D. Minutes
On a motion by Vice-Mayor Jackson, seconded by Councilmember Buttery, the
minutes of the April 21, 2003 worksession were approved with minor edits by a 6-0-
I vote, Councilmember Martinez absent.
On a motion by Councilmember Zoldos, seconded by Councilmember Kramer,
the minutes of the April 22, 2003 Council meeting were approved with minor edits by
a 6-0-1 vote, Councilmember Martinez absent.
Presentations
a. Loudoun Hospital Center
Mr. Dave Goldberg gave a brief update on the future of the Cornwall
Campus emergency room stating plans to open acute care beds at the facility.
Further, he stated the hospital has applied for more beds in their mental
health section at Landsdowne.
Councilmember Zoldos expressed his appreciation for the new
Cornwall facility and the service to the citizens of Leesburg.
Vice-Mayor Jackson stated some time ago the Leesburg Planning
Commission approved an application for expansion of the Cornwall Campus to
and asked the status of that expansion.
Mr. Goldberg stated they are considering that possibility.
Councilmember Buttery stated he has received positive feedback from
town residents concerning the Cornwall Campus.

Mayor Umstattd thanked Mr. Goldberg for his report.
b. Loudoun County Economic Development Director - Larry
Rosenstrauch
Mr. Rosenstrauch reported on the economic effects of the large number of
businesses, which are relocating to Leesburg and Loudoun County. He stated
Leesburg currently has a work force of 20 - 30,000 people.
Further, he stated the opening of the Air and Space Museum would begin
by bringing approximately 3,000,000 additional tourists to the County. He
encouraged businesses to prepare now.
Mr. Rosenstrauch commented on the possibility of the county becoming a
major bio-medical research center with the arrival of the Howard Hughes
Center and the number of brand-name companies that Loudoun currently
houses including, AOL and WorldCom.

Mr. Rosenstrauch outlined the county's new tourism initiatives, which
ads in many major magazines, which showcase downtown Leesburg as
other locations within the county.
Further, Mr. Rosenstrauch commented on the economics of the region
stating there should be improvement by next spring.
Mr. Rosenstrauch addressed the issue of growth in the county stating,
by the end of the decade, Loudoun could see an additional 140,000 residents.
He stressed the importance of building a strong commercial tax base to avoid
major tax increases for residents.
Councilmember Schmidt thanked Mr. Rosenstrauch for his coordination
with the town's economic development staff.
Councilmember Buttery stated the growth numbers present many
overwhelming opportunities and challenges.
c. Board of Architectural Review Awards
On a motion by Vice-Mayor .lackson, seconded by Councilmember
Schmidt the following awards were approved by a 6-0-1 vote, Councilmember
Martinez absent. The Mayor and Board of Architectural Review Chair, Richard
Forbes, presented the following:
Certificate of Recognition to Ms. Paige Buscema, owner Eyetopia, for her
projecting sign design.
Certificate of Recognition to Mr. Peter C. Burnett for his contribution to
perpetuating high architectural standards of the historic district through his
efforts on the design of the Loudoun County Courthouse project.
Certificate of Recognition to Mr. Robert E. Sevila for his contribution to
preserving the character and architectural quality of the Town of Leesburg.

Proclamation - National Tourism Week
On a motion by Councilmember Schmidt, seconded by Councilmember
Kramer, the following proclamation was approved by a vote of 7-0 and
presented to Linda Callagy on behalf of the Loudoun County Convention
and Visitor's Association:

WHEREAS~ the tourism industry is an important part of the economic base of
the Town of Leesburg; and
WHEREAS, many Leesburg businesses, including our restaurants, hotels, bed
& breakfasts, retail shops, cultural and heritage attractions, travel agencies, rental car
companies, other service businesses including the outlet center depend upon the
tourism industry for their success; and
WHEREAS, these businesses have made a long-term commitment to and
investment in the Town of Leesburg, support the town through the generation of local
revenues, provide employment opportunities for the citizens of Leesburg and
contribute to the quality of life in our town; and
WHEREAS, without the tax revenue generated by tourism, every family in
America would pay an average of one thousand dollars more in taxes every year; and

