Council Chambers, 25 West Market Street, 7:15 p.m. Mayor Umstattd presiding.
Council Members Present: Kelly Burk, David Butler, Katie Sheldon Hammler, Kevin
Wright and Mayor Umstattd. Council Member Martinez participated electronically
from Dallas, Texas.
Council Members Absent: Council Member Martinez joined the meeting at 7:19 p.m.
Council Member Dunn arrived at 7:35 p.m. and left at 7:59 p.m.
Staff Present: Town Manager John Wells, Town Attorney Jeanette Irby, Deputy Town
Manager Kaj Dentler, and Clerk of Council Lee Ann Green
AGENDA ITEMS
1. CALL TO ORDER
2. ROLL CALL: Showing a quorum of five members physically present. Council
Member Martinez participated electronically from Dallas, Texas.
3. NEW BUSINESS
a. Approval of Electronic Participation— Council Member Martinez
On a motion by Mayor Umstattd, seconded by Vice-Mayor Butler, the following
was proposed:
MOTION 2013-035b
I move to allow Council Member Martinez to participate electronically in the
meetings of August 12 and August 13, 2013.
The motion was approved by the following vote:
Aye: Burk, Butler, Hammler, Wright, and Mayor Umstattd
Nay: None
Vote: 5-0-2(Dunn and Martinez absent)
b. Approval of a letter regarding appeal of a school walk zone decision
On a motion by Council Member Burk, seconded by Vice-Mayor Butler, the
following was proposed:
MOTION 2013-035c
I move to approve the draft letter to School Board Chairman Hornberger with edits
as noted
Vice-Mayor Butler made a friendly amendment to change the language on
page two to reflect a request by Ms. Weiss to change to `grant an exception". The
motion was accepted as friendly.
Council Comments/Questions:
• Concern for pedestrian safety

• Concern for the process
• Trails are not specifically addressed with regards to snow removal
in the Town Code
• Homeowner's association considers the trails to be recreational
amenities, not sidewalks
• This is a reasonable policy but communication from the School
Board has fallen short
Council Member Wright made a motion to strike the two references to
permanent exceptions. The motion was seconded by Council Member Dunn.
Council Comments/Questions:
• This particular walk zone has significant safety issues
• Process was rushed
• Would rather financial impacts be made on services other than
those related to the classroom
The motion to amend failed on the following vote:
Aye: Wright
Nay: Burk, Butler, Dunn, Hammler, Martinez and Mayor Umstattd
Vote: 1-6
Council Member Dunn offered an amendment to add language "should this
measure be for cost savings, that the school board consider cutting costs in other areas that
are not classroom related".
Council Comments/Questions:
• From an exception point of view, this is about safety issues, not financial
issues
• If conditions change, would this exception be evaluated?
School staff answer: Yes.
The proposed amendment died for lack of a second.
Council invited Jill Weiss, Supervisor Reid and School Board member
Reed to speak.
Vice-Mayor Butler offered a friendly amendment to delete the words "on a
permanent basis"on the first page. The amendment was accepted as friendly after some
discussion.
The motion to send the edited letter was approved by the following vote:
Aye: Burk, Butler, Hammler, Martinez, Wright and Mayor Umstattd
Nay: None
Vote: 6-0-1 (Dunn absent)

Council Member Martinez authorized the Town Attorney to sign the
letter on his behalf.
4. ADJOURNMENT
On a motion by Council Member Wright, seconded by Council Member Martinez, the
meeting was adjourned at 8.•15 p.m.
