INITIATION: The regular meeting of the City Council was called to order by Mayor Nunamaker at 7:30 P. M., and the Mayor then 2. led the Pledge of Allegiance to the Flag. 3. INVOCATION: Rev. Lyman Ellis of the First Methodist Church gave the invocation. 4. ROLL CALL: PRESENT: Councilmen - Fitzjohn, Merritt, Nunamaker ABSENT: Councilmen - Dickason, Tyrell ALSO PRESENT: City Manager Woollett 5. APPROVAL OF MINUTES: A. Adjourned meeting of April 15, 1963. B. Adjourned meeting of April 16, 1963, C. Regular meeting of April 22, 1963, City Manager 1.qoollett :corrected the minutes of April 22, item #20, to read "Hart St." and not "Park St." Councilman Fitzjohn moved to approve the minutes of the meetings of April 15 and April 16, and the minutes of April 22 as corrected, Councilman Merritt seconded, and carried by the following called vote: AYES: Councilmen- Fitzjohn, Merritt, Nunamaker NOES: Councilmen -None ABSENT: Councilmen - Dickason, Tyrell UNFINISHED BUSINESS: 6, ORDINANCE NO. 63 -105: 2nd read. Re -Over Night Parking. The City Manager read title to Ordinance Mo. 63 -105 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY MUNICIPAL CODE BY RESCINDING SECTION 3203 OF THE LOS A,'GELES COUNTY TRAFFIC ORDI- NANCE NO. 6544 ADOPTED AS THE TRAFFIC CODE OF THE CITY OF TEMPLE CITY AND ADDING SECTIONS 3324 THROUGH 3330 TO THE MUNICIPAL CODE OF THE CITY OF TEMPLE CITY PROHIBITING ALL -NIGHT PARKING BETWEEN THE HOURS OF 3 :00 A. M. AND 5 :00 A. M. EXCEPT BY PERMIT FROM THE CITY OF TEMPLE CITY, He explained the costs -of putting the decals on the bumper referred to in Section 3331 of the Ordinance in com- parison to using the left rear window. Mr. Jack Clifford, 9971 Bogue St., spoke against the adoption of this ordinance as did Mr. Earl Kampschmidt of 4843 Hallowell. Councilman Fitzjohn moved to waive further reading of Ordinance No. 63 -105, Councilman Merritt seconded, carried by the follow- ing roll call vote: AYES: Councilmen- Fitzjohn, Merritt, Nunamaker NOES: Councilmen -None ABSENT: Councilmen - Dickason, Tyrell Councilman Merritt moved to adopt Ordinance No. 63 -105, Council- man Fitzjohn seconded, carried by the following roll call vote: AYES: Councilmen.Fitzjohn, Merritt, Nunamaker NOES: Councilmen -None ABSENT: Councilmen- Dickason, Tyrell The City Attorney arrived prior to the voting on this ordinance and advised he felt they should adopt the ordinance as now writte; and if they so desired at any time they could amend it for any changes made. 7. ORDINANCE NO. 63 -106: 1st read. Re- Standard & Training of Police Officers. City Attorney Shatford read title to Ordinance No. 63 -106 AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING SECTIONS- 4274 AND 4275 TO THE TEMPLE CITY MUNICIPAL CODE TO REQUIRE AD- HERENCE TO STANDARDS FOR RECRUITMENT AND TRAINING OF POLICE OFFICERS AS ESTABLISHED BY THE CALIFORNIA COMMISSION ON PEACE OFFICERS STANDARDS AND TRAINING, Councilman Fitzjohn moved to waive further reading of Ordinance No. 63 -106, Councilman Merritt seconded, and carried by the following roll call vote: 450 1 Council Minutes, May 13, 1963, page 2 AYES: Councilmen - Fitzjohn, Merritt, Nunamaker NOES: Councilmen -None ABSENT: Councilmen - Dickason, Tyrell As this was the first reading no further action was taken. 8. RESOLUTION NO. 63 -283: Annexation No. 6 A West Temple City, Inhabited. City Manager Woollett reported the Registrar of Voters has cer- tified signers of the petition registered total 16 on file April 30, 1963, on the petition dated April 29, 1963. Total registered voters for the area is L!.7 and 25% of that is 11, so the petition is sufficient. In conjunction with this Resolution No. 63 -283 sets the protest hearing for July 22, 1963, at 8 :00 P. M. to be held in the City Hall. Councilman Merritt moved to adopt Resolution No. 63 -283, Councilman Fitzjohn seconded, and carried by the following roll call vote: AYES: Councilmen- - Fitzjohn, Merritt, Nunamaker NOES: Councilmen -None ABSENT: Councilmen - Dickason, Tyrell NEW BUSINESS: ORDINANCE NU. 63 -107: 1st readinc:. Subdivision Ordinance. City Manager Woollett advised this was the first ordinance to come out of the Master Plan study. The proposed ordinance has been carefully considered by the Planning Commission and check- ed out with the Regional Planning Commission, the Planning Advisor, and the Whitnalls, Consultants of Planning & Govern- ment, and is recommended to the Council for adoption. City Attorney Shatford read title to Ordinance No. 63 -107 AN ORDI- NANCE PROVIDING REGULATIONS FOR THE DIVISION OF LAND IN THE CITY OF TEMPLE CITY, CALIFORNIA, AND FOR THE PREPARATION AND PRESEN- TATION OF MAPS THEREOF, AND PRESCRIBING PENALTIES FOR ITS VIOLA- TION. Councilman Fitzjohn stated he had the greatest confidence in our Planning Commission and could see no reason for further delay, and then moved to waive further reading of Ordinance No. 63 -107, Councilman Merritt seconded, carried by the follow- ing roll call vote: AYES: Councilmen - Fitzjohn, Merritt, Nunamaker NOES: Councilmen -None ABSENT: Councilmen- Dickason, Tyrell 10. 