HomeMy Public PortalAbout2007-13 - AMENDMENT - SEPTAGE RATESFINAL READING ORDINANCE 2007 -13 L L— 0 7 AN ORDINANCE AMENDING CHAPTER 9 OF THE CITY OF GREENCASTLE CODE REGARDING SEPTAGE RATES WHEREAS, the City has had numerous requests to accept septage from numerous individuals, both within and outside of the City; and WHEREAS, the City Wastewater treatment plant has the capacity to treat septage, and accepting such septage represents an income generation opportunity for the City. NOW THEREFORE be it ordained by the Common Council of the City of Greencastle that it hereby amends certain sections of Chapter 9 of the Greencastle City Code by adding the following language: Section 9 -25. Monthly Rates and Charges Subsection d. shall be re- labeled "e" Subsection e shall be re- labeled' f' A new subsection d. shall be added and shall read: The charge for acceptance and treatment of septage shall be S.07 per gallon. ® 2. Section 9 -45 Definitions. The following definition shall be added to the Definitions section, in alphabetical order: aa.. Septage. The by- product material of decomposed wastewater organics from septic tanks or sewage disposal systems. Septic tanks are used where wastewater collection systems and treatment plants are not available. All other Definitions in Section 9 -45 occurring alphabetically after "Septage" shall be re- lettered to adjust for the addition of the definition of Septage, above. 2. Sec. 9 -47 shall be amended as follows: Sec. 9 -47 Private Sewage Disposal and Septage. a. The disposal of sewage by means other than the use of the available sanitary sewage system shall be in accordance with local, county and state law. The disposal of sewage by private disposal systems shall be permissible only in those instances where service from the available sanitary sewage system is not available. b. The City may, at its discretion, accept septage from sources not connected to the City's wastewater system. Any person wishing to have the City accept septage must ® comply with any policies, prodedures or application requirements established by the Board of Public Works and Safety or the Wastewater Superintendent and must pay all fees described in Section 9 -25, herein. All septage is subject to testing and the City reserves the right to deny any request to accept septage. Any person who fails to comply with this Ordinance, or the policies, procedures or application requirements of the Board of Public Works and Safety or the Wastewater Superintendent shall be subject to a fine in an amount not to exceed $5000, in addition to any other damages under the law, and reasonable expenses including court costs and attorney fees. All other terms and conditions contained with Chapter 9 of the Greencastle City Code which are not inconsistent herewith shall remain in full force and effect. This Ordinance shall have full force and effect upon passage of the Greencastle Common Council and its approval by the Mayor.