WHEREAS, On August 31, 1949, Secretary of Defense Louis Johnson
announced the creation of an Armed Forces Day to combine the separate
celebrations of each branch and to commemorate the unification of the armed forces
under the Department of Defense; and
WHEREAS, from the very beginnings of our nation, our Armed Forces have
strived to protect our Country, our Freedom, our Citizens and other Nations from
various forms of tyranny; and
WHEREAS, most recently many of our men and women have been deployed to
combat the forces of terrorism that exist in the world through Operation :Iraqi Freedom
and Operation Enduring Freedom; and
WHEREAS, this year the Department of Defense has chosen the them, "A
Force for Freedom" for the 2003 Armed Forces Day celebration; and

serve our country so selflessly and honorably everyday.

On a motion by Councilmember Zoldos, seconded by Councilmember

WHEREAS, President Jimmy Carter signed a joint resolution declaring the first
Asian/Pacific American Heritage Week in 1979; and
WHEREAS, President George H. W. Bush extended the celebration to
Asian/Pacific American Heritage Month in 1992; and
WHEREAS~ The United States Congress passed Public Law 102-450 in October
1992 designating May of each year as Asian Pacific American Heritage Month; and
WHEREAS, the Asian Pacific American Heritage Council has designated this
year's theme as "Salute to Liberty"; and
WHEREAS, Asian/Pacific Americans represent more than 30 ethnic
backgrounds and represent one of the fastest growing ethnic groups in the United
States; and
WHEREAS, Virginia is home to a rich and diverse population, drawing people
from nations around the world; and

Day
On a motion by Councilmember Buttery, seconded by Councilmember
Martinez, the following motion was approved by a 7-0 vote and was presented

WHEREAS, The Congress and the President of the United States have
designated May 15th as Peace Officers Memorial Day, and the week in which May 15th
falls as National Police Week; and
WHEREAS, during this National Police Week the names of 148 law
enforcement officers who made the ultimate sacrifice in 2002 will be added to the
Law Enforcement Memorial; and
WHEREAS, the members of the Leesburg Police Department play an essential
role in safeguarding the safety and the rights and freedoms of the citizens of
Leesburg; and
WHEREAS, it is important that all citizens know and understand the duties,
responsibilities, hazards, and sacrifices of their law enforcement agency, and that
members of our law enforcement agency recognize their duty to serve the people by
safeguarding life and property, by protecting them against violence and disorder, and
by protecting the innocent against deception and the weak against oppression;
THEREFORE, the Mayor and Council of the Town of Leesburg in Virginia,
hereby proclaim May 15th of the year 2003 as Police Officers Memorial Day and the
week of May 11th - 17th of the year 2003 as National Police Week and encourage the
citizens of Leesburg to honor and to thank the members of the Leesburg Police
Department for their dedicated service to the community and to remember and
honor as fallen heroes those law enforcement officers who, through their courageous
deeds, have made the ultimate sacrifice in service to their community.

i. Certificate of Appreciation - Home Depot and Safeway Stores
On a motion by Councilmember Buttery, seconded by Councilmember
Zoldos the Certificate of Appreciation for continued support of the United
States Armed Forces troops who have recently been deployed and their
families was approved by a 7-0 vote and presented to Mr. Steven Glass,
Regional Trainer for Home Depot and the Leesburg Safeway store.
F. Petitioners
Ms. Sara Chafin., 204 Pershing Avenue, read the following petition into the
record:
We the undersigned residents of Pershing Ave, N.W. Leesburg, Virginia, would
consider supporting the Wilson Avenue and Pershing Avenue improvements project if
the street width on Pershing Avenue N.W. was changed from the currently proposed

