5. MINUTES
a. Special Session Minutes of November 1, 2012
On a motion by Council Member Martinez, seconded by Council Member Butler,
the minutes of the Special Session meeting of November 1, 2012 were approved by a vote of
7 -0.
b. Regular Session Minutes of November 13, 2012
On a motion by Council Member Martinez, seconded by Council Member Butler,
the minutes of the Regular Session meeting of November 13, 2012 were approved by a vote
of 7 -0.
6. ADOPTING THE MEETING AGENDA
On the motion of Vice Mayor Wright, seconded by Council Member Burk, the meeting
agenda was approved as presented by the following vote:

7. PRESENTATIONS
a. Proclamation — Native American Indian Heritage Month
On a motion by Council Member Martinez, seconded by Council Member Burk,
the following was proclaimed:

NATIONAL AMERICAN INDIAN HERITAGE MONTH
NOVEMBER 2012
WHEREAS, on November 15, 1994 President Clinton issued a
proclamation based on Senate Joint Resolution 271, designating the
month of November as "National American Indian Heritage Month; and
WHEREAS, American Indians, the first Americans, have made
enormous contributions to the life of our Country and the earliest
beginnings of its history; and
WHEREAS, American Indians have greatly enhanced the culture,
prosperity and greatness of our Commonwealth and nation; and
WHEREAS, local organizations such as the Loudoun Museum
and the Thomas Balch Library both offer a variety of information for
individuals who wish to discover the contributions that American Indians
have made to Loudoun County and nationwide; and
WHEREAS, it is fitting to recognize the many accomplishments
and contributions of American Indians to our shared culture and to the
preservation of our lands and of the tradition of America's first
inhabitants.
THEREFORE PROCLAIMED, by the Council of the Town of
Leesburg in Virginia the month of November of the Year 2012 as National
American Indian Heritage Month in the Town of Leesburg and urge the
citizens of Leesburg, as well as all community organizations, to preserve
and remember the accomplishments of Native Americans throughout the
history of our nation.
PROCLAIMED this 27th day of November 2012.
b. Mason Enterprise Center Update
Susan Henson, Enterprise Center Director, gave a brief presentation
on the Mason Enterprise Center's first year in operation. She highlighted that
70% of the space has been leased and gave examples of how small businesses
benefit from their partnership with the Center. She invited the Council to
attend the anniversary open house later in the week.
8. PETITIONERS
The Petitioner's Section was opened at 8:06 p.m.
Paige Buscema, thanked Council for their support of expanding the holiday
decorations downtown and the free parking for the holiday season. She stated the

Downtown Business Association is expanding their horse drawn carriage rides to two
weekends in December (15"' and 22 "). She stated they are free to anyone who has a
paid receipt from any downtown business dated in the month of December. She invited
Council to attend the Holiday Open House on December 1st where nearly 20 businesses
downtown are hosting open houses. She also noted on December 12 "', they will have a
progressive dinner starting at the Guest Room and invited Council to join them.
Milt Herd thanked Council for their service. He noted that Alternative 1 for the
Crescent Design District does a good job of balancing conflicting interests and is the best
option yet. He stated the purpose of the Crescent Design District is to create a walkable,
mixed -use environment to enhance the economic viability of the area and the town. He
stated the addition of new people to the town has added vitality and energy. He
encouraged Council to understand. that the Crescent Design District is for the betterment
of the town, not for developers.
The Petitioner's Section was closed at 8:17 p.m.
9. APPROVAL OF THE CONSENT AGENDA
On a motion by Council Member Martinez, seconded by Council Member Butler, the
following item was moved for approval as the Consent Agenda:
a. Water Pollution Control Facility (WPCF) Equipment Replacement
RESOLUTION 2012 -126
Amending the FY 2013 Utilities Fun Budget and Making a Supplemental
Appropriation in the Amount of $120, 000 for the Repair of Capital Fixed Assets
The Consent Agenda was approved by the following vote:

Nay: None
Vote: 7 -0
10. PUBLIC HEARINGS

11. RESOLUTIONS AND MOTIONS
a. Endorsement of Mural Theme
On a motion by Council Member Burk, seconded by Council Member Martinez,
the following was proposed:
MOTION 2012 -029
I move that the Leesburg Town Council approve the theme for the Downtown
Parking Garage mural as: "This project will reflect a thematic aspect of the
community such as history, growth, change, diversity, andlor commerce and
should be created in a medium that is suitable for exterior application with
minimal maintenance. The mural is intended to become a focal point for visitors
and enhance the sense ofpride in Leesburg. ';• and that the Chief Procurement

Officer issue a Request, for Proposal, as approved by the Town Attorney, for the
solicitation of bids to artists or a team of artists for the installation and
maintenance of the Downtown Parking Garage mural.
Council Comments/ Questions:
Original authorization for the mural specified that no public funds could
be used
Council would have to approve the mural
A building would be more historically accurate than a mural
The motion was approved by the following vote:
Aye: Burk, Butler, Martinez, and Mayor Umstattd
Nay: Dunn, Hammler and Wright
Vote: 4 -3

