Coun¢ilmembers Present: Frank Buttery, Mervin .]ackson, Melinda Kramer, Marry Martinez, David Schmidt, Bob Zoldos, and Mayor Kristen Umstattd. AGENDA ITEMS A. Invocation by Councilmember Zoldos B. Salute to the Flag was led by Councilmember Buttery C. Roll Call showing all members of Council present. D. Minutes: On a motion by Councilmember Vice Mayor .]ackson, seconded by Councilmember Buttery, the minutes of the .]uly 7, 2003 worksession were approved, with minor edits, by a 7-0 vote. On a motion by Councilmember Buttery, seconded by Councilmember Kramer, the minutes of the July 8, 2003 meeting were approved, with minor edits, by a 6-0-1 vote, Zoldos abstaining. Ruth Presentations: a, Recognition of the Virginia State Champion 13-14 year-old Babe Team from Loudoun .]ay Browley, Greater Loudoun Babe Ruth, Central Division Commissioner, introduced the 13-year old Babe Ruth team from Loudoun who has just won the Virginia State Championship. Leesburg Councilmember, Marry Martinez, coached the team. The Loudoun team will travel to Charlotte, North Carolina to compete in the SE Regional Tournament. b. Dominion Virginia Power - Pam Gottfried Pam Gottfried gave Council a briefing on the route of the Dominion Transmission Transformer through Leesburg and the measures they have taken to lessen the impact on roads and bridges. Ms. Gottfried reported that Dominion Power would move the 132-ton electrical transformer over local roads on a 16-axle tractor-trailer at approximately 3 mph over a two-day period. Town Council Minutes for July 22, 2003 Page 2 Council discussed several concerns with the impact on the southeast Leesburg residents and the lack of emergency access to their neighborhoods. c. Virginia 2007 Community Program - Doug Foard Doug Foard presented Council with a certificate of recognition from the State of Virginia for Leesburg's participation in the Virginia 2007 Community Program commemorating Virginia's 400th Anniversary. Mr. Foard shared some ideas the committee has for the commemoration in Leesburg, such as expanding August Court Days and ,luly 4th celebrations. Further, they plan to have the Virginia Militia and Captain Washington march through the streets of Leesburg. Council commended Mr. Foard for his efforts on this program. d. Town Hall Visitor Znformation Center - Zst Quarter Operations Report - Linda Callagy~ LCVA Linda Callagy provided Council with a summary report of the activity from the Town Hall Visitor's Center staffed by LCVA during the quarter including April, May and .lune. She introduced the new Chairman of the Loudoun County Visitors Association, Jonathan Swartz to Council. Council commended LCVA for this partnership with the town. e. Proclamation - National Night Out On a motion by Councilmember Buttery, seconded by Councilmember Martinez, the following proclamation was approved by a 7-0 vote: PROCLAMATZON NATIONAL NIGHT OUT AUGUST 5~ 2003 WHEREAS, a unique crime/drug prevention event sponsored by the National Association of Town Watch (NATW) has been scheduled for August 5, 2003; and WHEREAS~ last year's National Night Out campaign involved citizens, law enforcement agencies, civic groups, businesses, neighborhood organizations and local officials from 9500 communities from all 50 states; and WHEREAS, National Night Out is designed to heighten crime and drug prevention awareness; generate support for, and participation in, local anti- crime programs; strengthen neighborhood spirit and police community partnerships; and send a message to criminals letting them know that neighborhoods are organized and fighting back; and Town Council Minutes for .]uly 22, 2003 Page 3 WHEREAS, National Night Out has proven to be an effective, inexpensive, and enjoyable program to promote neighborhood spirit and police-community partnerships in our fight for a safer community; and WHEREAS~ 2003 marks the twentieth anniversary of this unique crime/drug prevention event. THEREFORE, RESOLVED by the Mayor and Council of the Town of Leesburg in Virginia to call upon all citizens of Leesburg and upon all patriotic, civic and educational organizations to observe Tuesday, August 5, 2003 as National Night Out and to leave their porch lights on as a symbol of the community's united stance against crime. PASSED this 22nd day of July 2003. Police Chief Joe Price accepted the proclamation on behalf of the Leesburg Police Department. F. Petitioners Sandy Kane, 815 Kenneth Place, addressed Council on the CST contract stating they have excellent goals for recycling. She reminded Council that the State of Virginia mandates 25% recycling. Ms. Kane expressed concerns with the resolution on recycling before Council this evening and asked that it be sent back to the Environmental Advisory Commission to determine the environmental impact to the community. Paul Ritchey, 221 Shenandoah Street, addressed Council. He commended the town on their participation in this Memorial Day Celebration. Mr. Ritchey asked about the possibility of using the northwest quadrant of the old Rt. 7/Rt. ::[5 Bypass ramp to help relieve traffic from the off ramp exiting onto the Rt. 7 Bypass at Sycolin Road? Geary Higgins, candidate for the Board of Supervisors - Catoctin District, addressed Council. Mr. Higgins outlined his credentials and stated he would like to build better town/county relations. Gem Bingol, 205 Primrose Court, addressed Council. Ms. Bingol stated she is thrilled with the new trash and recycling contractor but the town still has a way to go to meet the 25% recycling goal mandated by the State of Virginia. She asked that Council remain firm on their recycling plan. Ken Reid., 607 Talmadge Court, addressed Council. Mr. Reid discussed the deplorable road system in Tavistock. He stated concerns with their being only one way out of the Tavistock development. Mr. Reid suggested that Council should consider building a bridge at the end of Lawson Road over Tuscarora Creek. Robert CarTer., 22 Gannon Way, Potomac Falls, Virginia addressed Council. Town Council Minutes for July 22, 2003 Page 4 Mr. Carmer discussed the lack of enforcement of the handicapped