with mental retardation in the Town of Leesburg and the State of Virginia and encourage all citizens to support them in their endeavors. PROCLAIMED this 22nd day of April 2003. F. Petitioners Rita Bubniak, 314 Nickels Drive, addressed Council on behalf of the Safe Trails Connection. She asked Council to consider the Chancellor Street Trail option, as it is the safest trail connection for southwest Leesburg. Adria Frie, 1403 Harle Place, addressed Council asking for consideration of the Chancellor Street Trail as a trail option instead of spending $75,000 on the South King Street trail. She stated South King Street is an unsafe alternative. Liz Whiting, 241 Edwards Ferry Road, addressed Council asking for support of budget funding for the Residential Traffic Committee's calming issues. She also asked Council to support funding for the improvements to Loudoun Museum. Jennifer Douqlas with sons Matt, Jordan and Tyler addressed Council. She invited Council to attend a Tiger Claw Tae-Kwon-Do demonstration on April 26th to benefit St. Jude's. Town Council minutes for April 22, 2002 Page Michael Rogers, 233 W. Market Street, addressed Council asking for support of the Information Technology budget initiatives. Connie Fletcher, 232 W. Market Street, addressed Council in support of the Downtown Business Development Plan. She stated that public/private partnerships are a good way to achieve development goals. Further, the Main Street Loudoun/ Leesburg Program will assist in the downtown plan. Public Hearing a. Amending the Leesburg Zoning Ordinance and Zoning District Map regarding the Floodplain Protection District and Creek Valley Buffer District and repealing the F-1 Floodplain District and the Flood Hazard District of the Zoning Ordinance of 1990~ as amended. The public hearing opened at 8:47 p.m. Susan Swift explained this amendment to establish a single Floodplain Protection District and a Creek Valley Buffer Overlay District in the Zoning Ordinance. Also the Official Zoning Map will be amended to remove the F-1 Floodplain District and rezone the affected properties and inclusion of the appropriate properties in the Creek Valley Buffer District. Councilmembers Zoldos and Buttery thanked staff for implementing this much-needed amendment to the Zoning Ordinance and Map. There were no petitioners for this public hearing. The public hearing closed at 8:54 p.m. Endorsing the Business Development Strategy Report~ dated March 31~ 2003. The public hearing opened at 8:55 p.m. Betsy Fields addressed Council stating that Tripp Muldrow had presented this report to Council at their last meeting. Since that time it has been presented to the Economic Development Commission, Planning Commission, Downtown Committee, and has been posted on Leesburg's web site. She added this is a policy document that should be incorporated into the Town Plan. Ken Reid, 4 Loudoun Street, stated Leesburg is a wonderful place to live. He believes the report is good, but would like to see more emphasis on attracting businesses. The downtown needs a drugstore and national brand stores. Liz Whiting, 214 Edwards Ferry Road, addressed Council asking for support of the Business Development Strategy Report. She stated the strength of the report is that it takes a fresh look at neighborhoods and their growth. Town Council minutes for April 22, 2002 Page 9 Stephen Price, IVlarshall Foundation, asked that Council formally endorse this development strategy report. It enhances our tremendous potential for tourism to Leesburg and outlines enhancements for the eastern approach to the historic district. Linda Callagy, 683 Springhouse Square, addressed Council stating that the King Street business owners endorse the study and are ready and willing to move the historic district into the 21st Century. Connie Fletcher, 232 W. Market Street, addressed Council in support of the Downtown Business Development Plan. She stated that public/private partnerships are a good way to achieve development goals. Further, the Main Street Loudoun/Leesburg Program will assist in the downtown plan. The public hearing closed at 9:10 p.m. H. Council Comments: Councilmember Schmidt thanked the petitioners for their comments on the business development plan and stated he is looking forward to implementing the plan. He thanked the Bubniak and Frie families for their comments on the Chancellor Street Trail. Councilmember Schmidt reported attending the Arbor Day festivities at Banshee Reeks Park. Councilmember