Adjournment JF TIFFIN CITY COUNCIL REGULAR'MEETING Mayor Phillips called meeting to order at 6:30 pm on Wednesday, April 13, 2011 at Springmier Library. Roll Call of members present: Chris Ball, Mike Gericke, Mark Petersen, Travis Weipert. Absent Jim Bartels. Also present were Attorney Steve Greenleaf, Engineer Doug Frederick, Public Works Brett Mehmen and Clerk Ruth Demuth. Motion by Council person Gericke and seconded by Council person Ball for approval of agenda as presented. Any following actions requiring a vote are approved by Ayes unless so noted other and absences noted. Community Forum: Diane McGriff, of 305 Nightingale Dr. inquired of the City's assistance in resolving a wet area between back yards between W Goldfinch Dr. and Nightingale Dr. Ron Behrens of 312 Goldfinch Dr. commented on the continuous use of a sump pump in his basement. Mayor Phillips reported that a meeting of neighbors, Engineers, and other officials had been held at site and neighbors were given a drainage plan by Engineers for possible resolution. His understanding was that the neighbors were to proceed with resolution. Council members agreed to further discuss concerns at April 27, 2011 Work Session. Council person Mark Petersen entered meeting'at 6:40pm. Resident on Redbird Run inquired on"No Parking"signs on east side of street north of Goldfinch Dr. Further review of request moved to April 27, 2011 Work Session. Council person Jim Bartels entered meeting at 6:47pm. Darla Bartels, representing Tiffinfest Committee, presented three contracts for Mayor's signature for vendors. Motion by Weipert and seconded by Ball for approval of contracts and for Mayor's signature. Johnson County Deputy gave general overview of city status. Discussion held on inquiry for Sheriff's Department and Auxiliary staff needed during Tiffinfest events. Tiffinfest committee members inquired on assistance with traffic following parade. Old Business: Motion by Bartels and seconded by Ball for approval of council minutes for March 9 and 30, 2011. Motion by Gericke and seconded by Bartels for approval of receipts and expenditures. Four Ayes and nay by Petersen. Discussion held on the award of the 2011 and 2012 Mowing Contract. Inquiry made on extending contract to three years. Mayor Phillips reminded Council members that original proposals were submitted based a two year contract. and it would be inappropriate to award a three year contract. Motion by Council person Petersen and seconded by Ball to read Resolution 2011-12 by title only. Motion by Gericke and seconded by Weipert to approve Resolution 2011-12 Award Contract for Mowing Contract for Park and Beautification Areas within the City Limits of Tiffin, Iowa for two years. Mayor Phillips reviewed timeline of events involved in the city acquiring the two resident lots in Timber Ridge Part Two Development. Lot#31 is now listed for sale at approximately$45,000. Council discussions from March 30, 2011 Work Session reviewed on future of Lot#48. Residents expressed their displeasure of advertising on Lot#48 and preliminary decisions made by Council. Inquiries were made on estimated price set on lot. Mayor Phillips explained process of listing lot with realtor to generate interest on lot. Attorney Greenleaf confirmed the process was legal and within the city's authority to list lot#48 for sale. Attorney explained that until City Council reaches point to authorize sale of lot, the process'does not require a formal vote by City Council per Iowa Code. Discussion held on various options for the future of the lot. Questions were asked on the Public Hearing process on the sale of Public Land: Attorney replied that City has followed the correct process required. Attorney suggested that neighbors of lot#48 formulate a plan to present to the City Council for further discussion. Motion by Council person Ball and seconded by Council person Gericke to table approval of Resolution 2011-14 and review at April 27, 2011 Work Session. New Business: Motion by Council person Weipert and seconded by Council person Petersen to read Resolution 2011-13 by title only. Motion by Council person Ball and seconded by Council person Weipert for approval of Resolution 2011-13 To Accept and Approve the Site Plan For the Depot Tiffin Reconstruction Plan Within the Limits of the City of Tiffin, Iowa, contingent upon the comments made by the City Engineer and the review done by Public Works, Tiffin Fire Chief and approval of recommendation made by the Planning and Zoning Commission. It was noted that the new canopy location on the site plan regarding the set back requirements would need the approval of the Board of Adjustments through the Variance process. Mayor Phillips read the proclamation proclaiming the month of May 2011 Older Americans Month in Tiffin. Eve Casserly was present and received the signed document on behalf of the Johnson County Successful Aging. Discussion held on the progress of the Rolling Hills Part Four completion for the final platting. Tim Herrold, representing Corell Readi-Mix, answered questions on the progress of the punch list items and commented on interest of sale of lots. Herrold reported that elevations had been completed on the depth of the big pond. Test results showed that most areas of pond measured between six to eight feet in depth, which met original design of pond. Herrold inquired on the required maintenance bond to be obtained for two years instead of the five years, due to the Rolling Hills Drive having been opened to the public and maintainted by the City since the 2007
