® AN ORDINANCE APPROVING THE PETITION
OF D & S INVESTMENTS TO VACATE
CERTAIN PUBLIC RIGI ITS -OF -WAY
WHEREAS, D & S Investments, on behalf of the record title holders and
with their express written permission, has petitioned for vacation of certain public
rights -of -way in the City of Greencastle, Putnam County, Indiana; and
WHEREAS, the Petition for Vacation of Public Rights -of -Way has been
submitted to the Greencastle Plan Commission and such Plan Commission has voted
in favor of the vacation of such public rights -of -way, as requested in such petition,
and issue a recommendation to the Common Council for the City of Greencastle,
Indiana, approving such vacation; and
WHEREAS, all notices have been published and sent pursuant to statute; and
WHEREAS, it appears to the Common Council for the City of Greencastle
that it is in the best interest of the citizens of Greencastle that said Petition for
• Vacation of Public Rights -of -Way be granted.
NOW THEREFORE, be it ordained by the Common Council for the City of
Greencastle, Indiana, that the following public rights -of -way located in Greencastle,
Putnam County, Indiana, and more particularly described as follows:
An unnamed platted street along the Westerly side, an unnamed
platted street along the Southerly side, an unnamed platted street along
the Easterly side and North of Keightley Road, and an unnamed
platted alley through the center of Keightley's Outlols as shown of
record in Plat Book 3, Part I, page. 4, in the Office of the Recorder
of Putnam County, Indiana, located South of the Southern Highway
and West of U.S. 231.
is hereby vacated as public rights -of -way in the City of Greencastle, Indiana.
Said vacation is subject to providing new dedicated rights -of -way allowing
access to all effected landowners.
This Ordinance shall have full force and effect of law immediately upon its
passage by the Common Council for the City of Greencastle, Indiana, and signature
by the Mayor.
