AN ORDINANCE APPROVING THE PETITION OF MAIM (;J0 1 kt,�aaat
JOSEPH D. WALLACE AND BETTY J. WALLACE, HUSBAND AND WIFE,
TO VACATE PUBLIC RIGHT -OF -WAY LOCATED IN TIIE
CITY OF GREENCASTLE, PUTNAM COUNTY, INDIANA
WHEREAS, the Plan Commission of the City of Greencastle, Indiana, did at its regular
meeting held on September 23, 1991, approve the PctitiOtl of Joseph D, Wallace and Betty J.
Wallace, Husband and Wife, for the vacation of a certain public right -of -ways located in the City
of Greencastle; and
WHEREAS, the Common Council of the City of Greencastle, Indiana, pursuant to law,
Published notice that this matter would come before the Common Council for public hearing at
the regular meeting of the Common Council to be held on Tuesday, October 8, 1991 at 7:30
o'clock, p.m. at Jones School, 209 West Liberty, Greencastle, Indiana; and
WHEREAS, the adjoining property owners have consented or have been notified pursuant
to statute as to the vacation of the right -of -ways; and
WHEREAS, the Common Council of the City of Greencastle at a council meeting did
table Ordinance 1991 -22 without further passage, which Ordinance should now be brought to
AM, the floor for consideration; and
WHEREAS, the Common Council of the City of Greencastle, Indiana, has determined
the relief prayed for in said Petition should be granted and those portions of the public right -of-
way located in the City of Greencastle, Indiana, should be vacated.
NOW, TIIEREFORE, be it ORDAINED by the Common Council of the City of
Greencastle, Indiana, that the following public right -of -ways located in the City of Greencastle,
Putnam County, Indiana, and more particularly described as follows:
A. Iowa Street (Wiffun Street) from Elizabeth Street to Carp Street (Earp Street).
B. Iowa Street (Wiffim Street) from Carp Street (Earp Street) to North end.
C. Jones Street from North Jackson Street to end.
are hereby vacated as a public right -of -ways of the City of Greencastle, Putnam County, Indiana.
The City of Greencastle retains a perpetual casement in the vacated right -of -ways together
with the right to erect, lay, construct, inspect, repair, remove, or replace water lines, sanitary
sewers, storm sewers and other municipal utilities in said vacated right -of -ways with modern
equipment. No permanent structure may be constructed upon said easements.
