Councilmembers Present: Frank Buttery, Melinda Kramer, Mervin Jackson, Marry Martinez, Robert Zoldos, and Mayor Kristen Umstattd. Staff Present: Town Manager Robert Noe, Town Attorney William Donnelly, Assistant to the Town Manager Nicole Ard, Assistant to the Town Manager Kathleen Leidich, Director of Engineering and Public Works Tom Mason, Interim Finance Director George Shelley, Library Manager Alexandra Gressitt, Management Intern Alexandra Shabelski, and Clerk of Council Judy Ahalt. Minutes On a motion by Councilmember Zoldos, seconded by Councilmember Buttery, the minutes of the November 10, 2003 work session were approved by a 6-0-1 vote, Councilmember Schmidt absent. On a motion by Councilmember Martinez, seconded by Councilmember Kramer, the minutes of the November 24, 2003 work session were approved by a 6- 0-1 vote, Councilmember Schmidt absent. On a motion by Councilmember Buttery, seconded by Councilmember Martinez, the minutes of the November 25, 2003 meeting were approved by a 6-0-1 vote, Councilmember Schmidt absent. Presentations a. Virginia Travel & Tourism - Charlotte Reed Ms. Reed presented Marantha Edwards with a certificate of Completion from the Virginia Polytechnical Institute and State University Virginia Travel and Tourism Institute. b. VML Achievement Award - Steve Cawthron Mr. Steve Cawthron presented Council the Virginia Municipal League Achievement Award for Tuscarora Landscaper's Choice, lapel pins and a final report on the mosquito control program. F. Petitioners Howard Dawley, Loudoun County Fire and Rescue, urged Council to approve the boundary line agreement with the county so construction can begin on the burn building. Lori Ciafre, 115 Meade Drive SW, urged Council to approve the resolution regarding stop signs along Meade Drive. Town Council minutes for December 9, 2003 Page 2 Dawn Barrett, 115 Meade Drive SW, urged Council to approve the resolution regarding stop signs along Meade Drive. Peter Dunning, Bluemont Concert Series, asked Council to approve an appropriation of $10,000 to the Bluemont Concert Series to reinstated the established funding levels for programs in FY 2003 and FY 2004. .lim Haynes, 602 Lasswell Court SW, addressed the issue of FBO fees stating he spoke with Peter Stephenson who met with representatives of Piedmont Hawthorn regarding this issue in 1993 and suggested reviewing the Airport Committee and Town Council minutes from that time to find the outcome of that meeting. Further, Mr. Haynes recommended that an Airport Director be appointed quickly and that Councilmember Zoldos be appointed to serve on the Airport Technical Advisory Group. John Drury, addressed Council regarding traffic congestion on Battlefield Parkway. He urged Council to work with State and Federal governments to secure funding. Ken Reid, addressed Council regarding the need for funding to complete Battlefield Parkway. He urged citizens to email their concerns to the Virginia Department of Transportation at six-yearprogram(~virginiadot.org. Public Hearing a. SE-2003-05 - Loudoun Motor Sports - Public Hearing The public hearing opened at 8:06 p.m. Brian Boucher outlined the application for a special exception at 212 Catoctin Circle, SE. He stated the Planning Commission is recommending approval with conditions. Councilmember Martinez verified staff would look at any possible environment impact issues. Councilmember Kramer stated a commissioner informed her that the vote on this item was close because some of the commission members were worried that special exceptions were being pushed through with changes occurring at the last minute. IVlr. Boucher stated the Planning Commission voted 6-0-1 to approve the application with conditions. Further, he stated there was no public comment at the meeting and this was not a controversial item. Bob Sevila, attorney for the applicant, stated this business would sell and repair motorcycles as well as other power equipment. He thanked staff for their cooperation and handling of the application. There were no speakers. The public hearing closed at 8:23 p.m. Town Council minutes for December 9, 2003 Page 3 I-I. Council Comments Councilmember Martinez stated Hobie Mitchel of the Commonwealth Transportation Board told him that the overpass at Sycolin Road and the completion of Battlefield Parkway are a priority for them. He congratulated Marantha Edwards on her accomplishments and the Economic Development Department for their tourism ad campaign. Councilmember Martinez wished the citizens a happy holiday season and urged them to help their neighbors in need. Councilmember Zoldos asked Mr. Noe the status of the credit card audit report as well as staff's progress with the county/town park and ride issue and progress regarding the appointment of a permanent airport director. Further, he congratulated Ms. Edwards on her accomplishments and the street crew for their efforts to clear the snow from the W&OD trail. Councilmember Zoldos wished the citizens a happy holiday season and a prosperous new year. Vice Mayor .]ackson wished the citizens happy holidays. Councilmember Buttery wished the citizens happy holidays and urged them not to drink and drive. Councilmember Kramer