PROFESSIONAL SERVICES CONTRACT FOR
LEGAL SERVICES
WHEREAS, there exists a need for legal services in connection with State Court
Tax Appeals totalling $35,128,600.00; and
WHEREAS, legal services are a professional service and are exempt from the
requirements of competitive bidding pursuant to N.J.S.A. 40A: 11-5 (1) (a); and
WHEREAS, the Local Finance Officer has certified that funds are available.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the
Borough of Carteret does hereby approve the appointment of McGowan &
Coughlin, P.C., at a maximum cost not to exceed $15,000.00 billable as per attached
contract.
BE IT FURTHER RESOLVED that the Mayor and Borough Clerk are hereby
authorized to execute said contract.
IT IS FURTHER RESOLVED that the contract is awarded without competitive
bids in accordance with N.JS.A. 40All-5 (1) (a) due to the specialized and
professional nature of the services provided.
BE IT FURTHER RESOLVED that notice of thls action shall be published in The
Home News ~: Tribune on April 22, 1997.
