AUTHORIZING TAX ASSESSOR TO FILE COUNTERCLAIMS
ON BEHALF OF THE BOROUGH OF CARTERET
WHEREAS, certain taxpayers have filed State Tax Court local property assessment
appeals; and
WHEREAS, the Assessor o£the Borough of Carteret (the "Borough") believes there
is a reasonable basis for the filing of counterclaims on behalf of the Borough; and
WHEREAS, the statute authorizing such counterclaims specifically requires
administrative action by the municipality's's Governing Body to authorize the Tax
Assessor to file said counterclaims.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council that the Tax
Assessor, William H Marbach, is hereby authorized to file such counterclaims as
permitted by the Rules of the Court with the legal assistance of McGowan &
Coughlin, P.C., attorneys for the State Tax Court appeals of local property owners
per the attached memo identifying said property owners.
Adopted this 17th day of April, 1997
and certified as a true copy of the
original on April 18, 1997.