36' width to a 30' width. The most recent resident survey of April 9, 2003 from the
Dept. of Engineering and Public Works did not give residents this option, despite
repeated requests from Pershing Avenue residents at meetings etc., for them to do so.
The 1997 Town Plan for Leesburg Virginia, pg. 7-3, states that the Fairview
Subdivision is to be considered as a part of the Conservation District. To quote from
the Town plan, "Leesburg has a number of holder neighborhoods with a distinct sense
of place." With the consideration that Pershing Avenue is part of the Fairview
Subdivision and part of a Conservation District, we request that the street width
requirement of 36-feet be waived to a 30-foot width. Recently, such areas as the
Lowenbach Subdivision (which is part of the Conservation District), have received this
variance from the Town Council. The current Engineering Department plan for
Pershing Avenue waives the 36-foot width requirement down to 30-feet for the
entrance area from Market Street onto Pershing Avenue and for 280-feet north on
Pershing.
Therefore, the entrance width and 280-feet further down Pershing will be
narrower than the rest of the street. This was done to preserve the stonewall on town
property near the entrance of Pershing. Residents of the street feel that if the
stonewall can receive a variance, so should the rest of Pershing, so that the street will
be of consistent uniform width. Variance, on street width have been given by the
Town Council to other streets in Leesburg with similar amounts of traffic as Pershing
with no apparent problems for traffic flow, etc.
Additionally, the Engineering Department has stated it will not bury existing
power lines on Pershing, yet a representative from Dominion VA Power Co. stated
during a meeting with a resident that the power line poles will have to be moved
further onto personal property to accommodate the 36-foot width proposed. Because
the tree roots on the property of these residents extend further into the street and
because their trees branches will need to be trimmed to accommodate the power line
poles being moved further into their yards, the trees will adversely be affected. An
arborist, whom a resident consulted, stated that if roots and limbs were cut at the
same time or too close together, the tree would die.
The Dominion VA Power representative also stated that there would probably
need to be more poles on both sides of the street in order to update the lines. These
lines will show more when trees are cut down or die within a few years.
We request these power lines be buried while the street is under construction
for the project. We asked Mr. Nagi Elsewaissi to do this. He stated estimates he
received concerning this were too expensive and that the town would not do it. We
requested a copy of the estimates to verify the cost. We have not received them. We
request the Council investigate outside funding for the burial of power lines on
Pershing (as was done on Fairview St.). Tf the street is scaled back to 30" as we are
petitioning, the money saved could be used to bury the power lines along Pershing
Avenue.
We petition to have a meeting with the Department of Engineering at which we
would request full disclosure on project topics such as when the project on Pershing
Avenue will begin, who will perform the construction work, and who the on-site project
managers will be.

