HomeMy Public PortalAbout1993-08 Rezone Property On Round Barn RoadORDINANCE 1993 -8 AN ORDINANCE TO REZONE HURLEY - PINGLETON PROPERTY CONSISTING OF 12.66 ACRES ON ROUND BARN ROAD WHEREAS Bret D. Hurley and Lee R. Pingleton are the owners, hereinafter referred to as Hurley - Pingleton, of a 12.66 acre parcel located on the west side of Round Barn Road, Greencastle, Indiana, Putnam County, Indiana, in the Southeast quarter of Section 15 Township 14 North Range 4 West in Greencastle Township; and, WHEREAS Hurley- Pingleton petitioned for rezoning of such parcel before the Greencastle Plan Commission from R1 to R2; and, WHEREAS such property has been annexed to the City of Greencastle by Ordinance #1993 -3 approved by the City Council on April 28, 1993; and, WHEREAS the Greencastle Plan Commission has recommended the rezoning of said parcel from RI to R2 subject to any undeveloped portion reverting to Rl in event of sale of any part of such undeveloped tract; and, WHEREAS I- Iurley- Pingleton have made Offers of Dedication to the city of casements for Round Barn Road right of way and for street right -of -way (city has not formally ® accepted such easements) in conjunction with their petition for annexation which were recorded in miscellaneous record page ' C ( on July 1993. NOW THEREFORE be it ordained by the Common Council of the City of Greencastle that the following described tract in Putnam County Indiana be rezoned from RI to R2: A part of the Southeast quarter of Section 15, Township 14 North, Range 4 West located in Greencastle Township, Putnam County, Indiana, being bounded as follows: Commencing at the Southeast corner of the Southeast quarter of Section 15, Township 14 North, Range 4 West (brass plug in casting): thence North 00 degrees 05 minutes 38 seconds West (assumed bearing) 1160.45 feet along the East line of said Southeast quarter to the Southeast corner of a 27.89 acre tract of land (Tract N1) described and recorded in Plat Book /18, Pages 104 & 105 and also recorded in Miscellaneous Record 88, Pages 310 and 311, said point also being the POINT OF BEGINNING of this description; thence continuing North 00 degrees 05 minutes 38 seconds West 419.26 feet along the East line of said Southeast quarter; thence South 89 degrees 20 minutes 54 seconds West 1312.45 feet to a point on the West line of said 27.89 acre tract of land; thence South 00 degrees 11 minutes 48 seconds East 421.45 feet along the West line of said 27.89 acre tract of land to its intersection with the Westerly extension of the Northmost ® South line of said 27.89 acre tract of land; thence North 89 degrees 15 minutes 08 seconds East 1311.72 feet along the Westerly extension of the Northmost South line and along the Northmost South line of said 27.89 acre tract of land to the POINT Of BEGINNING, containing 12.66 acres, more or less.