parking spaces at Tda Lee Recreation Center. Mr. Carmer also had concerns with the lack of advertisement of the Parks and Recreation Advisory Commission meetings and the need for designated senior citizen therapy time at the warm water pool facility. Public Hearing: a. Consideration of the vacation of a portion of North Street, NE Bill Donnelly gave an overview of this vacation of a portion of North Street, NE. He stated a public sidewalk was constructed on private property belonging to David L. and Holli D. Bowers. The town has agreed to vacate 149 square feet of public street no longer required by the town and exchange it for the property needed from the Bowers. The public hearing opened at 8:55 p.m. There were no petitioners for this public hearing. The public hearing closed at 8:56 p.m. This vacation will return to the next Council meeting for a vote. H. Council Comments: Councilmember Schmidt asked for continued encouragement and support for our armed forces in Iraq. He thanked Congressman Frank Wolf for his support in the funding of the ILS system at Leesburg Executive Airport and Battlefield Parkway. Councilmember Schmidt commented that tonight's petitioner, Geary Higgins, has served the citizens well on the Loudoun County School Board. He stated he would be offering a motion tonight on recycling. Councilmember Martinez had no comments. Councilmember Zoldos congratulated Councilmember Martinez on the success of his Babe Ruth Team. Further, he thanked Congressman Wolf for securing $1,000,000 for the Precision ILS System at the Leesburg Executive Airport. He congratulated the Parks and Recreation staff for another wonderful 4th of July Celebration. He thanked Geary Higgins for addressing Council tonight. Vice Mayor Jackson thanked staff for the work they have done on the :ILS system and Calvin Grow and Phil Rodenberg for their assistance to Congressman Wolf in securing the $6,000,000 for Batttlefield Parkway. He reported attending the Griffith-Owens & Associates ribbon cutting ceremony along with Councilmember Zoldos. Town Council IVlinutes for ,luly 22, 2003 Page Further, Vice Mayor Jackson reported the passing of Robert Primack and Judge Aiken's wife. Councilmember Buttery congratulated Councilmember Martinez on the accomplishments of his Greater Loudoun Babe Ruth Team. He thanked Mr. Martinez and other citizens who work with our youth. He asked that Council consider going on record at the next Council meeting in opposition to the increase in Dulles Greenway tolls. Councilmember Kramer expressed her condolences to the Primack family. She congratulated Councilmember Martinez for the accomplishments of his Babe Ruth team and his work with the youth of the community. t4ayor's Comments Mayor Umstattd commended the Utilities Department for their community outreach regarding the notice of water shutoff in her community. The Mayor commended Georgia Bange for her efforts in bringing a Russian teenage group on a tour of Leesburg. She thanked Joe Latham for hosting the free concert at Laurel Brigade Inn. The Mayor thanked Congressman Frank Wolf for his efforts to secure $1,000,000 for the ILS System at the airport and $6,000,000 for the eastern section of Battlefield Parkway. She stated Council deserves credit for voting unanimously on both of these issues. Further, Mayor Umstattd reported on her meeting with Hobie Mitchel and the Chief Financial Officer of the Dulles Greenway stating it was her understanding that a toll increase would improve their bond rating and allow for more improvements to the Toll Road. .1. Hanager's Report Bob Noe stated that Planning Director, Susan Swift, would provide a report on Barber and Ross at this time. Susan Swift stated staff has met with Barber and Ross and Peterson Company representatives. To date a formal application for the site plan or special exception has not been received. She reported the town has initiated a plan amendment and has scheduled a meeting with VDOT to discuss the issues. Further staff has sent a letter to ]. Randall Minchew with rezoning options for the existing Barber & Ross site. Council thanked Ms. Swift for the report and asked for regular updates. K. Legislation [ ORDTNANCES ] Town Council Minutes for .~uly 22, 2003 Page 6 None CONSENT AGENDA On a motion by Vice Mayor .lackson, seconded by Councilmember Buttery, the following consent agenda was proposed: 2003-116 RESOLUTION Authorizing an agreement and approving a performance guarantee for Potomac Station Battlefield Parkway, Phase :[! public improvements. The consent agenda was approved by the following vote: Aye: Buttery, Jackson, Kramer, Martinez, Schmidt, Zoldos and Mayor Umstattd Nay: None Vote: 7-0 REGULAR AGENDA ] RESOLUTION Endorsing the Loudoun Museum proposal for acquiring use of School Board Union Street properties and restoration of training school. Bob Noe stated the Loudoun Museum has asked to defer this issue. Lm Boards and Commissions a. Airport Commission - Councilmember Zoldos stated the commission's meeting date has been changed to the 3rd Tuesday of each month at 7:30 p.m. in the BP/Amoco Room of Town Hall. Further, he stated the next meeting would be August 19th. b. Thomas Balch Library Commission - No comment c. Board of Architectural Review - No comment d. Cable Commission - Vice Mayor .lackson stated he would be making an appointment to the Cable Commission at the next meeting. e. Economic Development Commission - No comment f. Environmental Advisory Commission - Councilmember Kramer stated she was pleased to see EAC members at tonight's meeting to discuss recycling. g. Tnformation Technology Commission - No comment h. Parks and Recreation Commission - Councilmember Buttery, responding to an earlier petitioner, stated all meetings of this commission are posted. i. Planning Commission a. Town Plan Status Report was provided by Planning Commissioner Lyle Werner. Susan Swift reported the southwest sector meeting would be held on Thursday, July 24th at Catoctin Elementary School followed by the northeast sector at Harper Park Middle School on ~luly 29th and the northwest sector at !da Lee on July 31st.