1963 -64 BUDGET FOR EXPENDITURE OF GAS TAX FUNDS: The City Manager advised our estimated 1963 -64 apportionment is about $112,000. from the gas tax fund, and $6000. from the same fund for engineering purposes only. He recommended the City Council adopt Resolution No. 63 -281 and Resolution No. 63- 282 adopting and submitting a budget for expenditure of these state allocated funds. He advised the project selected as part of the Master Plan of development of streets was to complete the widening of Double Drive which will cost some $250,000. of - which the County will spend $125,000., the City of Arcadia be- tween V5,000. and $40,000., and Temple City's share--is $100,000. Councilman Merritt moved to adopt Resolution No. 63 -281 and Resolution No. 63 -282, Councilman Fitzjohn seconded, carried by the following roll call vote: AYES: Councilmen- Fitzjohn, Merritt, Nunamaker NOES: Counc i laen -None ABSENT: Councilmen- Dickason, Tyrell 11, PUBLIC HEARING: 8 :15 P. M. CURB & GUTTER, NORTH SIDE OF LONGDEN FROM ENC I N IT,'\ TO FREER. The City Manager advised there was 611 lin. ft. in the area and the petition received covered 422 lin, ft. or 60 %. Mayor.Nuna- maker opened the Public Hearing and asked if anyone wished to speak for or against this improvement. No one came forward to speak. Councilman Fitzjohn moved to close the Public Hearing, Councilman Merritt seconded and carried. SETTING PUBLIC HEARINGS ON CURB & GUTTER. The City Manager advised petitions for curb and gutter had been received for the south side of Longden from Loma to Encinita, and for the south side of Freer, from Daleview to Farago, and requested a Public Hearing be set for May 27, 1963, at 8 :00 P.M, at the City Hall. Councilman Merritt so moved, Councilman Fitz- john seconded, and carried. 13. APPEAL VARIANCE CASE NO. 63 -45: 9441 E. Broadway The City Manager advised we had received an appeal from the decision of the Planning Commission in Variance Case No. 63 -45 which they denied and requested a Public Hearing be set for May 27, 1963, at $:15 P. M. in the City Hall. Mayor Nunamaker asked if a Public Hearing was necessary and if the case could not just be reviewed by the Council for their decision. The City Attorney advised the City has always set a Public Hearing before the Council and felt it should be done so at this time also. Councilman Fitzjohn moved to set the Public Hearing for May 27, 1963, at 8:15 P. M. at the City Hall, Councilman Merritt seconded, roll cat] vote to carry as follows: AYES: Councilmen - Fitzjohn, Merritt, Nunamaker, NOES: Councilmen -None ABSENT: Councilmen - Dickason, Tyrell 14. ISSUANCE OF PERMITS FOR FIREWORKS STANDS: The City Manager advised applications were received in order from the Optimist Club, Lions Club, Y's Mens Club, Rotary Club, Church of Jesus Christ of Latter Day Saints. Also an applica- tion from the American Legion which was filed late on May 7. Mr. Scherer of the American Legion advised the Council the reasc for the late filing was that they did not have a definite place for their stand as at the last minute the location they had ar- ranged for was sold and in escrow which cancelled out their use of the lot. Councilman Fitzjohn moved that the American Legion be included and all applicants be granted permits Councilman Merritt seconded, and carried by the following called vote: AYES: Councilmen - Fitzjohn, Merritt, Nunamaker NOES: Councilmen -None ABSENT: Councilmen- Dickason, Tyrell 15. CASH CONTRACT #41212 LIVE OAK RE- CONSTRUCTION, TEMPLE CITY BLVD. TO BALDWIN AVE., AMAN BROS, The City Manager read a letter from the L. A. County Road Dept. recommending the City Council accept the work on Cash Contract #41212 which has been satisfactorily completed and authorize the payment oF $40,199.50 to Amen Bros. Councilman Fitzjohn moved to accept the work on Cash Contract #41212 and authorize payment of the sum of $40,199.50 to Amen Bros. as recommended, Councilman Merritt seconded, carried by the following rot+ call vote: AYES: Councilmen - Fitzjohn, Merritt, Nunamaker