Butler, Thomas S. Dunn, II, Katie Sheldon Hammier, Marty Martinez, Ken Reid, Kevin Wright and Mayor Kristen Umstattd. Council Members Absent: None. Staff Present: Town Manager John Wells, Deputy Town Manager Kaj Dentler, Town Attorney Jeanette Irby, Director of Public Works Tom Mason, Assistant Director of Capital Projects Tom Brandon, Assistant Director of Capital Projects Renee LaFollette, Preservation Planner Annie McDonald, and Clerk of Council Lee Ann Green AGENDA 1. Call to Order ITEMS 2. Salute to the Flag was led by Council Member Martinez 3. Invocation was lead by Council Member Butler 4. Roll Call showing all present. S. Minutes a. Work Session Minutes of January 26, 2009 On a motion by Council Member Butler, seconded by Council Member Wright, the minutes were passed 6-0-1 (Hammier abstaining). b. Regular Session Minutes of January 27, 2009 On a motion by Council Member Butler, seconded by Council Member Reid, the minutes were passed 6-0-1 (Hammier abstaining). 6. Adopting the Meeting Agenda (Amendments and Deletions) On a motion by Council Member Wright, seconded by Council Member Butler, the meeting agenda was adopted after moving items 12 a, 12 b, 14 a, and 14 b to the Consent Agenda. The motion was passed by the following vote: Aye: Butler, Dunn, Hammier, Martinez, Reid, Wright and Mayor Umstattd Nay: None Vote: 7-0 7. Presentations a. Proclamation - Black History Month On a motion by Vice Mayor Hammier, seconded by Council Member Reid, February was proclaimed Black History Month in the Town of Leesburg by a vote of 7-0. b. Loudoun Convention and Visitors Center Update - Cheryl Kilday gave Council a brief presentation on the state of travel and tourism in the Town of Leesburg and Loudoun County. Fall into the Arts Presentation - "Loudoun Still Life" by Kathi Fertig Jim Sisley of Fall into the Arts presented Council with a painting by artist, Kathi Fertig. 8. PETITIONERS The Petitioners section was opened at 8:20 p.m. Robert Jackson - 313 Ayrlee Avenue, N.W., stated he has participated in the Leesburg Flower and Garden show several times in the past, both as an exhibitor and a judge. He stated this year he has been placed on a waiting list for exhibition space. He questioned whether any consideration was given for businesses located within the Town. Mayor Umstattd and Council Member Reid asked for a clarification on how exhibitors for this popular event are chosen at the next Council meeting. Pete Garvey, 428 S. King Street, stated he wanted to discuss the option for a park on Loudoun Street. He stated as a father of two, there is currently no park for the children of the Georgetown neighborhood. He stated there are not enough parks in the Old and Historic District. He stated he supports a park on Loudoun Street and asked the Town to take that into consideration. The Petitioners section was closed at 8:28 p.m. 9. ADOPTION OF THE CONSENT AGENDA On a motion by Council Member Martinez, seconded by Council Member Dunn, the following consent items were proposed: a. Approving Change Order #2 for Battlefield Parkway - Edwards Ferry to Ft. Evans and Authorizing the Town Manager to Execute It RESOLUTION 2009-017 Approving Change Order #2 for Battlefield Parkway - Edwards Ferry to Ft. Evans and Authorizing the Town Manager to Execute It b. Monument Siqns for Prosperity Center RESOLUTION 2009-018 Approving Monument Signs for Prosperity Center, Located at 701-707 East Market Street c. Town Plan Amendments to Reclassify Land Immediately Adiacent to Old Izaak Walton Park RESOLUTION 2009-019 Directing Staff to Establish a Neighborhood Community Meeting in order to Present Information Related to the Town Plan as well as Town Plan Amendment TLTA 2008-0004, as it Relates to Parcel 232-28-3893 and a Portion of Parcel 232-38-9290 (Also Referred to as "Waterside") Town Council Meeting of February 10. 