AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OPA-LOCKA, FLORIDA; AMENDING CHAPTER 20
OF THE OPA-LOCKA CODE OF ORDINANCES
ENTITLED "TRAILERS" BY CREATING SECTION 20.8
ENTITLED "TRUCK ROUTES ESTABLISHED" AND
ESTABLISHING REGULATIONS FOR ROAD USAGE BY
COMMERCIAL VEHICLES WITHIN THE CITY OF OPA-
LOCKA; PROVIDING FOR APPLICABILITY AND
DEFINITIONS; PROVIDING FOR EXCEPTIONS;
PROVIDING FOR THE ESTABLISHMENT OF TRUCK
ROUTES; PROVIDING FOR PENALTIES; PROVIDING
FOR INCORPORATION OF RECITALS; PROVIDING FOR
CONFLICT AND REPEALER; PROVIDING FOR
SEVERABILITY; PROVIDING FOR AN EFFECTIVE

WHEREAS, vehicles of extraordinary weight and size can contribute to rapid
destruction of surface streets in residential areas; and
WHEREAS, municipalities may enact reasonable regulations to promote the health,
safety and welfare of citizens; and
WHEREAS, the City Commission of the City of Opa-locka ("City Commission") desires
to amend Chapter 20 of the City of Opa-locka Code of Ordinances entitled "Trailers", by
creating Section 20-8 and establishing regulations for road usage by commercial vehicles within
the City of Opa-locka ("City"); and
WHEREAS, the City Commission desires to prohibit commercial vehicles, and anything
not self-propelled, that weighs in excess of one (1) ton from travel on certain residential streets
within the City; and

WHEREAS, the City Commission has determined that it will be in the best interest of
the City to specifically amend Chapter 20 of the City of Opa-locka Code of Ordinances, by
creating Section 20-8 entitled "Truck Routes Established" and prohibiting commercial vehicles,
and anything not self-propelled in excess of one (1) ton from traveling on certain residential
streets within the City of Opa-locka.
THE COMMISSION OF THE CITY OF OPA-LOCKA HEREBY ORDAINS:
Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City Commission of the City of Opa-locka hereby amends Chapter 20
of the City of Opa-locka Code of Ordinances entitled "Trailers" and hereby creates Section 20-8
entitled"Truck Routes Established"as set forth herein:
Sec.20-8. Truck Routes Established
(a) Definitions. For the purpose of this Section, the following terms, phrases,
words and their derivatives shall have the meaning given in this section.
"City" is the City of Opa-locka, Florida.
"Deviating Truck" is a truck which leaves and departs from a truck route while
traveling inside the City.
"Person" is any person, firm, partnership, association, corporation, company or
organization of any kind.
"Truck" is any vehicle designed or operated for the transportation of property,
and whose body weight or whose combined body and load weight or whose rated
capacity exceeds one(1) ton.
"Truck Route" is a way over certain streets, as designated in this Section, over
and along which trucks coming into and going out of the City must operate.
"Destination point" is a location where merchandise or material is loaded or
unloaded during the normal course of business.
(b) Application of Regulations. All trucks within the City shall be operated only
over and along the truck routes established in this Section and on the other
designated streets over which truck travel is permitted. Overnight parking of
trucks in residential areas are not permitted.

(c) Exceptions. This Section shall not prohibit:
1. Operation on Street of Destination: The operation of any trucks upon any street
where necessary to the conduct of business at a destination point, provided streets
upon which such traffic is permitted are used until reaching the intersection
nearest the destination point
2. Emergency Vehicles: The operation of emergency vehicles upon any street in
the City;
3. Public Utilities: The operation of trucks owned or operated by the City, public
utilities, or any contractor while engaged in the repair, maintenance or
construction of streets, street improvements or utilities within the City;
4. Detoured Trucks: The operation of trucks upon any officially established detour
in any case where such truck could lawfully be operated on the street for which
such detour was established.
(d)Truck Routes Established
1. NW 27 Avenue West on Veterans Way towards Douglas Road (NW 37
Avenue) including the reverse route from Douglas Road to NW 27 Avenue
(Douglas-Service Road is not included in this route)
2. NW 27 Avenue going East on Veterans Way towards NW 22nd Avenue,
including the reverse route going West from NW 22nd Avenue to NW 27 Avenue
3. All the connecting streets within the commercial and industrial boundaries of
NW 27 Avenue, NW 22 Avenue, NW151 Street and Veterans Way, to include
NW 147 Street, NW 149 Street, NW 150 Street, NW 22 Place, NW 24 Court, NW
25 Court, NW 25 Avenue, and NW 26 Avenue.
4. NW 27 Avenue going West onto NW 127 Street and NW 30 Avenue turning
West on NW 129 Street traveling North on NW 31 Avenue onto West to NW 131
Street towards NW 32 Avenue
5. Veterans Way going South on Dunad Avenue and Superior Street turning right
on Sesame Street to NW 135th Street, including the reverse route from NW 135th
Street to Veterans Way.
6. NW 135 Street going South on NW 32 Avenue, including the reverse route
from NW 32 Avenue to NW 135 Street
7. All the connecting streets within the commercial and industrial boundaries of
NW 22 Avenue, NW 141 Street, NW 19 Avenue, and Opa-locka Boulevard, to
include NW 20 Avenue, and NW 20 Court.

