INITIATION: The regular meeting of. the City Council was called to order by Mayor Nunamaker at 7:30 P. M., and the Mayor then 2, led the Pledge of Allegiance to the Flag. 3. INVOCATION: Elder Harold Calkins of the Seventh Day Adventist Church, 9664 E. Broadway, Temple City, gave the invocation. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nuna- maker ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford and City Manager Woollett 5. APPROVAL OF MINUTES: Councilman Fitzjohn moved to approve the minutes of the regular meeting of April 8, 1963, as mailed, Councilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED BUSINESS: 6. ORDINANCE NO. 63 -105: Over -night Parking. Introduction. City Manager':!oollett presented Ordinance No. 63 -105 prohibiting over -night parking except by permit from the City. The Council studied each section and recommended several changes which the City Attorney incorporated into the Ordinance, following which City Attorney Shatford read in full Ordinance No. 63 -105 titled AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY MUNICIPAL CODE BY RESCINDING SECTION 3203 OF THE LOS ANGELES COUNTY TRAFFIC ORDINANCE NO. 654. ADOPTED AS THE TRAFFIC CODE OF THE CITY OF TEMPLE CITY AND ADDING SECTIONS 3324 THROUGH 3330 TO THE MUNICIPAL CODE OF THE CITY OF TEMPLE CITY PROHIBIT- ING ALL -NIGHT PARKING BETWEEN THE HOURS OF 3 :00 A. M. AND 5 :00 A. M. EXCEPT BY PERMIT FROM THE CITY OF TEMPLE CITY. No further action was taken as this was the first reading of this Ordinance Mrs. Dunn, 5708 Golden West Ave., stated she was very much in favor of this Ordinance as it would eliminate other people park- ing over night in front of her property which at the present time prevent the street sweeper from cleaning that part of the street. 7. PROPOSED AMENDMENT #1 TO JOINT POWERS AGKEEMtNT: Re-new Temple City Library. City Manager Woollett said Amendment #1 conforms with the pre- vious verbal agreements at the Council meeting and will be sign- ed by the Board of Supervisors as well as the City. Councilman Tyrell made a motion to authorize the City Manager and Mayor to sign on behalf of the City Amendment #1 of the Joint Powers Agreement which approve the additional allocation by the County of $25,000. to include a basement room in the construction of the new Library, Councilman Merritt seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 8, NEW BUSINESS: APPOINTMENT BY CITY COUNCIL OF REPRESENTATIVES g. ALTERNATES TO FOLL0!ING ORGANIZATIONS: Mayor Nunamaker requested Councilman Fitzjohn.represent the City at League of Calif. Cities meetings, with the City Manager as 444 VOW Council Minutes, April 22, 1963, page 2 alternate. The Mayor requested Councilman Tyrell to represent the City at the California Contract Cities meetings, with Councilman Merriti . as alternate. The Mayor is automatically a director of the County Sanitation District, and he requested Councilman Dickason be alternate Director. Mayor Nunamaker requested Councilman Merritt to be Council re- presentative on the Finance Committee. A11 Councilmen agreed to serve as requested, and the Council approved the recommendations of the Mayor as follows: Council- man Tyrell moved to approve the appointments as recommended, Councilman Merritt seconded, and carried. 9. ISSUANCE OF PERMITS FOR FIREWORKS STANDS: Mayor Nunamaker brought up for discussion of the Council the question of whether or not the number of fireworks stands should be limited. Following discussion by the Council it was agreed, and Councilman Merritt made the motion to leave as is and previously handled, Councilman Dickason seconded, roll call to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 10. PUBLIC HEARING 8 :00 P. M. ASSESSMENT HEARING OLIVE ST. ET AL City Manager Woollett stated the Council had received a report broken down by area and footage which would be assessed $2.20 per foot. Mayor Nunamaker opened the Public Hearing, and asked if anyone wished to speak against this assessment, and no one came forward, He then requested anyone wishing to speak in favor of the assessment to come forward, and no one came for- ward. Councilman Tyrell moved to close the Public Hearing, Councilman Dickason seconded, and carried. Councilman Tyrell moved to find the assessments correct and adopt Resolution No. 63 -280 