Regular Session Minutes of May 28, 2008 On a motion by Council Member Reid, seconded by Council Member Schmidt, the minutes were passed 6-0-1 (Martinez absent) E. Presentations None F. Petitioners The petitioners section was opened at 7:50 p.m. David Goodfriend, 901 Amber Court, N.E., addressed Council regarding the Loudoun Health Check survey. Dr. Goodfriend encouraged everyone to participate in the survey so that the Health Department can identify the health needs of the community. The petitioner's section was closed at 7:56 p.m. G. Public Hearing None. H. Legislation CONSENT AGENDA On a motion by Council Member Wright, seconded by Council Member Reid, the following consent agenda item was proposed: Town Council Meeting of June 10. 2008 Paqe 2 1. Awarding the Town Wide Tree Canopy Construction Contract RESOLUTION 2008-83 Awarding the Town Wide Tree Canopy Construction Contract The consent item was approved by the following vote: Aye: Hammier, Horne, Reid, Schmidt, Wright and Mayor Umstattd Nay: None Vote: 6-0-1 (Martinez absent) I REGULAR AGENDA I. Town Code Amendment - noise related issues 4. Site Plan review time limits 5. SAGE Project Follow-up 6. Log Cabin Visitor's Center K. NEW BUSINESS (FOR CONSIDERATION TONIGHT) 1. Catoctin Ridae Tank Site On a motion by Vice Mayor Horne, seconded by Council Member Wright, the following was proposed: RESOLUTION 2008-84 Disclaiming Deed of Gift of Conveyance of Catoctin Ridge Tank Site The motion was approved by the following vote: Aye: Hammier, Horne, Reid, Schmidt, Wright and Mayor Umstattd Nay: None Vote: 6-0-1 (Martinez absent) 2. Council Initiated Zoning Ordinance Amendment: Non- residential Height Restrictions On a motion by Council Member Hammier, seconded by Vice Mayor Horne, the following was proposed: RESOLUTION 2008-85 Initiating Amendments to Section 6.3 of the Leesburg Zoning Ordinance to Increase Building Height in Specific Areas of the B-1 Zoning District Mayor Umstattd stated she would not be supporting this at this time, but would keep an open mind. She stated she is concerned about creating a canyon effect. Rules of Order On a motion by Council Member Wright, seconded by Vice Mayor Horne, the following was proposed: RESOLUTION 2008-86 Authorizing the Town Attorney to Advertise Public Hearings to Repeal, Amend and Reordain Sections 2-20 Through 2-26 of Article II of the Leesburg Town Code The motion was approved by the following vote: Aye: Hammier, Horne, Reid, Schmidt, Wright and Mayor Umstattd Nay: None Vote: 6-0-1 (Martinez absent) L. COUNCIL COMMENTS Council Member Reid announced a benefit with the Brandy Stills Band on June 28 at the Fire Hall to benefit John Earley. He stated Mr. Earley is one of the firefighters who was injured in a fire in River Creek. He stated he attended the Virginia Resources Authority meeting where he learned the Town can get 3% loans for municipal uses. He stated he also learned about leasing of LEED certified equipment. He regretted missing part of the worksession meeting on Monday night, but he was attending a Wilson Bridge meeting. He stated the SRTC has requested alert signs. He stated they have looked at procedures for appointing members to the SRTC. He thanked Council Member Schmidt for serving on Council. Council Member Wright disclosed a phone conversation with representatives from Waterford. He stated Relay for Life was very successful. He noted the team total was $6,954 and there is still some money to be deposited. He thanked all the team members who participated, including the Mayor. He stated Western Loudoun raised around $185,000. He thanked Betsy Creamer and Ron Petrella, who were the co-chairs. He asked that volunteers plan to come out and spend the entire day next year. He noted Grandmaster Choi did an exhibition. He noted the Form Based Code Steering Committee will meet tomorrow at 11 a.m. in the Lower Level Conference Room. He thanked Council Member Schmidt for providing his experience and guidance to the Council. Council Member Hammier disclosed a conversation with Waterford. She thanked JB Anderson for his Pledge of Allegiance. She noted the Cable Commission's PEG initiative will help the Town communicate with the citizens. She stated Loudoun County Public Schools will be holding a meeting regarding the new high school at Smarts Mill Middle School at 6 p.m. on June 18. She encouraged parents to attend. She stated Brian Rolston would not be able to continue to serve on the Standing Residential Traffic Committee. She stated Frank Holtz is interested in serving. She stated she is planning on attending the open house for the Community Health Clinic. She stated she is bringing some members of the Junior League who are interested