MEDINA CITY COUNCIL MEETING MINUTES OF APRIL 6, 1999
The City Council of Medina, Minnesota met in regular session on April 6, 1999 at 7:30 p.m. in
the City Hall Chambers. Mayor John Ferris presided.
Members present: Ferris, Zietlow, Hamilton, Johnson, and Smith.
Members absent: None.
Also present: Police Chief Ed Belland, Attorney Dani Deering, Public Works Director Jim
Dillman, City Engineer Glenn Cook, Planning & Zoning Administrator Loren Kohnen, and City
Clerk -Treasurer Paul Robinson.
1. Additions to the Agenda
A. Update on Mooney Lake Outlet.
B. Update on North American Liquors training program.
Moved by Phil Zietlow, seconded by John Hamilton, to approve the agenda as amended.
Motion passed unanimously.
2. Approval of the Minutes
Moved by John Hamilton, seconded by Phil Zietlow, to approve the minutes of March 16, 1999
as presented. Motion passed unanimously.
3. Comments from Residents in Attendance on Items Not on the Agenda
There were none.
4. Park Commission Comments
There were none.
5. Planning Commission Comments
There were none.
6. Approval of Final Plat Resolution 99-19 for Covey Run — Gubbins Subdivision
Loren Kohnen said that staff recommended approval. He said the issues concerning the power
line easements have been taken care of, and all of the additional items have been approved by
the city attorney.
Moved by Phil Zietlow, seconded by Jim Johnson, to approve Resolution 99-19 Granting Final
Plat Approval the Plat of Covey Run.
7. Approval of Resolution 99-20 Granting a Conditional Use Permit for Holy Name
Church
Loren Kohnen said that staff recommended approval of the conditional use permit. He said the
church has worked out a solution with the neighbors to the east on Brockton Lane. He said they
thanked Father Arnold for taking care of this issue for them.
Moved by Jim Johnson, seconded by Phil Zietlow, to approve Resolution 99-20 Granting an
Amended Conditional Use Permit to Holy Name of Jesus Catholic Church. Motion passed
unanimously.
8. Conditional Use Permit for Valvoline Instant Oil Change — Clydesdale Trail
Loren Kohnen read his memo from March 5, 1999. He said that Valvoline Instant Oil Change
was requesting a conditional use permit to construct a building for an oil changing facility. He

said the property is zoned for urban commercial, and that this use would be permitted in this
district. He said exterior building materials would be concrete and include an enclosure for the
dumpster. He said that the proposal meets building material and setback ordinances.
Loren read the conditions to the conditional use permit as approved by the planning
commission. He said that staff recommended approval of the conditions as approved by the
planning commission. He made a note that the barrel fascia must meet the glare ordinance. He
showed a plat of the proposal on an overhead and showed where the NURP pond would be
located. He said this would be a nice addition to the city.
Phil Zietlow said that condition 1 could simply read "NURP pond can continue as long as it is
maintained".
There was some discussion about the barrel lighting. Mark Gilbertson, a representative from
Valvoline, said they could turn off the barrel lighting on the rear of the building at closing but
leave the barrel lighting that faces Trunk Highway 55 on until midnight.
There was some additional discussion about this.
Phil Zietlow said that he would change condition 6 to state that the "barrel lighting will be off
from 10 p.m. to 7 a.m."
There was some additional discussion about the barrel lighting, the amount of wattage the
barrel lighting would cast, and the number of lights that would be needed underneath the barrel
lighting.
Mark Gilbertson said they would meet the City's glare ordinance restrictions.
There was some more discussion regarding the wattage and barrel lighting. Condition 7 was
modified to include "no more than 400 watts of lighting under a dark translucent canopy(barrel
lighting) would be allowed".
There was a correction to condition 17, it should read "maintenance plan for flammable waste
trap to be available for city staff review".
Condition 18 acknowledged that the roof top 30 inch ventilator did not need to be screened. The
reasons for this were that it would not be visible to neighboring properties and that it would
negatively affect the performance of the roof top ventilator. Those reasons were to be added to
the resolution.
Condition 21 was added. It stated "the city would hold in escrow an amount sufficient to pave
the Clydesdale Trail and provide water and sewer to Valvoline Motor Oil Station".
Moved by Jim Johnson, seconded by Carolyn Smith, to authorize the city attorney to draft a
resolution approving the conditional use permit with the additions and corrections. Motion
passed unanimously.
9. Conditional Use Permit for Hennepin County Parks Maintenance
Loren Kohnen read the memo in the council packet. He said that the Hennepin County
Regional Park District would like to construct a second maintenance building on the same site