imposing such assessments, Councilman Dickason seconded, roll call vote to-carry as follows: AYES: Councilmen- Dickason, Fitzjohn,,Merritt, Tyrell, Nunamaker NOES: Counc i lmenwNone ABSENT: Councilmen -None 11. PUBLIC HEARING 8:15 P. M. Curb & Gutter east and west side of Doreen from Freer to Key West. City Manager Woollett advised this comprised 1150 lin. ft. for both sides of the street, with 926 lin. ft signed up requesting the curb, or 80.5 %. Mayor Nunamaker declared the Public Hearing opened, and request- ed to hear those in favor of the project. Mr. Carl B. Bertram, 5004 N. Doreen, requested that the curbing be continued on around the corner of his lot so both sides would have curb. The City Manager advised this could be done on this project. Mayor Nunamaker asked if anyone wished to speak against this installation, and no one came forward. Councilman Tyrell moved to close the Public Hearing, Councilman Merritt seconded, and carried. Councilman Tyrell moved to find the project to be in the public interest and to instruct the Supt. of Streets to cause the work to be done, Councilman Fitzjohn seconded, carried by the following roll call vote: ` AYES: Councilmen- - Dickason, Fitzjohn, Merritt, Tyreli, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 12. AWARDING OF BID ON MAINTENANCE BUILDING: LIVE OAK PARK City Manager :(!oollett advised the low bid for construction of this building was $3,258.85 submitted by W. H. & M. G.Johnson, Co- Owners, contractors located at 9064 E. Broadway Temple City, and requested the City Council to award this contract to them In stated amount and instruct the City Attorney to draw the contract and authorize the Mayor and City Clerk to sign. EXTENSION OF TIME TO NEW LIBRARY CONTRACTOR: City Manager Woollett read a letter from Shepard & Morgan, Con- tractors, who are building the New Library requesting a one day extension of time as work was stopped on March 28, 1963, because of rain. Councilman Dickason moved to approve, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 14. PARKS & RECREATION COMMISSION RECOMMENDATIONS: 1. recommend a fee of $5.00 per hour for use of Live Oak Park auditorium by Pat Hibbard snd her baton group if Park is open and available, otherwise a fee of $8.00 per hour to cover open - ing and closing costs. Councilman Tyrell moved to approve, Coun- cilman Fitzjohn seconded, carried by following roll call vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 2. recommend American Field Service be permitted to use audi- torium at Live Oak Park for a Fashion Tea to raise funds to send a foreign exchange student abroad without charge by the City. Councilman Tyrell moved to approve, Councilman Dickason seconded, carried -by the following roll call vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 15. RESOLUTION NO. 63 -279: Warrants & Demands. Following study Coun- cilman Merritt moved to adopt Resolution No. 63 -279, warrants and demands in the sum of $59,216.92 Nos. 2511 through No. 2548, Councilman Fitzjohn seconded, carried by the following roll call vote: AYES: Counciimen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Coun ilmen -None 16. COMMITTEE FOR CORNER -STONE CEREMONY: re -New Library The City Manager advised that pursuant to the instructions of the Council he was proposing the following individuals to serve on the Committee for the Ceremony concerning the new library some time in September, this year Bert Anspach, President, Chamber of Commerce Bertha Rains, President, Library Advisory Council Jack Rand, Superintendent of Schools Dennis Savage, Representative Ministerial Assn. Mark Schrock, Past Master of 612 & 805 Masonic Lodges in this City William `:Wool Lett, Jr., City Manager Councilman Dickason moved to approve, Councilman Fitzjohn se- conded, and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 446 Council Minutes, April 22, 1963, page 4 17. SET PUBLIC HEARING FOR CURB & GUTTER: north side of Longden, from Encinita to Livia City Manager Woollett requested a public hearing be set for the above project for May 13, 1963, at 8:15 P. M. Councilman Tyrell so moved, Councilman Dickason seconded, and carried. 