Further, Ms. Chafin stated the residents were informed last week that the
Wilson and Pershing projects were considered separate projects and therefore required
separate petitions, which gave them little time to gather signatures.
Mr..lim Sisley, Safe Trails Connection, stated he represents a network of
citizens dedicated to providing safe trails and supporting non-vehicular
transportation. Further, he stated his support for the 20-year trails plan, river-walk,
and way-finding systems recently approved by Council.
In addition, Mr. Sisley stated the trail system in Leesburg is less than 10%
complete and asked Council to consider constructing the Chancellor Street Trail
before the South King Street Trail as it is a safer option.
Tom Soderholm, 607 Stribling Court, outlined trail risk management. He
compared the risk factors for the proposed South King Street Trail and the proposed
Chancellor Street Trail. His conclusion was that the Chancellor Street Trail
represents a 50% decrease in the risk of injury than South King Street Trail.
Mr. Quinten Johnson, 206 Oakcrest Manor Drive, stated the growth in
Leesburg would continue to increase as will the need for a trail system. Further, he
stated many trails currently exist in Leesburg; they just need to be connected to
provide safe access to all points in town.
Mr. Sean O'Connell, 1191 Hawling Place, stated as a Doctor of Chiropractics
he has become aware of the increasing levels of obesity in American citizens. He
stated a trails system in Leesburg would promote outdoor activities and have a
positive impact on the health and lifestyles of our residents.
Mr. Misha Ptak, 712 Chimney Court, expressed his concern with the noise
coming from the new Frances Hazel Reid Elementary School construction site and
cited the potential for increased traffic from the school.
Mr. Gregory Lee, 108 Stoneledge Place, expressed his concern with a
proposal suggesting the entrance to the new Francis Hazel Reid Elementary School
be moved from the Leesburg By-pass to Dry Hollow Road. He stated such a move
would adversely affect his family.
Mr. John Stanley, 706 Amber Court, expressed his concern with a proposal,
which suggests the entrance to the new Francis Hazel Reid Elementary School be
moved from the Leesburg By-pass to Dry Hollow Road. He stated such a move
would adversely affect the value of his home and his quality of life.
Mr..lamie ~lancin, 112 Stoneledge Place, expressed his concern with the
proposed entrance change for the Francis Hazel Reid Elementary School. He stated
children are using his back yard for a cut-thru to the construction site and the
construction traffic is traveling too fast in that area.
Mayor Umstattd stated the school board received a request from a citizen
asking that the entrance to Francis Hazel Reid Elementary School be moved from the
Leesburg By-pass to Dry Hollow Road. She further stated staff has since contacted
the school board and there is no plan to move the entrance for the school to Dry
Hollow Road.

Ms. Christine Ambers, 10 2nd Street, stated the residents of the Waverly
Heights neighborhood would like to request that sidewalks be constructed in their
community.
Vice-Mayor .lackson stated he asked Ms. Ambers to make this request while
Council is reviewing the CTP.
Mr. Brad Pierce, 905 Catoctin Circle, stated he is against the proposal to
relocate the Francis Hazel Reid Elementary School entrance to Dry Hollow Road.
Ms. Linda Callagy, Loudoun County Convention and Visitor's Center, stated
she is addressing Council in honor of Tourism Month and announced their new
tourism campaign entitled "Thrillin' and Chillin' Less Than An Hour Away". She
stated this new slogan would be appearing in literature and on busses very soon.
Ms. Angile Esperatu, Loudoun County Convention and Visitor's Center,
presented a press box to the Council and outlined its contents including various
promotional material from the Greater Washington Tourism Alliance.
Mr. Mason Hulen., 708 Amber Court, stated his opposition to the potential
change of the entrance to the new Francis Hazel Reid Elementary School.
Ms. Ann Robinson, Loudoun County Soil and Water District, outlined a new
initiative to educate residents about the function of storm drains in Leesburg. She
stated the Soil and Water District received a grant to fund the project. Further, she
stated on May 20th children from the Loudoun Country Day School will be placing
door hangers in the Fox Ridge neighborhood to inform residents of the program and
on May 27th the students will return again to place the signs on the drains.
Mr. Frank Ruggles, 10 Wilson Avenue, suggested widening Wilson and
Pershing at their entrances and then narrowing the streets to 30-feet with parking on
both sides as a way to minimize the impact on the neighborhood.
Ms. Kimberly Derrick Riley, 829 Catoctin Circle, stated Dry Hollow Road is to
be used as an emergency access lane for the new Francis Hazel Reid Elementary
School and moving the entrance to Dry Hollow would hinder emergency access.
Mr. Greg Eversmeyer, 825 Catoctin Circle, stated his opposition to moving the
entrance to the new Francis Hazel Reid Elementary School to Dry Hollow Road.
Mr. Ken Buckstrup, 7 Wilson Avenue, requested that Council only widen
Wilson Avenue to 30-feet in order to minimize the impact on the neighborhood.
Mr. Ken Bently, 12 Wilson Avenue, stated his concern with the widening of
Wilson and Pershing to 36-feet. He asked Council to only widen the streets to 30-
feet.
Ms. Carol Roby, 40820 Woodside Place, asked Council to begin construction of
the Chancellor Street Trail, stating the South King Street Trail is unsafe. Further,
she asked Council to consider a trail connection to White's Ferry to accommodate the
cyclists who travel the C&O Canal and spend the night in Leesburg.