Martinez thanked those folks who commented on the South King Street Trail. He thanked the Korean delegation for their visit and interest in Leesburg. He reminded citizens of the upcoming Leesburg Flower and Garden Show on April 26th and 27th. Councilmember Martinez stated he looks forward to implementing the Business Development Strategy Report. Councilmember Zoldos stated he supports the Business Development Strategy Report and all who contributed to putting it together. He congratulated Management l~ntern Adam Brown on his appointment to a position in Manassas Park. Councilmember Zoldos recognized Nicole Ard for her hard work on putting together the visit by the Korean delegation. He also thanked the Bubniak and Frie families for their comments on the Chancellor Street Trail option. Vice-Mayor .lackson expressed support for the Business Development Strategy Report. He thanked Adam Brown for the work he has done for the town and congratulated him on his new job. Town Council minutes for April 22, 2002 Page Councilmember Buttery congratulated Adam Brown on his new job. He reminded citizens of the Border Guard Muster at Ida Lee Park on May 2-4th and the Gallery Walk on May 2nd. He expressed support for the Business Development Strategy Report and thanked Master Choi for leading the effort to establish the sister city relationship with Samcheok, Korea. Councilmember Kramer expressed support for the Business Development Strategy Report. She reported on a trip to Staunton, Virginia to view their historic district and the revitalization efforts of their downtown. She thanked Adam Brown for his contribution to the Town and wished him luck in his new position. T. Mayor's Comments: Mayor Umstattd thanked Safeway and Home Depot for making up the difference in the salaries of those soldiers who were deployed to active duty. She thanked Randy Collins, Loudoun County Chamber of Commerce, for attending the Staples opening in Leesburg on April :[2th, The Mayor echoed Councilmember Schmidt's comments on Arbor Day and thanked ]ay Banks and Nicole Ard for the wonderful job they did for the event. She thanked Ed Starzenski and all those who participated at Loudoun County High School's tribute to our troops. Mayor Umstattd commented on the success of the Gallery Walk and suggested that it be expanded to two Fridays per month. The Mayor echoed the comments by Councilmembers Schmidt, Zoldos, and Martinez on trail concerns. .1. Manager's Report: Bob Noe reported that every police officer has been trained in a police emergency management exercise concerning schools. He stated that the Leesburg Police has started the Silent Partner Alert Program. He reported the annual vehicle decal season has ended with 22,000 decals issued. He thanked Jay Banks and Nicole Ard for the work on the Arbor Day activities. Further, he reported that 1,000 children participated in the Annual Easter Egg Hunt at Ida Lee Park. Mr. Noe reminded citizens of the Flower and Garden Show coming up on April 26th and 27th. He thanked Nicole Ard and Master Choi for coordinating the Korean visit, Mr, Noe thanked Adam Brown for his contributions to the Town and wished him well in his new position. Town Council minutes for April 22, 2002 Page ! ! Mr. Noe stated that three employees are on active duty in the military: O. Jackson, Mike Gregory, and Jennifer Gillespie. He asked that they be remembered in our prayers. K. Legislation ORDZNANCES On a motion by Councilmember Martinez, seconded by Councilmember Kramer, the following motion was proposed: ORDZNANCE 2003-O-4 Amending Article VII, Chapter 17-147, "Levy and Rate" to increase the tax on cigarettes sold in the Town of Leesburg The motion was approved by the following vote: Aye: Buttery, Jackson, Kramer, Schmidt, Martinez and Mayor Umstattd Nay: Zoldos Vote: 6-1 Councilmember Schmidt stated there was no opposition to this increase at the public hearing and we agreed to this in our budget deliberations. Vice-Mayor Jackson stated we would have to find $500,000 if we turned down the cigarette tax increase. Councilmember Zoldos stated he could not support this tax increase. Mayor Umstattd agreed with Councilmember Schmidt stating she endorses the C1~P projects for S. King Street, Fort Evans Road, and West Market Street. Further, she stated this has been a difficult budget and she does not want to eliminate funds for Balch, non-departmentals, and police staffing. CONSENT AGENDA On a motion by Councilmember Martinez, seconded by Councilmember