18. COMMUNICATIONS: a. L. A. County Boundary Commission, proposed annexation #38 City of So El Monte. Councilman Fitzjohn moved to receive and file, Councilman Merritt seconded, and carried. b. The Mayor read a letter from the Jr. Womens Club of Temple City requesting May 9 be proclaimed as HEAR FOUNDATION MONTH, anc also a charitable solicitation permit for that month. Council- man Fitzjohn moved to grant, Councilman Merritt seconded, and carried. c. City Manager Woollett presented a charitable solicitation permit request for May 24 and 25 to conduct a poppy sale from the American Legion Auxiliary. Councilman Tyrell moved to ap- prove , Councilman Fitzjohn seconded, and carried. d. Councilman Tyrell read a letter from tpe San Gabriel Valley Bar Assn. requesting May 1 be proclaimed as LAW DAY. Councilman Dickason moved to approve, Councilman Fitzjohn seconded, and carried. e. Mayor Nunamaker read a request from the Loyal Order of Moose requesting June be proclaimed as Moose Month. Councilman Tyrell moved to so proclaim, Councilman Merritt seconded, and carried. f. Mayor Nunamaker presented a request from the L. A. County Fire Dept, requesting May 4 be proclaimed as Fire Services Day. Councilman Nunamaker moved to approve, Councilman Merritt se- conded, and carried. 19. TIME FOR THOSE iN THE AUDIENCE WHO WiSH TO SPEAK: Mr. Don !etzel, 9614 Olive St., asked how the curbs would be billed to them. The City Manager advised they would be sent a bill and given 10 days to pay and if not paid within that time the amount will be assessed against the property. Irvin Shapera, 10534 Freer, a corner lot advised he wants the curb to coo around the corner on Freer to install curb on both sides of his lot when they put in curb on Doreen. The Manager advised this can be done. Marvin Oakes, 9314 Blackley St., stated curb and gutter had been installed on his property but they did not center the curb and gutter with his driveway and it was off about 2 ft. The City Manager advised we would send a man to check this out with him. W. R. Williams, 1016 Key West, advised he awned the second lot east of Doreen, and from his property east the block already had curb and gutter, and he was desirous of haveing it insta-iled on his property. The City Manager advised we will have a pe- tition prepared and sent to him to sign and return. Mr. Gebrow, 10617 Key West, advised curbs were going in east of Doreen on Key West, and he was interested in curbs and would like to have it all done in one operation. The City Manager advised when they can be put together and made one project that we prefer to do it. Mr. C. Bertram, 5004 N. Doreen, asked about specifications for driveway entrances as his lot has been split and the existing driveway will be moved a little bit. The City Manager advised a field check will take this in and they will check with him. Mrs. Mary Corset, 5221 Doreen, advised she lived in front of 447 Council Minutes, April 22, 1963, page 5 of the lot at this location and wanted to know if the property owners of the lots in the rear shared the expense of the curb and gutter and was advised by the City Manager this depended on what ever she could work out with these property owners, but she was directly responsible as the installation was on the fron lot. Ernest McGrudie, 9230 Olive, asked regarding the assessment on Olive and was advised he had ten days to pay from the time he received the bill. Mrs. Mabel Hein; 9128 Hermosa, requested the "No Parking" sign be moved from directly in front of her house to at least the property line in either direction. Following discussion the City Attorney advised it can be extended or changed to more or less footage from the center of the street. Councilmen Tyrell and Merritt felt there should be some leeway and that the sign could be moved from the center of her property. The City Mana- ger advised the staff would check and see whether or not this can be done. 20. MATTERS FROM CITY OFFICIALS: Councilman Tyrell stated some time ago there was discussion re- garding a higher rate of return on funds in the bank by using Bank of America, and that there was a higher rate of interest offered. The City Manager advised at present we receive 3% for six months, and the Bank of America offer 32 %, and this is going to the finance committee and will be recommended for next year. Councilman Dickason recommended the elimination of the left hand turn on Park St. where it is no 'longer needed. This will be referred