2009 Page 3 d. COUNCIL COMMENTS Council Member Dunn congratulated everyone who completed the CPEAV Certified Planning Commissioner's course which was held at Ida Lee. He requested having some of the budget review at work session meetings, if possible. Vice Mayor Hammier stated she had a number of disclosures related to George Mason University. She stated she met with Peter Kalaris about Meadowbrook and had a number of conversations with Waterford. She stated she agreed with Council Member Reid as it relates to the Flower and Garden Show. She stated she would like clarification of the rules regarding basketball hoops. She congratulated Bill Ference on his drawings for the Loudoun Street options. She stated she was disappointed there is still partisanship going on at the state level with regards to federal stimulus funding. Council Member Martinez clarified he is not a Pittsburgh fan. He did congratulate Pittsburgh on their win in the Super Bowl. He stated he met with Peter Kalaris regarding Meadowbrook as well as Juan and Ann Jansen. He asked for a progress report on the KSI development. He also asked for a progress report on the Battlefield Parkway connector. He noted Central Loudoun Little League is gearing up for practices and tryouts. Council Member Wright disclosed a meeting with Rick Starke regarding Waterford and Peter Kalaris regarding Meadowbrook. He stated a group of Council Members and staff went to Richmond for VML Day. He stated there is no consensus on how the stimulus money will be distributed. He stated the HCA debate is over and he looks forward to a progress report from INOVA. He stated Relay for Life is approaching. He stated everyone can join the Government Steps at Town Council Meeting of February 10. 2009 Page 4 Westernloudounrelay.org. He stated Brett Burk was appointed as chair of the Planning Commission, Mary Harper as vice-chair and Ted Kalriess as parliamentarian. He noted the Planning Commission retreat has been moved to Thursday. He stated there used to be a priority given to Leesburg and Loudoun businesses at the Flower and Garden Show. He stated he is looking forward for a report about this. Council Member Butler disclosed meeting with Peter Kalaris about Meadowbrook. He stated he enjoyed VML Day and the ride down with Council Member Reid. He stated his number one impression is the legislators are working hard and are all passionate about working hard for Leesburg and Loudoun County, but no one promised any money. He noted Sycolin Road paving is still on the VDOT schedule for next fall. He congratulated Brett Burk for being elected chairman of the Planning Commission. He stated he has volunteered to get a pie in his face for Relay for Life. Council Member Reid stated while the Town may not get any new money from VDOT, some legislation is getting through at the State level on expedited plan review. He noted Delegate May has been helping with the question of a diamond interchange in discussions with VDOT. He asked for more timely snow removal on cul-de-sacs. He stated we need to discuss a walk/bike/Segway patrol downtown. He stated the downtown lends itself to this type of patrol since public safety is a priority. He asked for a memo from the Town Manager regarding travel. He asked for a discussion on utility availability fees for businesses. He stated the centennial of the NAACP is this month. He stated it is amazing how far the country has come given the election of an African-American as president and other prominent positions. He stated he is concerned about the incident where KKK fliers were distributed in a Leesburg neighborhood. 17. MAYOR'S COMMENTS Mayor Umstattd disclosed a meeting with Peter Kalaris on the Meadowbrook project. She stated Mr. Kalaris is considering seeking a Council initiated text amendment to the Zoning Ordinance that would permit a significant increase in residential density. She stated her concern is the process of text amendment would not have as much public notice as a rezoning. She stated it is important to include the citizens. She stated the proposal would not quite double the residential density to about 1.6-1. 75 units per acre. She stated any text amendment would affect other properties zoned R-1. She thanked Senator Jim Webb for replying to the Council. She stated this type of response is rare. She stated he promised to take the request for stimulus funds seriously. She stated Congressman Wolf's office has alerted them to a website to be the central portal and repository for citizen's groups to apply for federal stimulus funding. She stated NVTA is continuing to request funding on behalf of Leesburg and other Northern Virginia localities. She stated everyone is disturbed by the fact the KKK would come into Leesburg. She stated she was proud of the fact that those who received fliers were not afraid. She stated the white community has been very protective of the African-American community. She stated the KKK is unable to engender the fear they want in our community. 18. MANAGER'S COMMENTS Mr. Wells had no comments. 19.
