PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael Thompson, Council Member Peter Wadsworth, Council Member Evan Mann, City Attorney Andrew Rawlings, Public Works Director Zech Prouse and City Clerk/Treasurer Keri West. ABSENT: None. VISITORS: Bill Koester, James West, Todd Kennington, Robert Wright, Heather Marley, Chani Reading, Journee Holdaway and Rebekah Brinkerhoff. Mayor Gubler welcomed everyone and Clerk West led the Pledge of Allegiance. A roll call was taken by Clerk West to open the meeting. CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of March 15, 2022 were reviewed. Council reviewed the finance reports for the period ending March 31, 2022 (50% of the fiscal year elapsed). The City had $2,302,952.40 in the bank and routine bills had been paid, "Exhibit A". Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the consent agenda as presented. Council Member Wadsworth seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: Smoke, Vape & Tobacco Free Parks Proposal; Mayor's Youth Advisory Council —Journee Holdaway and Chani Reading approached the podium as representatives of the Mayor's Youth Advisory Council (MYAC). Miss Holdaway stated the MYAC would like to propose to the City Council to make the City block around the Iona City Park, as well as all current and future parks in the City, smoke, vape and tobacco free. Miss Reading explained the negative influence this type of behavior has on the youth in the area and the benefits that would come if this proposal is approved. She continued and explained the negative health effects of secondhand smoke and stated this proposal would eliminate that health risk at City parks. Miss Holdaway stated Eastern Idaho Public Health District 7 has offered to supply all of the signs for the City parks at no cost to the City. Council Member Mann asked what type of sign would be provided. Miss Holdaway confirmed they are metal signs. Council Member Wadsworth asked Attorney Rawlings if this proposal is legal for the City to pass and what type of penalty the City can enforce if passed. Attorney Rawlings stated Iona City Code 8-1 is already written with rules to regulate the City parks. He continued and stated this would be an amendment to the current code. Attorney Rawlings stated the City has already enacted an infraction fee schedule, so enforcement of this addition to the Code would be included in that. Deputy Randall encouraged the Council to designate this as an infraction, if passed, to allow for easier enforcement. Council President Geray congratulated the MYAC on a good, cohesive discussion on this proposal. He continued and asked them how they would respond to a person that has lived in Iona for many years and argues their right to smoke in the park as a taxpaying citizen. Miss Holdaway stated the MYAC is not trying to take away freedoms with this proposal, but would IONA CITY COUNCIL REGULAR MEETING—APRIL 19, 2022 like to increase the health and safety of the youth and children in the park as they are the people that use the park the most. Council Member Wadsworth asked the MYAC's opinion on creating a designated area in the park for smoking. Council President Geray and Council Member Mann agreed with this suggestion. Mayor Gubler asked Clerk West to communicate with surrounding areas to see if they have designated smoking areas in their City parks. Council President Geray suggested the MYAC members do this, rather than Clerk West. Mayor Gubler agreed. MYAC members accepted this suggested. Council President Geray stated he does not believe the Council is opposed to this proposal, but would like to hear feedback from nearby communities. Mayor Gubler agreed, but stated his opinion would be to protect the health and rights of everyone using the parks by restricting smoking and vaping in all areas of the parks. Council President Geray stated he understands the health benefits, but it is someone's right to smoke and thinks it is reasonable to designate an area of the park for smoking. He also stated this would help with enforcement, to direct someone where to go if they argue their right to smoke in the park. Clerk West expressed her concern with a designated area that is near a residence and how it would affect that resident. Mayor Gubler thanked the MYAC and encouraged them to do the requested research and bring their information back to the Council next month. Discussion with Idaho Falls Public Library —Robert Wright of the Idaho Falls Public Library (IFPL) approached the podium and stated the contract the City of Iona has with the IFPL requires an annual update on how the Iona Library is doing. He continued and stated the IFPL actually contracts with the Bonneville County Library District (BCLD), which then contracts with the City of Iona to include the Iona Library. Mr. Wright stated the Iona Library was started in the early 2000s by volunteers. In 2006, the IFPL approached the volunteers and the City of Iona and offered to manage the library, since the BCLD paid IFPL for services to Bonneville County residents. He continued and stated they negotiated the contract that the City of Iona would provide the building, pay for maintenance and all utilities, while the IFPL would manage the library. Mr. Wright stated there are currently 7,546 items in the Iona Library and has issued over 900 library cards from this location. He continued and stated the Iona Library is open 30 hours/week and checks out over 3,000 items each month. He stated each week there are several bins delivered full of books and other items transferred from the IFPL. Mr. Wright thanked the Friends of the Iona Library (FOIL) organization as they have been an integral part of the success of the Iona Library. He continued and thanks current and past Mayors and Councils for their willingness to partner with the IFPL to benefit the residents of Iona. Mayor Gubler agreed it is an integral part of our community and wants it to continue. Mr. Wright stated the BCLD is currently reviewing their contract with IFPL. He stated if they choose not to renew their contract, the City of Iona is welcome to discuss and contract directly with the IFPL to keep the Iona Library as is. Business License Application; Relax & Recover LLC — Todd Kennington approached the podium and stated he has started a business and is interested in obtaining a Business License to do business in the City of Iona. He stated he has a 6x10 cargo trailer with an electric massage chair and air conditioning inside to offer massages. Mr. Kennington stated he has spoken with the owner of Main Street Sales, located at 3647 N. Main Street, and he has agreed to let him park his cargo trailer on his property. He continued and stated he has a business license through the state and is interested in obtaining a business license in Afton. He stated he is also planning