Ms. Karen Jones, 112 Prince Street, provided a draft implementation plan for
the Business Development Plan. Further, she stated a full report on the Business
Development Plan implementation, as well as the Economic Development
Commission Annual Report would be presented to Council in June.
Mr. George Reynolds, 504 West Market Street, stated his support for the
widening of Wilson and Pershing Avenues to 30-feet with parking on one side.
Mr. Mel Whiteley, 6 Wilson Avenue, expressed his support for the widening of
Wilson Avenue to 30-feet stating this would not necessitate moving the utility poles.
Ms. Cathy Kennan, 2! Pershing Avenue, stated her concern for potential
impact on the trees if the road is widened beyond 30-feet. Further, she stated she
grew up in Loudoun County and would like Leesburg to remain as it is.
Ns. Jennifer Whyte, 708 Chimney Court, stated her concern with a proposal
to move the entrance for the new Francis Hazel Reid Elementary School site to Dry
Hollow Road.
Ms. Sandra Smallwood, 90:~ Chancellor Street, stated her support for the Safe
Trails Connection group, but stated she is firmly opposed to the Chancellor Street
Trail.
Public Hearing
a. Amending the Subdivision and Land Development Ordinance to
update and revise Articles 2, 3 and Appendix "A" of the Town of
Leesburg Design and Construction Standards Manual (DCSM)
The public hearing opened at 10:10 p.m.
Aref Etemadi stated this update was initiated three years ago through
ES:[. He stated the ES! board has reviewed and accepted the amendments,
which update the DCSM to reflect changes in industry standards and various
typos.
There were no petitioners for this public hearing.
The public hearing closed at 10:14 p.m.
H. Council Comments:
Councilmember Schmidt thanked the residents for coming out tonight. He
stated there was good input on the Wilson and Pershing projects and he looks
forward to the manager's report. Further, he thanked the Safe Trails Connection
Group stating it may take time for them to gain a voice in the community and
encouraging them to continue their work.
Councilmember Martinez thanked the residents of Wilson and Pershing for
their comments stating the Council has to take into consideration the feelings of the
people who live there. Further, he stated he was encouraged by the report giVen by
the Safe Trails Connection Group.
Councilmember Zoldos wished a Happy Mother's Day to the residents. He
commented on the success of the Flower and Garden Festival and thanked the parks
staff for their involvement.

Regarding the issue of the Wilson and Pershing projects, Councilmember
Zoldos asked the Town Manager to set up a meeting with the residents to address
their concerns.
Councilmember Zoldos also thanked the Safe Trails Connection Group for
attending the meeting and expressed his feelings that the South King Street Trail
does not meet the safety standards of the town.
Further, Councilmember Zoldos reported on a meeting held with
Congressman Frank Wolf. He stated the Congressman was extremely helpful and his
staff is working diligently to try to secure federal funding for a precision instrument
approach to the Leesburg Executive Airport, including a Iocalizer and a glide scope.
Further, he reported the Federal Aviation Administration would conduct a site survey
at the airport on Friday morning to determine which system would be a better fit.
He stated the team who attended the meeting was very successful and asked that
the team remain intact.
Further, Councilmember Zoldos commented on the lack of a town flag for
Leesburg and stated he would bring forth several design options at the next Council
meeting.
Vice-Mayor Jackson thanked the residents of Wilson and Pershing Avenues for
their comments. He also thanked Peggy Coleman for her work with the Safe Trails
Connections Group. He commented on the success of the employee breakfast held
on May 7th stating that over 175 employees attended.
Vice-Mayor .lackson stated he asked the residents of Ist and 2nd streets to
approach Council regarding sidewalks for their neighborhood and asked that Council
consider this request during the C]'P discussions.
Councilmember Buttery thanked the citizens for their comments and their
cordial attention to each of the speakers. Further, he commented on the impact that
change can have on people and stated one of the biggest attractions of Leesburg is
its green and open spaces.
Regarding the issue of the bike trail to White's Ferry, Councilmember Buttery
stated it takes time for some projects to develop citing a conversation he had with

