AN ORDINANCE AUTIIORIZING CONVEYANCE OF
REAL ESTATE BY THE GREENCAS'iTLE COMMUNITY
SCHOOL CORPORATION TO TILE CITY OF GREENCASTLE
tract WHEREAS the Greencastle Community School Corporation is the owner of a.44 acre
of land adjacent to the City Park; and,
WHEREAS, the City Parks Department has need of such land to more effectively serve
the community.
NOW THEREFORE be it ordained by the Common Council of the City of
Greencastle that the Greencastle Community School Corporation be authorized to convey by
deed the following described tract in Putnam County Indiana to the City of Greencastle,
subject to the terms and conditions as set forth herein:
A part of Lot #75 of the Eastern Enlargement to the 'Town, now City,
of Greencastle, Indiana, more particularly described to -wit:
Beginning at an iron pipe marking the Southeast corner of Lot #75 of the
Eastern Enlargement to the Town, now City, of Greencastle, Indiana; thence
South 88 degrees 47 minutes West 200.00 feet with the South line of said Lot
N75 to a chisel mark; thence North 00 degrees 08 minutes West 96.32 feet with
the West line of a 0.67 acre tract as described in Deed Record 178, page 196 in
the office of the Recorder in Putnam County, Indiana to a 5/8 inch rebar which
is South 00 degrees 08 minutes East 50.00 feet from an iron pipe marking the
Northwest corner of said 0.67 acre tract; thence North 88 degrees 38 minutes
East 200.22 feet to a 5/8 inch rebar on the East line of said Lot 1175, which is
50.00 feet South from a 5/8 inch rebar marking the Northeast corner of said
0.67 acre tract; thence South 96.83 feet with the East line of said Lot N75 to the
point of beginning, containing 0.44 of an acre, more or less.
Subject to all rights -of -way and pertinent easements of record.
Provided that the real estate conveyed by Quitclaim Deed shall be
maintained in perpetuity by the Grantee for use as a public park; that no
building or other structure shall be erected on the conveyed real estate; and that
a landscaped barrier, consisting of mounded earth and planted shrubs, shall at
all times be maintained along the northern boundary line of the conveyed real
estate.
And provided further, that the real estate so conveyed is to be used for
the purposes above stated and to revert to the Board of School Trustees of the