on doing business in Rigby, which does not require a business license. Mr. Kennington stated he 2 IONA CITY COUNCIL REGULAR MEETING—APRIL 19, 2022 will have a website set up to allow for online reservations. He continued and stated his goal is to be a mobile business, but he would like to start out with a specific location to get people familiar with the business. He stated the prices will range from $15-$30 for massages that range from 15- 60 minutes. Council President Geray asked if the trailer will stay at the location, or if it will be moving around. Mr. Kennington stated the trailer will be moving to other locations, depending on when appointments are scheduled, but would stay at this location for all Iona appointments. Mayor Gubler stated if this is by appointment, there should not be an issue with parking. Council President Geray asked if the trailer is labeled for the business. Mr. Kennington confirmed the trailer is marked with names and logos for the business on the outside. Clerk West asked if Mr. Kennington needs to provide proof of permission by the property owner for the Council to approve the business license. Attorney Rawlings stated that is not necessary for a business license, only for a Conditional Use Permit, which is not required for this situation. Mayor Gubler entertained a motion. Council President Geray made a motion to approve the Business License Application for Relax & Recover, LLC, as owned by Todd Kennington. Council Member Wadsworth seconded the motion. All in favor, motion carried. Ordinance to Enact Iona City Code § 9-1-9 prohibiting the use of engine compression brakes within City boundaries (Ord. 276-04-22) — Mayor Gubler stated the Council discussed this at the Work Meeting prior to this meeting. He explained the City has been getting complaints about certain types of trucks coming through the City at early hours of the morning and using their loud engine brakes. He continued and stated this is a disturbance and that it is not necessary to use engine brakes within the city limits, where the speed limits are all 35 mph or lower. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve Ordinance 276-04-22, an Ordinance of the City of Iona, Idaho; enacting a new Section 9-1-9 of the Iona City Code; prohibiting the use of engine compression brakes (A.K.A. Jake Brakes) or other loud braking systems within City boundaries; providing for severability; and establishing an effective date. Council Member Wadsworth also made a motion to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council Member Mann seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member Thompson: YES Council Member Mann: YES Discussion of City Hall Makeover by Hamlet Homes — Clerk West stated sub-contractors for Hamlet Homes will be here on Wednesday, May 4th, to tear out the front steps to the City Building. She stated the office will still be open that day,but people will need to come in through the gym. She continued and stated on Thursday, May 5th, Hamlet Homes will be bringing a bus of approximately 25 employees from Utah to renovate the foyer area of the City Building, pouring the front steps and replacing the front handrails. Clerk West continued and stated she has already communicated with the other tenants in the City Building and has informed them the entire City Building will need to be closed to the public that day for safety reasons. She also stated Hamlet Homes has hired Jill's Chicken Shack to cater an employee and community lunch 3 IONA CITY COUNCIL REGULAR MEETING—APRIL 19, 2022 that day in front of the City Building, for anyone that would like to come from 12:30pm-2:30pm. Clerk West stated Hamlet Homes has provided a flyer for the City's Facebook page, and also asked if the City would send the flyer to all residents with the monthly water bill, to notify them of the event. Clerk West and Council President Geray agreed it is a reasonable request and is a large contribution to the City. STAFF REPORTS: Clerk West stated the May Council Meeting has been pushed back one week to accommodate voting on May 17th. So, the meeting will be held on Tuesday, May 24th She also stated the Easter Egg Hunt went well in April and they received a lot of positive feedback. Council President Geray agreed and stated he felt the Easter Egg Hunt was a huge success. Clerk West also updated on the success of the Recreation Department and stated they had 12 teams register for flag football, which is good considering the short notice of a new league. She also stated the baseball/softball registration is complete and they have approximately 80 teams registered. Director Prouse stated Elim Estates has tied into the water line on the north end of the subdivision, through Homer Estates. He continued and stated they are waiting for power poles to be moved on Iona Road before they can begin the sewer work. Director Prouse stated once that sewer work begins, Iona Road will be closed and traffic will be detoured through Quaky Aspen Drive and continued through the Mountain Ridge Subdivision, for up to 2 weeks. Director Prouse also updated the Council on the tennis court project and stated he is working with the City Engineer to complete the bid packets to advertise for a contractor to complete the project. Mayor Gubler stated the tennis courts have already been excavated and the material is being stored on the parking lot near the new water tank. Director Prouse also updated and stated the work truck he has ordered is still delayed with an anticipated delivery date of August or September 2022. Deputy Randall reported the calls for service are similar to this time last year. He also stated there was one incident with a stolen car and stolen firearms, which occurred the same night, by the same group of people. He continued and stated there has been an arrest in that case and everything has been recovered. Deputy Randall expressed concern regarding contractors leaving tools and supplies unlocked overnight. Council President Geray suggested contacting them directly and letting them know. Council Members Wadsworth, Thompson and Mann all stated nothing to report. Council President Geray reported Election Day on Tuesday, May 17th, and encouraged everyone to research the candidates and vote. Clerk West stated Bonneville County Elections did just complete a major redistricting and encouraged people to verify their new district and where they will need to go to vote. Mayor Gubler publicly thanked everyone involved in the Easter Egg Hunt. He continued and stated it went very well and was a great event. He stated the MYAC youth were there all day to volunteer and he appreciates them and all volunteers and City staff involved. Mayor Gubler continued and stated the next large event will be Iona Days and the planning for it is going well with lots of volunteers.