Councilmember Kramer thanked the residents for attending the meeting
tonight stating that they represent the heart of Leesburg. Further, she stated her
agreement with Councilmember Buttery's comments.
I~layor's Comments:
Mayor Umstattd thanked the residents for attending the meeting. Further,
she thanked Dona Wolf and Phil Rodenberg for organizing the program on
emergency planning with Mr. Ron Carlee. She stated Mr. Carlee's comments on how
communities can better react to a disaster were very effective.
Further, she thanked Kaj Dentler for his response to an incident in Fox Ridge
Park and Bill Allison for his efforts in locating the owner of a check he had found on
the street.

Mayor Umstattd thanked Betsy Fields, Marantha Edwards and Larry
Rosenstrauch for attending the Hughes opening and commented on the ability of the
town's and county's Economic Development Departments to work together.
She thanked the staff for the success of the Flower and Garden Festival and
stated Kathy Foster of Leesburg Today asked her to recognize ~lennifer Montgomery
for her efforts. She asked staff to prepare resolutions for the next meeting to thank
the parks, police and street employees who worked on the show.
Mayor Umstattd reported on the meeting with Congressman Wolf stating
Steve Hutchens, Dan Moats and Stanley Caulkins were very effective. Further, she
stated Doug McNeeley and Tom Toth were helpful and echoed Councilmember
Zoldos' request that the team be preserved to continue working with Congressman
Wolf to secure federal funding for an ILS system at the Leesburg Executive Airport.
Mayor Umstattd commented on the success of the recent gallery walk stating
the parking garage was filled at 5:45 p.m.
14anager's Report:
Bob Noe stated staff is organizing an event for the East Market Street
Widening Project and verified Council would like to schedule the event for May 27th at
6:30 p.m.
Mr. Noe asked Council if they would like to proceed with the demolition of the
T-hanger at the airport?
Councilmember Zoldos stated the hanger should be removed to make way for
the new hanger construction.

Councilmember Schmidt stated he would not have supported this
arrangement in 1994, however he will support this item in order to facilitate the
refinancing and reduce the costs to the taxpayers.

Councilmember Zoldos asked to clear up the discussion from last night
regarding the annexation committee and made a motion to accept Councilmember
Martinez's resignation and appoint Councilmember Schmidt in his place.
Bill Donnelly stated under Robert's Rules of Order, Councilmember Martinez
has the right to withdraw his resignation anytime before Council accepts it. Further,
he stated only Council could accept the resignation because Council appointed him.
Councilmember Martinez stated he would like to withdraw his resignation.
Councilmember Zoldos stated the importance of the annexation committee
and added the committee will become active again once the landowner's petition for
annexation has been decided.
Councilmember Zoldos made a motion to appoint Councilmember Schmidt as
the 4th member to the committee.
Mayor Umstattd asked if the issue could wait till the next meeting?
Councilmember Zoldos stated he would like to proceed tonight.
Mayor Umstattd stated there would have to be a motion to suspend the rules
and unanimous consent of Council.
Councilmember Zoldos asked Bill Donnelly for his opinion.

Mr. Donnelly stated his concurrence with the Mayor that this is considered
new business and, therefore, requires unanimous consent of Council to be voted on
tonight.
Mayor Umstattd accepted the ruling of Mr. Donnelly and asked for a motion to

On a motion by Councilmember Martinez, seconded by Councilmember
Buttery the motion to adjourn was passed by a 6-0-1 vote with Councilmember
Zoldos opposed.
