Mayor Walter W. Parker called the Special Meeting to order at 7 P.M. The
following members of Council were present: James G. Burke, Jr., Jack Youmans, Shirley
Sessions, Pamela O'Brien and Mallory Pearce. Acting City Attorney Dana Braun was
present to guide the Council on legal issues. Mayor Parker announced to the audience of
two that the meeting tonight is to have a public hearing on the millage for the year 2000.
Mayor Parker introduced the new City Manager Tom Cannon.
Mayor Parker opened the meeting for business legally presented.
Mayor Parker opened the public hearing on the 2000 millage rate. Braun informed
Council that the new taxpayers' bill of rights says that any increase in the tax digest
means that there must be a decrease in the millage rate. Cannon said that the Chatham
County Board of Appraisers provided the millage rate of 4.766 to Tybee Island. Cannon
said that this should bring in the same amount of money as the old assessment, because of
all of the new assessments. Cannon stated that if you want to set the millage at a higher
rate then the City would have to hold three public hearings. Pearce said we can always
legally reduce but not raise it after it is set. Braun said you would have some difficulty.
Parker said that if we wanted 4.8 then 3 public hearings would be needed. Youmans said
the reduction is only on the appraisals not on new construction the tax digest. Youmans
said that the police and parking departments are going to receive much more revenue than
proposed in this budget. Burke said that the City would still get about $50,000 more in
revenue from taxes. O'Brien stated that Chatham appraises our property, many are being
appealed, less property tax income, and we had 6 mils why not go to 5 mils. Pearce said
he agrees with O'Brien. Cannon said that in the 2000 budget itself on the expense side
there is over 1 million dollars hear marked for parks and buildings which he understands
is for a gym pool complex. Cannon said there is no way with only 6 months left in this
year that we would spend that money. Cannon said that a budget is a best guest because
you are trying to anticipate that is going to happen during the year. Youmans said that
when the budget was passed the money for the gym was not expected to come from
taxes. Parker said that Cannon wants to review the 2000 budget. Burke said that he
talked with Gary Udinsky, Tax Appraiser, and he understands the process now and that
the City will get about $59,000 more in taxes this year. Sessions asked that we approach
Chatham County and ask them to give of a list of the services that they provide for Tybee
Island. Parker said that he know that we get $60,000 for the water sewer department but
we can also ask for money for the lifeguards and the cleaning of the beach. Youmans
said that Chatham County also provides the courts, the jail, and they clean ditches and
other things. Parker suggests that the Council go along with what Chatham recommends
for millage. Pearce asked Cannon his thoughts on the millage. Cannon answered to go
with 4.766, however when we prepare the budget for 2001 we will look for other funding
resources. Cannon said now that taxes provide 20% of the income and that parking
provides 17 %, the tourist only pay the parking fee. Youmans said the millage was 12 or
13 when he was elected to Council 13 years ago and that the Council has voted to drop
the millage rate 3,4 or 5 times and it has never decreased service delivery, if anything we
have better service now. Parker closed the public hearing. Pearce moved to adopt the
4.766 millage rate for the year 2000. Burke seconded. Vote by Council was unanimous.

Pearce moved to go into closed session to discuss real estate. Sessions seconded.
Vote by Council was unanimous. Youmans moved to reconvene the regular meeting and
moved to adjourn. Vote by Council was unanimous.

R E S O L U T I O N
the fiscal year of the City of Tybee Island begins on
January 1 and ends on December 31; and
Title 3 of the Code of Ordinances for the City of Tybee
Island, Georgia, and specifically Section 3 -2 -11
provides in part that the millage rate for annual ad
valorem tax upon all real and personal property within
the City shall be established each year by Resolution
of the Mayor and Council; and
WHEREAS, the Mayor and Council desire to set the millage rate
for the year beginning January 1, 2000 and ending
December 31, 2000 in compliance with the terms of the
laws of Georgia and the Ordinances of this City;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
City of Tybee Island, in open meeting assembled, that the millage
rate of the fiscal year January 1, 2000 through December 31, 2000
be set at t)-, 71,0 fd mils.

The Tybee Island City council do hereby announce that the proposed
hearing to be held at Tybee City Hall on Thursday July 27, 2000 at
48 -5 -32 do hereby publish the following presentation of the current
digest and levy for the past five years.

7:00 o'clock. Pursuant to the requirements of O.C.G.A.

PERSONALLY appeared before the undersigned attesting officer,

after being duly sworn, deposes and on oath states the following:
(1) I was the presiding officer of a meeting of the Tybee Island

(2) That it is my understanding that 0.C.G.A. S 50- 14 -4(b)
provides as follows:
When any meeting of an agency is closed to the public
pursuant to subsection (a) of this Code section, the
chairperson or other person presiding over such meeting
shall execute and file with the official minutes of the
meeting a notarized affidavit stating under oath that the
subject matter of the meeting or the closed portion
thereof was devoted to matters within the exceptions
provided by law and identifying the specific relevant
exception.
(3) The subject matter of the closed meeting or closed portion of
the meeting held on the cY of , 2000, which was

with the mandate of O.C.G.A. § 50- 14 -4(b) that such an
affidavit be executed.