as the existing building. The building would have a total square footage of 11,935 square feet
and it would be constructed of tip up concrete panels, the same as the existing building.
Loren then read the 11 conditions as approved by the planning commission and showed an
overhead of the proposed building and site plan for the Hennepin County Public Works building.
Alex Meyer from Hennepin Parks was in attendance to answer questions.
Phil Zietlow asked how much the building would cost.
Meyer said that it would cost $1.4 million.
There was some discussion about the conditions.
Condition 6 was amended to include "there will be no lighting on property from 9:00 p.m. to 5
a.m. unless employees were on site".
There was some discussion about the type of trees that would be used for screening.
Alex said that they would adhere to the reforestation in condition 11. He said that would include
3,000 to 4,000 plantings.
Three other conditions were added.
One was that Hennepin County roads department review and approve existing driveway for
increased use. The second was that all existing CUP's, as practical, be combined into one
document. And the last one required a flammable waste trap.
Moved by Jim Johnson, seconded by Phil Zietlow, to direct the city attorney to draft a resolution
approving the conditional use permit with the recommended changes and corrections.
Motion passed unanimously.
10. Conditional Use Permit for Bill Nunn
This item was included in the council packets but was not listed on the agenda.
There was a motion made by Phil Zietlow, seconded by John Ferris, to add this item to the
agenda. Motion passed unanimously.
Loren Kohnen read his memo in the council packet. He said that Mr. Nunn would like to
construct an addition to his garage to house one of his antique carousels.
Loren Kohnen read the conditions from the planning commission and showed on an overhead
the proposed addition. One condition was added. This condition prohibited the housing of
livestock or animals in this building.
Moved by Phil Zietlow, seconded by Carolyn Smith, to direct the city attorney to draft a
resolution approving the conditional use permit as amended. Motion passed unanimously.

11. Mooney Lake Outlet Update
Loren Kohnen updated the city council on a meeting he attended with the other communities
involved in this project. He said a number of options were presented for controlling the lake
level at Mooney Lake. The one option that received the most discussion and seemed most
practical involved constructing of a storm sewer that would eventually drain into the City of
Wayzata. Representatives of the City of Wayzata had some concerns about this option, which
would cost around $175,000.
Loren Kohnen said the concern he raised at that meeting was who would pay for this project,
especially since the City of Medina has very few properties along the lake and since this
problem basically came into existence after the construction of homes on the Plymouth side of
the lake.
There was some discussion about whether or not the watershed district was the lead
organization on this project, and if they were going to push this project through if there was not
unanimous agreement from surrounding cities.
Kohnen said that he would keep the council up to date on any new developments in this area.
12. Resolution 99-21 Approving Sewer and Water Feasibility Study for Mohawk Drive
Glenn Cook said in addition to the approval of the feasibility study a public hearing would need
to be set for May 4, 1999 and he would need approval to prepare plans and specifications for
the sewer and water lines on Mohawk Drive.
Moved by Jim Johnson, seconded by Phil Zietlow, to approve Resolution 99- 21 the feasibility
study, set the improvement hearing for May 4, and approve the preparation of plan and
specifications . Motion passed unanimously.
13. Chippewa Road Feasibility Study
John Ferris said completing this project in 1999 makes it work better for all parties involved. He
said the city needs to make this project a priority. He said Jim Dillman has an excellent plan to
move ahead with this project.
Glenn Cook said that he would prepare the feasibility study for Chippewa Road for the April 20
council meeting.
There was some discussion about the strategy for removing the driveways along Trunk Highway
55 in order to give the city greater leverage in requesting funding for a signalized intersection at
Willow Drive and Trunk Highway 55.
There was some discussion about commercial versus residential assessments. It was
mentioned that Wally Cates recently requested that his property be considered for urban
commercial zoning.
Glenn Cook said they could assess him as commercial property and if for some reason the
property was not placed into the urban commercial zone, there would have a mechanism in
place for Mr. Cates to receive a residential assessment and for the city to refund him the
difference.

