AN ORDIMNCE AUTHORIZING A SPECIAL USE IN AN M-2 GENERAL TMISTRI& DISTRICT
FOR A TREE CUTTING SERVICE ON PROPERTY LOCATED AT 2320 FLA= ROAD, PUR,SIIANI'
TO ARTICLE 48 OF CHAPTER 22 OF THE Pl[7 aCIPAL CODE OC"NLY KNOW AS THE ZON—
ING ORDINANCE OF THE CITY OF RICIMND, IM)TANA.
WMEAS, Article 35 of Chapter 22 of the Mmricipal Code allcmm retail and
service businesses to be established in nn industrial area when
clearly demonstrated as necessary to serve the needs of the in-
dustrial area by Special Use authorization as provided in Article
48 of said Chapter; and,
UUMW , a notice was given and a public hearing on this Ordinance was con-
ducted by the Richmond City Planning Commission the � day of
1979, at which time remonstrances were

and,

in favor of/' reccr=ding the passage of Ordinance
No. 15-1979, therefore,
BE IT 0RT14 NED by the Common Council of the City of Richmond, Indiana, as
follows:
SECTION 1. As provided in Article 35 and 48 of Chapter 22 of the Municipal
Code, the following described. -use of the following described real
estate is allowed as a Special Use for a tree cutting service at
2325 Flatley Road, in the City of Richm nd, Indiana; more particularly
described; to brit:
Being lot number 1 in Burdette's Addition Plat Book 9,
page 1, northeast quarter of Section 25, Township 14
North, Range 2 West.
SECTION 2. As a condition of the aforesaid Special Use and as an additional
restriction on said use, the following requirements shall hereafter
and at all times be net by the owner, leasee or any person, firm or
corporation using said real estate.
The site plan accompany the petition be identified as
Exhibit A and made a part of Ordinance No. 15-1979.
b. The Special Use authorization shill be considered
null and void should the Special Use cease for a
period of one (1) year or more.
SECTION 3. The 7rmdng Administrator of the City of Ri.chmand, Indiana, is hereby
'authorized and directed, upon enactumt and publication of this Ordi-
nance, to record and approve the issuance of a permit for the establishment
of the use herein allowed.
SECTION 4, This Ordinance shall be in full force and effect from and after its
passage and approval by the Mayor, and publication as by law required.

Dear Mr. Paust, Members of Conn Council & Mrs, Trimble:
The Ricimmnd City Plan G=ission conducted a public heap ig on
Tuesday, February 27, 1979, on Ordinance No. 15-1979.
The petitioner, Lingle Trading Company, was represented by Katie
Ruckaba, Agent, wbo.requested Special Use authorization for a
proposed tree cutting service to be'located in an M-2 General
Industrial District at 2320 Flatlev Road. No one spoke in oppo-
sition to the petition. Twenty-four (24) letters had been sent
to adjoining 'properties; none were returned in favor and me (1)
in opposition.
The Plan C mission voted eight (8) to two (2) to allow this
Special Use with the following conditions:
(a) The site plan accompanying the petitionbe
identified as ENhi.bit "A" and made a part
of Ordinance No. 15-1979.
(b) .The Special Use authorization -shall be con-
sidered null and void should the Special Use
cease for a period of one (1) year or more.
