HomeMy Public PortalAboutResolution 61-117RESOLUTION NO. 61 -117 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, TO THE BOARD OF DIRECTORS OF THE LOS ANGELES COUNTY DI- VISION OF THE LEAGUE OF CALIFORNIA CITIES RECOMMENDING ADOPTION OF A NEW FORMULA FOR APPORTIONING GAS TAX TO CITIES WITHIN LOS ANGELES COUNTY WHEREAS, The Gas Tax Committee of Los Angeles County Division of the League of California Cities has made a detailed study and report of a proposed new method of apportioning gaso- line tax funds to Los Angeles County and to the cities within Los Angeles County, and WHEREAS, said study indicates the incorporated area within Los Angeles County contains 81% of the population and 74% of the street mileage but receives only 43% of the aggregate gas tax funds subvented to Los Angeles County and cities within said County, and WHEREAS, said report proposed to pool all gas tax monies received by said County and all cities within said County into a common fund, said fund then to be divided between Los Angeles County as one unit and all cities within said County as another unit solely on the basis of total existing street and road mileage in unincorporated County areas and total street mileage within cities, and WHEREAS, said Committee proposes that the monies in said fund to be apportioned to the cities within Los Angeles County be apportioned in accordance with one of the following three formulas: A. Formula I - based on 85% population and 15% street mileage; B. Formula II based on street mileage only; C. Formula III - based on 50% population and 50% street mileage; and WHEREAS, under Formula I, 26 cities would benefit most; under Formula II, 28 cities would benefit most; and under For- mula III, all cities would benefit less than under Formula I but more than under Formula II, and WHEREAS, under Formula I, the 26 benefitting cities represent 79.6% of the population and 74.1% of the street mileage, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That in the event over 50% of the legisla- tive bodies of the cities within Los Angeles County are in agreement with the recommendations of the said Gas Tax Committee with respect to the division of gas tax funds between Los Ange- les County and the cities within said County, the City Council of the City of Temple City recommends and urges the Board of -1- 137 Directors of the Los Angeles County Division of the League of California Cities to open negotiations with the Board of Super- visors of Los Angeles County to change its policy and method of apportioning gasoline tax funds to Los Angeles County and to the cities within Los Angeles County to conform with the propo- sal of said Gas Tax Committee: TO WIT: That all of the gasoline tax monies received by the Cpunty and all of the gasoline tax monies re- ceived by the cities within Los Angeles County be lumped into a common fund and that such fund be divided between the County as one unit and all of the cities within the County as another unit solely on the basis of total existing street and road mileage. SECTION 2. That the City Council of the City of Temple City believes that Formula I is the most equitable of the three formulas proposed by said Gas Tax Committee and recommend and urges that the legislative bodies of all cities within Los Ange- les County and the Board of Directors of the Los Angeles County Division of the League of California Cities adopt said Formula I. SECTION 3. That a copy of this resolution be forwarded to each member of the Board of Supervisors of Los Angeles County and to the City Council of each city within Los Angeles County. SECTION 4. That this resolution shall take effect imme- diately. SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution; shall cause the origi- nal of the same to be entered in the Book of original Resolu- tions of the said City of Temple City, and shall make a minute of the passage and adoption thereof in the records of the pro- ceedings of the City Council, in the minutes of the meeting at which the same is passed and adopted. 1961.