NOES: Councilmen -None ABSENT: Councilmen- Dickason, Tyrell 16. EXTENSION OF TIME ON NEW LIBRARY CONTRACT: City Manager Woollett read a letter from 7,heard & Morgan re- questing a one day extension of time due to inability to work on April 15, 1963, due to the wet weather and they not pour concrete. Councilman Merritt moved to grant, Counc..oman Fitzjohn seconded and carried by the following called vote: AYES: Councilmen - Fitzjohn, Merritt, Nunamaker NOES: Councilmen -None ABSENT: Councilmen- Dickason, Tyrell 452 Council Minutes, May 13, 1963, Page 4 17. RESOLUTION NO. 63 -284: Warrants & Demands Following study the City Manager advised that included in this Resolution was a payment to Shepard & Morgan on the library of $35,000., and also a $40,000. payment for the Live Oak improve- ment, and a L. A. Co. Road Dept. bill of-$28,000. Councilman Merritt moved to adopt Resolution No. 63 -284, warrants and de- mand Nos. 2549 through 2619, in the sum of $120,006.56, Council- man Fitzjohn seconded, and carried by the following roll call vote: AYES: Councilmen- Fitzjohn, Merritt, Nunamaker NOES: Councilmen -None ABSENT: Councilmen - Dickason, Tyrell 18, PARKS & RECREATION COMMISSION RECOMMENDATION: The City Manager advised the Commission recommended that the City co- sponsor the Temple Players, a little theatre group as the Footlighters are no longer operating, and also advised this involves no expenditure of funds. This is a prosceniungroup and have made arran ?ements with one of the schools For use of a stage and auditorium and all plays will be cleared through our Commission. Councilman Fitzjohn moved to approve, Council- man Merritt seconded, and carried. Councilman Tyrell arrived at this time, 8 :25 P. M. 19. TRAFFIC COMMISSION RECOMMENDATIONS: Item 6. Recommend marked parking stalls be installed on both sides of Cloverly Ave. between Las Tunas Dr. & Woodruff Ave, Item 15. Recommend a side intersection CURVE sign, with 25 m.p.h. speed, be placed before intersection on Temple City Blvd. on the east side south of Lower Azusa Rd. Item 14. Recommend installation of centerline striping on Oak Ave, and Lemon Ave. together with additional pavement markings for speed limits. Item 17. Recommend acceptance by the Council of petition re- questing two -hour time limit parking on both sides of Camellia from Las Tunas Dr. to Woodruff Ave. advising enforcement problem due to limited use of three - wheeler. Following discussion Councilman Merritt moved to approve items 6, 15 and 14, Councilman Fitzjohn seconded, roll call vote to carry as follows: - AYES: Councilmen - Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen-Hone ABSENT: Councilmen - Dickason Following considerable discussion regarding item 17, Councilman Tyrell moved to grant the request, Councilman Merritt seconded, roll call note to- -carry as follows: AYES: Coundilmenr-Fjtzjohn, Merritt, Tyrell,Nunamaker NOES: Councilmen -Bone ° ABSENT: Councilman - Dickason Item 9. Commission recommend installation of STOP and stop bar pavement markings on Halifax Rd. in conjunction with 25 m.p.h. pavement markings to be placed at quarter -mile intervals the entire length of Olive Ave. to aid enforcement. Councilman Tyrell moved to approve item 9 of the recommendations, Councilmar: Fitzjohn seconded, roll call vote to carry as follows: AYES: Councilmen-. Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen - Dickason At this time Mayor`Nunamaker presented a Certificate of Recogni- tion from the City of Temple City to Councilman Tyrell for his excellent and untiring services in behalf of the City during his term as Mayor the past year. 20. SUMMER RECREATION PROGRAM: Director of Recreation Kobett requested authorization to recruit employees for the Summer Recreation program as in previous years prior to the adoption of the budget, which would involve the same number or people this year as last. COMMUNICATIONS: a. The City Manager presented letters from the L. A. County - Boundary Commission regarding annexations #309, 324, 326, 328 - City of El Monte, and proposed annexation #40 -City of South El Monte. Councilman Tyrell moved to receive and file,Councilman Fitzjohn seconded and carried. 22. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mrs. Georgia Maxey, Traffic Commissioner, requested the Council to change their agenda to have the Invocation before the Pledge of Allegiance to the Flag. Following discussion the Council approved. Chas. Oakley, 6164 Rosemead, requested information regarding the -. zoning between Garibaldi & Rosemead, and also regarding the viola- tion letter sent to Mr. Janis. The City Manager advised Mr. Janis had filed for a variance on his property and the zoning could not be determined at this time and not until the adoption of the Master Plan. 23. MATTERS FROM CITY OFFICIALS: Mayor Nunamaker stated he had neglected to appoint a Council re- presentative to the Civil Defense Committee and at this time ask- ed Councilman Merritt if he would act in this capacity which he agreed to do. Mayor Nunamaker read a letter from the Temple City Christian Church requested permission to have two banners across Las Tunas Dr. one near Allessandro and one near Temple City Blvd. during the period of May 15 -29 for the Temple City Religious Census, the church to furnish the necessary liability insurance. Council- man Tyrell moved to grant, Councilman Fitzjohn seconded, carried. The Mayor read a letter from American Field Services advising that Temple City would be a stop -over for a bus load of foreign students that have been studying in the U. S. numbering 32 plus 2 chaperones. They wall stay over night June 20 and 21, and it was requested June 16 -22 be proclaimed as American Field Services Week. Councilman Tyrell so moved, Councilman Fitzjohn seconded, and carried. Mayor Nunamaker advised he would like to have a committee take --- over the Sister City project. Councilman Tyrell so moved, Coun- cilman Fitzjohn seconded and carried. The Mayor also thought when the foreign students arrived in El Monte the Council should be there and escort them into the City and will discuss this further at a later date. He then read a letter from the Y'Teens of the High School request- ing a car wash at the Standard Station on the northwest corner of Las Tunas & Alessandro on the 18th and 25th of May from 10:00 AM to 4 :00 PM. Councilman Fitzjohn moved to grant, Councilman Tyrell seconded and carried. Mayor Nunamaker read a letter from Mrs. Geo. Liden, Ch., Merchants Sidewalk Sale, Chamber of Commerce, requesting permission for a sidewalk sale May 24 from 10 A. M. until 9 P. M., also stating participating merchants will be covered with insurance. They also request No Parking signs posted on Las Tunas Dr. from Clover - ly to Camellia during the hours of the sale. Following discussion regarding the posting it was agreed the City Manager would work this out with the Chamber, and the idewalk sale be approved. Councilman Fitzjohn so moved, Councilman Merritt seconded, and carried. 454 1 1 1 Council Minutes, May 13, 1963, page 6 City Manager Woollett read a letter from the County Road Dept. regarding Tract #20748, Miller & Price Dev. Co. advising the street improvements have been satisfactorily completed. However as the street trees required as a condition have not been com- pleted they recommend the Council accept completed portions of the work for maintenance but do not release the faithful per- formance bond until remaining work is completed. Councilman Tyrell so moved, Councilman Merritt seconded, carried by the following roll call vote: AYES: Councilmen-Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -none ABSENT: Councilmen - Dickason City Manager Woollett read a letter From the County Road Dept. regarding Tract #27309 J. B. Weber Dev. Co. advising the street improvements have been satisfactorily completed. However the street lights required are not included and have not been in- spected by the Road Dept„ and they recommend acceptance of the completed portions of the work for maintenance, but that the faithful performance bond should not be released until the re- - maining work is completed. Councilman Fitzjohn so moved, Council. man Merritt seconded, roll call vote to carry as follows: AYES: Councilmen-Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -Bone ABSENT: Councilmen - Dickason City Manager Woollett advised there is a certain amount of work regarding the electrical energy work to be done before the lot is paved at this time at the library, and he requested the Counci to authorize the Edison Co. $133.92 for such work, and authorize a contract with Cook Bros. to do the work in the sum of $516. on the same project. Councilman Tyrell so moved to approve, Councilman Fitzjohn seconded, carried by the following roll call vote: AYES: Councilmen- Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen - Dickason The City Manager suggested this meeting be adjourned to May 23, 1963, at 7:30 P. M. for an executive session to discuss an ap- pointment to fill the vacancy on the Planning Commission. The Council all agreed to this time. 24.