13. UNFINISHED BUSINESS
a. Crosstrail Boulevard Letter Regarding Plan to Complete
On a motion Council Member Burk, seconded by Council Member Butler, the
following was proposed:
MOTION2012 -030
-- I move to approve the letter to the Loudoun County Board of Supervisors
supporting completion of two lanes of Crosstrail Boulevard between Sycolin Road
and Russell Branch Parkway
Council Comments/ Questions:
• Very important road for Leesburg
• Concern that completion of the road will spur residential development

15. COUNCIL COMMENTS
Council Member Dunn hoped everyone had a good Thanksgiving. He disclosed
meetings with Mr. Banzhaf and the Petersen Companies and representatives of Leegate.
Vice Mayor Wright stated his family had the opportunity to visit Leesburg and
was very complimentary on the community. He reminded everyone of the Craft Show,
Tree and Menorah Lighting, Jingle Jam, and the Holiday Parade. He disclosed
meetings with Mr. Banzhaf and the Petersen Companies and representatives of Leegate.
Council Member Burk disclosed attendance at the Patriot Project breakfast. She
stated this group is raising funds for a statute dedicated to Revolutionary War heroes for

the courthouse lawn. She stated she attended the ribbon cutting for Q Company, a
barbecue restaurant, on Catoctin Circle. Further, she disclosed a meeting with Mike
Banzhaf and John Petersen regarding the Crosstrail rezoning near the Leesburg Airport.
She stated she attended the Living Legacy Tree Planting at Oatlands. She stated the
Journey through Hallowed Ground is raising funds to plant a tree for every single soldier
who died in combat in the Civil War. She complimented Mike O'Connor and Kate
Magennis -Wyatt for their efforts on this project. She also disclosed a meeting with
Andre Fontaine regarding his project. She expressed her gratitude to the Native
American population for everything they have done for the town. She noted two
members of the Loudoun County Public School system, including former Loudoun
County Board Chairman George Barton, passed away over the weekend and gave her
condolences to their families.
Council Member Martinez disclosed a meeting with Mr. Banzhaf and
representatives of the Petersen Companies. He stated he also spoke with Mr. Banzhaf
over the phone regarding the offer to the Board of Supervisors of Crosstrail as a possible
location for a relocated Courts Complex. He stated his father's 1956 Chevy Bel -Air
Coupe is almost ready to be entered in the Holiday Parade.
Council Member Hammler disclosed meetings with Andre Fontaine and Mr.
Banzhaf and the Petersen Companies. She thanked Senator Herring, Delegate Black's
legislative aide, Delegate Minchew, and Delegate May for attending the legislative
dinner. She noted the discussion was very helpful. She thanked Mayor Umstattd for
having Leesburg host the meeting of the Towns of Northern Virginia which was a good
opportunity to make progress on the town's legislative priorities. She thanked Ms.
Brinkley for her lovely invocation. She stated her appreciation for citizens like Paige
Buscema and Milt Herd and all the citizens' innovative and creative energy.
Council Member Butler stated he had the same disclosures as the previous two
Council Members. He expressed his hope that everyone had a good Thanksgiving stated
he escaped central New York before the snow started. He also expressed his hope that
all the town's retailers had a profitable Black Friday. He stated his wish that the Board
of Supervisors remain silent on the issue of the seasonal displays on the Courthouse
lawn.
16. MAYOR'S COMMENTS
Mayor Umstattd disclosed a meeting with Mr. Banzhaf and Mr. Petersen
regarding their proposal to develop the Crosstrail property. She stated there was
discussion about sewer lines and they did acknowledge that they sent a letter to the
Chairman of the Board of Supervisors Government and Finance Committee suggesting
that the county move the entire courts complex to Crosstrail. She expressed her doubt
that the proposed site is large enough for the entire complex as well as the expansion.
She disclosed a meeting with representatives of Leegate. She stated they are looking at a
rezoning and comprehensive plan amendment to allow between 320 -350 townhomes
and two- over -two units as well as a commercial center. She also disclosed a meeting
with Andre Fontaine regarding his proposal to move the Courthouse Complex to his
property near Izaak Walton pond. She stated there are two other downtown land

owners who would like to accommodate the courthouse expansion on their properties as
well as Crosstrails and Mr. Fontaine's property.
She agreed that the Public School system lost two fine educators this week. She
stated Mr. Barton's funeral will be on Thursday at 2 p.m. at Harmony Methodist Church
in Hamilton.
17. MANAGER'S COMMENTS
Mr. Wells offered condolences to the Barton family. He stated he worked for the
County during Mr. Barton's tenure as Chair of the Board of Supervisors. He stated the
Council's direction to put benches, trees, and pet waste station on the vacant land on
Loudoun Street has been completed. He stated he has been contacted by two
individuals who would like to make donations to the town to expand the amenities. He
stated he would work with Mr. Ference to come up with an idea of how to implement
those donations.

On a motion by Vice Mayor Wright, seconded by Council Member Butler, the meeting was
adjourned at 8:51 p. m.