wished the citizen's happy holidays. Mayor's Comments Mayor Umstattd wished the citizens a safe and joyful holiday season. Councilmember Martinez stated the Loudoun County Board of Supervisors would be discussing the allocation of the gas tax money as well as the Brothers Concrete issue at their December 15 meeting. .1. Manager's Report Mr. Noe stated the parade and tree lighting ceremony were cancelled for Saturday because of the projected additional snowfall. He stated the tree lighting and pictures with Santa Claus have been rescheduled for December 13 at 6:00 p.m. Mr. Noe introduced George Shelley, Tnterim Finance Director, and Alexandra Gressitt, Balch Library Manager. He congratulated David Kackley who received the O'Neal Stewart Award for Employee of the Quarter for the Leesburg Police Department. Further, he stated the auditors with PBGH will be providing their report on the credit card audit at the January 13 Council Meeting. Mr. Noe stated when Cindi Martin was first appointed as Tnterim Airport Director in 2001, she was an employee of Campbell and Paris. He stated two meetings ago comments were made that she was acting inappropriately in signing off on Campbell and Paris items; however, she did so at his direction. Mr. Noe stated staff has not met with the county regarding the park and ride meeting; however, staff plans to meet with them sometime next week. He stated the interviews are ongoing for the position of airport director. Further, Mr. Noe stated there have been a number of staff meetings regarding efforts to connect Town Council minutes for December 9, 2003 Page 4 Battlefield Parkway to the Greenway and staff will be meeting with officials from the Virginia Department of Transportation on December 22. K. Legislation CONSENT AGENDA On a motion by Councilmember Martinez, seconded by Mayor Umstattd, the following consent motion was proposed: 2003-163 RESOLUTION Authorizing the Town Attorney to enter into litigation to collect delinquent water/sewer bills from South Street Under. 2003-164 RESOLUTTON Accepting public improvements, releasing the performance guarantee and approving a maintenance guarantee for public improvements at Woodlea Manor, Section 7. The motion was approved by the following vote: Aye: Buttery, Kramer, Jackson, Martinez, Zoldos and Mayor Umstattd Nay: None Vote: 6-0-:L (Schmidt absent) REGULAR AGENDA On a motion by Vice-Mayor .~ackson, seconded by Councilmember Kramer, the following motion was proposed: 2003-165 RESOLUTION Authorizing the Town Manager to install an all-way stop on Meade Drive at Lawnhill Court and Fairfield Way. The motion was approved by the following vote: Aye: Buttery, Kramer, Jackson, Martinez, Zoldos and Mayor Umstattd Nay: None Vote: 6-0-1 (Schmidt absent) On a motion by Councilmember Buttery, seconded by Councilmember Martinez, the following item was deferred: RE$OLUTTON Making an appointment to the Cable Television Advisory Commission. Councilmember Buttery stated there was an issue raised regarding the number of franchise appointees required to serve on this commission and asked that this item be discussed at the January 12 worksession. Boards and Commissions a. Fire and Rescue Site Agreement On a motion by Councilmember Martinez, seconded by Councilmember Kramer, the following motion was proposed: 2003-166 RESOLUTION Authorizing the Mayor to execute the fire and rescue site agreement Councilmember Zoldos asked that a friendly amendment be made to the motion to allow the last sentence of item 11 on page 5 to read "Such payment will satisfy all of the town's school site obligations including without limitation those under the annexation area development policy." The amendment was accepted by Council. Holiday Schedule On a motion by Councilmember Zoldos, seconded by Vice-Mayor .lackson, the following motion was proposed: 2003-168 RESOLUTTON Extending the holiday schedule to include .lanuary 2, 2004. The motion was approved by the following vote: Aye: Buttery, .]ackson, Kramer, Martinez, Zoldos and Mayor Umstattd Nay: None Vote: 6-0-1 (Councilmember Schmidt absent) d. Closed Session On a motion by Mayor Umstattd, seconded by Councilmember Buttery, the following motion was proposed: Pursuant to Section 2.2-3711(A)(1) of the Code of Virginia, ! move that the Leesburg Town Council convene in a closed meeting to consider a personnel matter, specifically the annual performance evaluation of the Town Manager. The motion was approved by the following vote: Aye: Buttery, ,lackson, Kramer, Martinez, Zoldos and Mayor Umstattd Nay: None Vote: 6-0-1 (Councilmember Schmidt absent) Council convened in a closed meeting at 8:59 p.m. Council reconvened in open session at 9::19 p.m. and the following motion was proposed by Mayor Umstattd, seconded by Councilmember Martinez: !n accordance with Section 2.2-3712(D) of the Code of Virginia, T move that Council certify that to the best of each member's knowledge, only public business matters lawfully exempted from open meeting requirements under the Virginia Freedom of Information Act and such personnel matters as were identified in the motion by which the closed meeting was convened were heard, discussed or considered in the meeting by Council.