Matt Faue, a resident of Corcoran living on Willow Drive, said that he was concerned about the
potential traffic increase and problems created by the paving of Chippewa Road. Currently it is
a dangerous intersection and it is nearly impossible at times during the day to get out onto
Trunk Highway 55 from Willow Drive.
There was discussion about this issue, however, at this time Glenn Cook said the intersection
was not bad enough, according to MnDOT, to receive funding.
Matt Faue asked if it would be possible for a turn lane to be placed in the middle of the highway
so at least a car could get half way across the highway and then merge into the traffic from the
middle. He called it a "safe landing area" in the middle of the highway.
John Ferris said that the city will make every effort to get a light at that intersection.
14. Townline Road
Jim Dillman said that next week the City of Orono was going to have a public information
meeting concerning Townline Road. He said that it would be good to have somebody from the
City of Medina to representative the City's position on this issue.
John Ferris said that he would be willing to go and represent the city at that hearing.
15. Computer Software
Ed Belland said recently he talked to the council about the problems with the police
department's current database program. He said that he and the police assistant had attended
a number of seminars and looked at several products. The two main products were PC Enfors
and Visions. He said that the advantages of PC Enfors were that it is: currently up and running,
a local company, modeled after their existing software, and will eventually allow local police
departments in the area to link to one another.
He said that Visions was an excellent product. He said that its biggest drawback is its cost and
that there is not a solid date when it will be available.
Belland said that the purchase price for Visions is around $26,000, and $10,195 for PC Enfors.
He said annual maintenance for Visions would be around $6,500 per year as compared to
$2,600 per year for PC Enfors.
He said that after weighing all the factors, he is asking for approval to purchase the Enforce
software package.
Moved by John Hamilton, seconded by Carolyn Smith, to approve the purchase of Enforce.
Motion passed unanimously.
16. Officer Reserve Program
Ed Belland said that this was basically an informational item letting the council know that the
police department is still moving forward with implementing a reserve program as budgeted.
17. Resolution 99-22 Accepting Donation from Steven Lundell
Moved by Jim Johnson, seconded by Carolyn Smith, to approve Resolution 99-22 Accepting
Donation from Steven Lundell of a Digital Camera. Motion passed unanimously.

18. Oxygen Regulators
Ed Belland said he initially recommended purchasing new regulators. However, after additional
research into this issue he decided to retrofit the City's current regulators. He said this will last
quite a long time and cost significantly less.
19. North American Liquor Training Program
Ed Belland said that he reviewed their training program. He said it was acceptable.
20. Y2K Resolution 99-23 Designating a Y2K Coordinator
Moved by John Hamilton, seconded by Carolyn Smith, to approve Resolution 99-23 Designating
a Y2K Coordinator. Motion passed unanimously.
21. Approval for a Goose Round Up at Baker Park
Moved by John Ferris, seconded by Phil Zietlow, to approve a goose round up at Baker Park.
Motion passed unanimously.
22. Pay the Bills
There was a discrepancy between the claims amount in the packet and the amount on the
claims sheet.
Paul Robinson said that the discrepancy was for checks that were related to the payroll and for
the purchase of the Police Department's Tahoe.
Moved by Jim Johnson, seconded by Phil Zietlow, to approve the bills as presented
Order check numbers 19517-19573 for $89,162.46 and payroll check numbers 16046-16066 for
$15, 461.98. Motion passed unanimously.
23. Request from Bill Cavanaugh
At the end of the meeting the mayor recognized Bill Cavanaugh. Mr. Cavanaugh said he
wanted the county's records to reflect his deeds. He said the county currently shows three
parcels, however, he has 10 deeds for this property.
There was some discussion about whether or not this would require a resolution to subdivide
the property.
In order to resolve this issue, John Ferris said a meeting should be set up between Mr.
Cavanaugh, the planning and zoning administrator, and the city attorney to discuss this issue.