8. The commercial boundaries of NW 27 Avenue, first block going East on NW
143 up to NW 26 Avenue turning West to NW 27 Avenue.
9. Portion of Service Road along State Road 9 onto to NW 24 Avenue going
South towards NW 143 Street connecting back to Service Road.
10. All roadways within the commercial and the industrial area of the Sub-
Divisions of LeJuen Industrial Park and North Dade Industrial Park.
11. All roadways in the Salvage Yard Area in the Sub-Division of Nile Gardens to
include Port Said Road,Cairo Lane, and NW 127 Street
12. All of Opa-locka Boulevard up to Sharazad Boulevard. (Trucks are not
allowed to travel on Sharazad Boulevard).
13. All county and state roadways: NW 135 Street, NW 37 Avenue (Douglas
Road), NW 27 Avenue, NW 22 Avenue, NW 42 Avenue (Le Juene Road), State
Road 9, Opa-locka Boulevard, NW 151 Street.
(e)Truck Traffic in the City-Outside Origin
1. One (1) Inside Destination Point: All trucks entering the City for a destination
point in the City shall proceed only over an established truck route and shall
deviate only at the intersection with the street nearest to the destination point.
Upon leaving the destination point, a deviating truck shall return to the truck route
by the shortest permissible route.
2. Multiple Inside Destination Points. All trucks entering_the City for multiple
destination points shall proceed only over established truck routes and shall
deviate only at the intersection with the street nearest to the first destination point.
Upon leaving the first destination point, a deviating truck shall proceed to other
destination points by the shortest direction. Upon leaving the last destination
point, a deviating truck shall return to the truck route by the shortest permissible
route.
(f) Truck Traffic In City-Inside Origin
1. Outside Destination Point. All trucks, on a trip originating in the City, and
traveling in the City for a destination point outside the City, shall proceed by the
shortest direction over streets on which such traffic is permitted to a truck route as
established in this Section.
2. Inside Destination Points. All trucks on a trip originating in the City, and
traveling in the City for destination points in the City shall proceed as provided in
Subsection (e).

(g) Maps. The City Clerk shall keep and maintain accurate maps setting out truck
routes and streets upon which truck traffic is permitted; the maps shall be kept on
file in the office of the City Clerk and shall be available to the public.
(h) Signs. The Director of Public Works or his designee shall cause all truck
routes to be clearly sign posted to give notice that this Section is in effect.
(i) Weigh-Ins. Any duly authorized police officer of the City of Opa-locka, having
probable cause to believe that a vehicle is violating this Section, shall have the
authority to require any person driving or in control of any commercial vehicle
not proceeding over a truck route or street over which truck traffic is permitted, to
proceed to any private or public scale available for the purpose of weighing and
determining whether this Section has been complied with.
(j) Penalty. Any person who violates this Ordinance shall be guilty of a Class C
misdemeanor punishable by a fine not less than one hundred dollars ($100.00)
and not to exceed five hundred dollars ($500.00). A summary of this Ordinance
consisting of its title shall be duly published.
Section 3. All ordinances or Code provisions in conflict herewith are hereby
repealed.
Section 4. If any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining portions of this Ordinance.
Section 5. This Ordinance shall, upon adoption, become effective as specified by the
City of Opa-locka Code of Ordinances and the City of Opa-locka Charter.

