PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael Thompson, Council Member Peter Wadsworth, City Attorney Andrew Rawlings, Public Works Director Zech Prouse and City Clerk/Treasurer Keri West. ABSENT: Council Member Evan Mann. VISITORS: Brooke Allen, Bill Koester and James West. ITEMS OF BUSINESS: Discussion of Dogs Prohibited at City Events — Mayor Gubler stated there was an incident at the Easter Egg Hunt where a young man on a bicycle was bitten by a dog. The dog and its owner could not be found after the incident. He continued and stated he has received other complaints about dogs at City Events creating an unsafe environment for people attending the event. Mayor Gubler asked Attorney Rawlings if there is something the City can do to prohibit dogs, other than service dogs, at City events. Attorney Rawlings stated the City can prohibit dogs at events, there will just need to be a section carved out that designates and allows service animals. Council President Geray stated he is not opposed to this type of action and clarified it would only pertain to City events and would not restrict dogs at the City Park on non-event days. Mayor Gubler stated Council Member Mann had mentioned to him that dogs have created problems in the past at the City Park for people attending City Recreation games. He continued and stated he thinks this ordinance should include City Recreation games as City Events. Clerk West stated the laws are difficult pertaining to service animals, as far as what is considered a service animal and what proof can be required of someone with a service animal. Attorney Rawlings agreed and stated he would research this and would do his best to draft an ordinance that only allows dogs as defined by the Americans with Disabilities Act (ADA). Council Member Wadsworth stated he agrees with this course of action and recommended a violation be considered an infraction to allow for better enforcement. Deputy Randall agreed. Attorney Rawlings stated he will draft an ordinance to be reviewed and voted on at next month's meeting. Discussion of Engine Brake Ordinance—Mayor Gubler stated over the years this question has come up multiple times, but recently he has received a lot of complaints about loud engine brakes being used by large trucks at early hours of the morning within City limits. He continued and stated there is no reason to have engine brakes engaged in the City limits where the speed limit is only 35 mph. Mayor Gubler stated if the ordinance is passed, it gives the City the ability to put signs up near the road and deputies the ability to enforce it. No objections made by any Council Members. Discussion of Water at Church of Jesus Christ of Latter-day Saints on Iona Road —Mayor Gubler stated many years ago representatives from the Church of Jesus Christ of Latter-day Saints approached the City about connecting their church on Iona Road to the City's culinary system. It was arranged at that time to allow the church to water their grounds with water from IONA CITY COUNCIL WORK MEETING—APRIL 19, 2022 the canal. He continued and stated this has caused problems for their plants because of the timing of the canal water. Mayor Gubler continued and stated two years ago the church representatives approached the City again and asked if they were to purchase water rights and give them to the City if they could connect to the City's culinary water system for their exterior water needs. The City agreed, but the church has not been able to acquire water rights. Mayor Gubler stated the church representatives are now asking if they were to rent water from the water bank and put it in the City's name, would they now be permitted to connect to the City's culinary water system. Mayor Gubler added, the pump on the church's property has been vandalized, so to move forward the church either needs to repair their pump or use that money to connect to our culinary water system. Mayor Gubler stated he has spoken with Director Prouse and understands the prior concerns expressed by the City, but he personally does not see a problem with this now as long as the church pays for the water. Attorney Rawlings asked how long this agreement would be active. Mayor Gubler stated the agreement with the water bank is two years. Council Member Thompson asked if the infrastructure is already in place for the church to connect to the City's water system. Mayor Gubler confirmed. Council Member Wadsworth asked how much the church is currently paying for their water from the City. Clerk West stated each church is currently paying $416.50/month, which is 8.5 Equivalent Dwelling Units (EDUs). Council Member Wadsworth stated he thinks they are paying enough to allow them to also use City water for their grass and plants. Director Prouse suggested the church be required to adhere to current City Code, including the requirement of a permit for the installation and a backflow prevention test to be run and submitted to the City annually. He continued and stated other than that, he doesn't have any problem with this proposal. Director Prouse then suggested if the church installs an external loop with a line that is 2" or smaller, they will then be required to install a meter pit and meter, along with the backflow preventer. No concerns voiced by the Council or Mayor Gubler. Attorney Rawlings asked if he needs to draft an agreement for this. Mayor Gubler stated no agreement is necessary and he will communicate this information directly to the church representatives. Discussion of Fiber Internet Request for Proposal — Mayor Gubler stated the City Engineer has prepared the Request for Proposal (RFP) for the fiber project and it has been provided to the City Council in tonight's packet. He continued and stated he is interested in feedback from the City Council on the RFP tonight so it can be finalized and advertised as soon as possible. Mayor Gubler stated he thinks the RFP needs to outline the total cost, both to the City and to the end user for connection to the system. He continued and expressed his desire to reduce the total cost per connection, as much as possible. All Council Members agreed. Discussion then began regarding the intention of the RFP and whether items should be more specific or broad, allowing further negotiation with the chosen candidate. After discussing the RFP in its entirety, the Council agreed to include the following requirements in the RFP: • City's total investment not to exceed $450,000; • Deadline for work to be completed should be stated as, "The project must be completed and operational as per the deadline for use of ARPA funds." • All questions regarding proposals must be directed to Director Prouse by 5:00pm (MST) on Thursday, May 19, 2022. Proposals themselves are also due by 5:00pm (MST) on Thursday, May 19, 2022; • Electronic proposals must be emailed to cityclerkn,cityofiona.org; 2 IONA CITY COUNCIL WORK MEETING—APRIL 19, 2022 • End user cost must be defined in the proposal (each resident's connection fee). Clerk West stated she will send all of the updated information for the RFP to the City Engineer to edit. She continued and stated once she receives the final copy back she will have it published and advertised. Council President Geray stated they will discuss all submitted RFPs at the next City Council Meeting to be held Tuesday, May 24`h General Water System Discussion—Mayor Gubler stated there is water in the tank and the tank has now met the water loss standard set by the Department of Environmental Quality (DEQ). However, they believe a power surge occurred that damaged some components in the supervisory control and data acquisition (SCADA) system. Mayor Gubler continued and stated the wiring was not completed according to spec. At this point, the contractor is contacting the electrician to fix the work that was completed incorrectly. He continued and stated the system could be run manually right now, if the City desired. Council President Geray expressed concern over the lack of oversight to ensure everything is being completed according to spec. Mayor Gubler then stated there may also be a leak in the overflow pipe system that is currently being addressed. Director Prouse confirmed the City is not paying for any of the repairs. Mayor Gubler stated Dome Technology will be supplying him a schedule of when all the repairs and final tasks will be taking place. Council President Geray again expressed his disappointment in the evolution of this project and asked if there are any fees the City could be assessing the contractor. Director Prouse stated the contract includes steps the City could take regarding this, but the City Engineer does not believe it has reached that point yet. He continued and stated Council Members are invited to discuss this with the City Engineer if they disagree. Council Member Wadsworth expressed his thanks to Director Prouse and Mayor Gubler for their diligence in this ongoing project.