in getting involved. She stated she will be attending the Transportation Meeting with the Governor. She stated she has learned a lot from serving with Council Member Schmidt and thanked him for his efforts in serving the community. Town Council Meeting of June 10, 2008 Page 4 Vice Mayor Horne disclosed a phone conversation on June 1 with Colleen Gillis Snow. She stated she had a meeting with Jeff Sachs of the Peterson Companies about Crosstrails. She thanked Council Member Schmidt for coming back to serve his community. She stated she admired his sense of moderation and even handed approach. She stated he is always professional and calm. She stated the proposed high school is an 1800 student high school. She congratulated the Police Department for the Poker Run. She stated they raised $15,000 for Special Olympics and noted that the Mayor is a Biker Babe. She congratulated John Wells on his son, Jonathan's, achievements as a graduating senior. She asked for Certificates of Appreciation for her appointees at the next Council meeting. Council Member Schmidt stated the tribute JB Anderson performed was wonderful. He stated the Lecture Series at Balch Library has been very successful. He stated Eugene Scheel is the next presenter and encouraged everyone to attend. He thanked his colleagues for their kind words. He stated this time on the Council reminded him about what a great place Leesburg is to live. He stated it has been a pleasure to be a part of it. He thanked the Vice Mayor for her service, stating that she has been a great leader for the community. M. MAYOR'S COMMENTS Mayor Umstattd disclosed she met with Sam Adamo on the High School Site. She stated Tom Dunn was at the meeting as well. She stated she is very impressed with the level of attention they are paying to the Town's environmental concerns. She extended her sympathies to Elizabeth Kellogg on the passing of her husband, John Browerholtz. She stated Mr. Browerholtz was the Memorial Day speaker last year. She stated she was lucky enough to get to ride on a motorcycle up to Gettysburg and back on the Poker Run. She stated it was amazing how much work goes into this event. She stated Officer Bill Wolff, his wife and children worked for months along with Officer Mark McCartney and his wife. She stated Anita's and Bob Evans provided breakfast and lunch at no cost to the riders. She noted there were police escorts throughout Virginia, Maryland and Pennsylvania. She thanked the Leesburg Citizen's Support Team for their assistance at all three stops managing the Poker Draws. She stated they raised over $15,000 for the Virginia Special Olympics. She thanked Council Member Schmidt for filling in when he was most needed. Council Member Wright added he met with Sam Adamo last week. N. MANAGER'S COMMENTS Mr. Wells drew the Council's attention to the fact that the minutes are caught up. He stated the minutes are on the website for the public to access. He stated he would proceed on implementing the Standing Residential Traffic Committee's recommendation to purchase the signs. He stated the Governor will be at Harper Park Middle School tomorrow from 7-8:30. He stated the Governor will hold a special local government "pre-meeting". He stated the $15,000 raised for Special Olympics is a tremendous effort. He stated the newly elected Council Members are welcome to attend the Virginia Municipal League training, which is open to sitting Council Members as well. He stated Council Member's Elect Butler and Dunn are available on June 30 to meet with the County. He thanked Council Member Schmidt stating he did not know there are experienced Council Members in the Bull Pen to be called upon. Town Council Meeting of June 10. 2008 Paqe 5 O. CLOSED SESSION On a motion by Mayor Umstattd, seconded by Vice Mayor Horne, the following was proposed: Pursuant to Section 2.2-3711(A)(3) of the Code of Virginia, I move that the Leesburg Town Council convene in a closed meeting to discuss litigation regarding the Water Rate Case. The motion was approved by the following vote: Aye: Hammier, Horne, Reid, Schmidt, Wright and Mayor Umstattd Nay: None Vote: 6-0-1 (Martinez absent) The open meeting reconvened at 9:09 p.m. and the following motion was made by Mayor Umstattd, seconded by Council Member Reid: In accordance with Section 2.2-3712 of the Code of Virginia, I move that Council certify to the best of each Member's knowledge, only public business matters lawfully exempted from open meeting requirements under the Virginia Freedom of Information Act and such public business matters as were identified in the motion by which the closed meeting was convened were heard, discussed or considered in meetings by Council.