to the Traffic Commission. Councilman Fitzjohn asked if there was any further report on the Stay Order of the Jolly Coachman. City Attorney Shatford advis- ed he will file tomorrow Points of Authority with the Court and request Atty. Howser to set the matter for Hearing pursuant to the Stipulation, and we will hear possibly next week. Mayor Nunamaker presented Resolution No. 63 -281 proclaiming Public Schools Week for consideration by the Council. Council- man Tyrell moved to so proclaim, Councilman Dickason seconded, and carried. Mayor Nunamaker read a communication from the Mayor of Monrovia concerning the Metropolitan Water District which had advised if annexation to the district was not made before April 1 the costs would be several million dollars higher. Now the District wants to waive this and let some other cities come in. The City of Monrovia objects to this as good faith would be broken and object to the extension of this deadline. Following dis- cussion Councilman Fitzjohn moved to have the City indicate this City's support to the City of Monrovia on the stand they have taken on this issue, Councilman Tyrell seconded, and carried. Mayor Nunamaker presented a resolution passed by San Gabriel urging observance of National Flag week July 1 - 7. Councilman Merritt so moved, Councilman Tyrell seconded, and carried. Mayor Nunamaker read a letter from Sheriff Pitchess regarding the training program required by the Dept. which had received highest awards, and that by passing an ordinance the City would reca+ve a Commission award for adherence to the established min- imum standards. Councilman Tyrell moved to adopt such an ordi- nance, Councilman Fitzjohn seconded, and carried. The City Attorney will prepare the ordinance for the next meeting. Mayor Nunamaker advised the City had been requested to co -host 448 Counc� M i inutes, April 22, 1963, page 6 the May meeting of Calif. Contract Cities with other smaller cities for a cost to us of $100. Councilman Tyrell moved to approve, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None The Mayor read a request for a proclamation for July 4, and for all bells in the city, churches etc., to ring for 4minutes as a patriotic recognition. Councilman Tyrell so moved, Councilman Dickason seconded, and carried. City Manager'Woollett reported on Tract 27787 and requested the Planning Advisor to make the presentation. Ray Cushman, Plannin Advisor stated the Planning Commission and Council had approved the tentative tract map, and this final map has been checked out by the County Engineer for final recordation upon approval by the City Council, Councilman Tyrell moved to approve the final map, accept the streets and easements as offered for dedi- cation on said map, approve and accept the agreement to install sanitary sewers as required by the subject tract and a surety bond in amount of $8,000.00, an agreement guaranteeing setting of survey monuments, tie points and furnishing tie notes, and a suirety bond in the amount of $490.00, also an agreement to provide a water system, and also finds that American Capital corporation, subdivider of the subject tract, has in good faith attempted to secure an outright offer-of dedication from the Sunnyslope Water Co. - has been unable to do so and a refusal to accept the map for recording would work an undue hardship on the subdivider, Councilman Merritt seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None City Manager recommended the Council acknowledge receipt of a petition with required number of petitioners which is the next step in the phase of Annexation No. 6 -A, Muscatel to Burton. The signatures will be checked with the Registrar of Voters and report back at the next Council meetin .Councilman Merritt moves to receive as recommended, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None The City Manager read a request from Temple City Family Guidance Service requesting the month of May be proclaimed Family Guid- ance month. Councilman Fitzjohn so moved, Councilman Merritt seconded and carried. Mayor Nunamaker reported about Parking District #1 that they have more than the half mark needed, and in talking to two or three others felt they are interested, and that within another week they will be ready to present this to the next Council meeting. 21.