Buttery, the following consent motion was proposed: RESOLUTZON 2003-59 Making a reduction of the performance guarantee for public improvements installed in Potomac Crossing, Sections 8 and 9. RESOLUTZON 2003-60 Authorizing an agreement and approving a substitute guarantee for AIIman water and sanitary sewer extension and releasing the letter of credit from the AIIman Family Limited Partnership. The motion was approved by the following vote: Aye: Buttery, Jackson, Kramer, Martinez, Schmidt, Zoldos and Mayor Umstattd Nay: None Vote: 7-0 On a motion by Councilmember Martinez, seconded by Councilmember $chmidt, the following motion was proposed: RESOLTUION 2003-68 Adopting the Budget, General Fund in the amount of $32,975,523, Utilities Fund in the amount of $25,808,694, Airport Fund in the amount of $4,181,373, and Capital Projects Fund in the amount of $6,309,633, setting the tax rates, making appropriations for the fiscal year ending June 30,2004, and making transfer of capital project funds to the FY 2003 budget, Mayor Umstattd, seconded by Councilmember Kramer, made a motion to amend the original motion to include an additional appropriation of $10,000, from the Uran funds, for the YMCA ($5,000) and NE Coalition ($5,000). The motion to amend the original motion was approved by the following vote: Aye: Kramer, Martinez, Schmidt, and Mayor Umstattd Nay: Buttery, Jackson and Zoldos Vote: 4-3 Councilmember Schmidt, seconded by Councilmember Zoldos, made a motion to amend the original motion to remove $75,000 from the South King Street Trail from the Capital Tmprovements Project budget. The motion to amend failed by the following vote: Aye: Schmidt and Zoldos Nay: Buttery, Jackson, Kramer, Martinez, and Mayor Umstattd Vote: 2-5 Councilmember Schmidt complimented town staff for the professional way in which they put together the budget. He expressed regrets with S. King Street Trail and lack of support for Dodona Manor. He stated this is the best possible budget and wanted citizens to know that the town staff voluntarily proposed to give up the cost of living increase for this fiscal year. Councilmember Martinez complimented staff as well. He stated he is impressed with how Council handled the budget process. He stated that he regrets not funding Dodona Manor and the IT improvements that are integral to moving this town forward. Town Council minutes for April 22, 2002 Page Councilmember Zoldos complimented staff on the professional manner the budget was put together. He stated that fundamentally he could not support the proposed budget. He wanted the public to be aware that there are five new capital improvement projects in the proposed budget, which will cost approximately $1,350,000. He stated this will increase our debt service for the next 10-15 years. He added that staff has already reduced their FY-03 budget by $200,000. Vice-Mayor Jackson stated he is in agreement with some of Councilmember Zoldos' comments and will not be supporting this budget. Councilmember Buttery stated he appreciates staff's efforts in this tough budget year. Further, he appreciates Mr. Noe's comments and consideration of his guidance. He stated this budget is in the overall best interest of the town and he will be supporting it. Councilmember Kramer stated that in general she believes the budget had a positive outcome. She stated she is impressed with how staff handled the budget process. Further, she stated that citizens strongly oppose a real property tax increase. Councilmember Kramer stated that although the CIP projects do come with new debt, she would be supporting the proposed budget. Councilmember Martinez stated he agrees that we should not incur new debt, but that cuts were made to offset the debt. Further, he stated that Council should keep promises they made to citizens with reference to these capital improvement projects. He also thanked Mr. Uran for the donations he has made to the Town. Mayor Umstattd stated that Mr. Uran has donated over $1,000,000 to the Town of Leesburg. She complimented the town staff and Council for the work they have done on this budget. Further, she stated that staff has decided not to ask for a cost of living increase in FY 04 and there is only a 3% increase in the General Fund. The Mayor stated that our debt is less than it was in the 1990's. Councilmember Schmidt stated that more time should be spent discussing the CIP. He would like to come up with a more realistic plan that does not give false hope to citizens.