UPON CERTAIN ROADWAYS
Request: AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF OPA-LOCKA, FLORIDA, RELATING TO RESTRICTIONS OF
ROAD USE, PROHIBITING WITHIN THE CITY LIMITS;
PROVIDING EXCEPTIONS; PROVIDING PENALTIES FOR
VIOLATION OF THE ORDINANCES NOT TO EXCEED FIVE
HUNDRED DOLLARS ($500.00); PROVIDING FOR
SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE AND
PROVIDING FOR ENFORCEMENT.
Description: The City Commission of the City of Opa-locka directed the City Manager and City
Attorney to prepare an Ordinance restricting commercial vehicles to travel within the City's
residential areas.
Financial Impact: The publication of the Ordinance and the posting of traffic signs will be the
cost associated with the adoption of the Ordinance.
Implementation Time Line: Immediately upon adoption
Legislative History: Zoning Code 8.2. Regulations For The Parking, Storing or Keeping
of Commercial Vehicles, Boats, Buses, Trailers, and Trucks
Recommendation(s): Staff recommends the approval of the Ordinance.
Analysis: During the public meeting of January 28, 2009 the City Commission of the City of
Opa-locka expressed their concerns about the damages to the roadways which are caused by
commercial vehicles (trucks) traveling upon certain residential streets. It is a fact that, vehicles of
extraordinary weight and size can contribute to rapid destruction of surface streets typical to
residential areas. The City Commission may enact laws to prevent any future damages to city
streets and to promote the health, safety and welfare of its citizens.
The city's residential roadways which have experienced most damages are:
-NW 132nd Street from Port Said to Aswan Road (NW 30 Avenue)
-Aswan Road (NW 30 Avenue) from NW 135 Street to NW 127 Street
-Sharazad Boulevard from NW 27 Ave. to Veterans Way
-Perviz Avenue from NW 151 Street to Sharazad Boulevard
-NW 31 Avenue from NW 32 Avenue to NW 31 Avenue
-NW 132 Avenue from NW 30 to NW 27 Avenue
-Jann Avenue from NW 27 Avenue to Perviz Avenue
-Service Road from NW 22 Avenue to Burlington Street
The following represents a listing of the truck routes:
1. NW 27 Avenue West on Veterans Way towards Douglas Road (NW 37 Avenue)
including the reverse route from Douglas Road to NW 27 Avenue (Douglas-Service
Road is not included in this route)
2. NW 27 Avenue going East on Veterans Way towards NW 22nd Avenue, including the
reverse route going West from NW 22nd Avenue to NW 27 Avenue
3. All the connecting streets within the commercial and industrial boundaries of NW 27
Avenue, NW 22 Avenue, NW151 Street and Veterans Way, to include NW 147 Street,
NW 149 Street, NW 150 Street, NW 22 Place, NW 24 Court, NW 25 Court, NW 25
Avenue, and NW 26 Avenue.
4. NW 27 Avenue going West onto NW 127 Street and NW 30 Avenue turning West on

management and public utility services.

REGULATIONS FOR THE PARKING, STORING, OR KEEPING OF
COMMERCIAL VEHICLES , BOATS , BUSES„ TRAILERS , AND TRUCKS
A. Scope
The following regulations shall apply to all
residential districts .
B. Definitions
In addition to the definitions provided in Section 2.2,
the following definitions shall control this Section :
1 . For the purpose of this Code, the terms "bus",
"pole trailer" " semi-trailer" , "trailer" ,
"trailer coach", "truck", and "truck tractor"
shall be defined as set forth in the appropriate,
duly enacted statutes of the State of Florida pro-
.
viding for the regulation, registration, licensing
and recordation of own-ership of motor vehicles in
the State of Florida .
2 . In the case of doubt as to the proper classifi-
cation of a specific vehicle under the foregoing
terms, the determination by the Motor Vehicle
Commission of the State of Florida shall be
controlling. The body description and classifica-
tion on the motor vehicle certificate of title
shall be prima facie evidence of such
determination .
3 . The term "boat trailer" shall mean a trailer which
• is being used for, or is designed for, use of
carrying boats.
4. The term "industrial equipment" shall mean farm
tractors and implements, bulldozers, drag lines,
cranes, derricks , heavy earth moving equipment
normally used in farming, excavation and/or heavy
construction activities .
5 . The term "trailer coach" as used herein shall mean
and include all types of mobile homes and also
those types of self-propelled trucks or buses
which have been converted or equipped with living
and/or sleeping quarters. However, this excludes
• suburbans and pick-up trucks with living quarters
installed, sometimes referred to as "pick-up
campers " and other types of automobiles for
private use which have been equipped with camping
equipment and relocated materials.
6 . The term "residential districts", for the purpose
of this Code shall mean all R-1, R-2, R3, R-TH

and R-4 or other housing districts as established
by this Ordinance.
7 . The term "owner" when used herein in relation to a
motor vehicle shall mean the individual or firm to
which the vehicle is registered on the motor
vehicle certificate of title and shall include, if
under lease, rental agreement, or on loan under
any type of arrangement, gratuitous or otherwise,
the individual or firm having possession or
control of the vehicle .
8. The term "owner" when used herein in relation to
private property in a residential district shall
mean the recorded owner of the property based upon
the records of Dade County and the State of
Florida , and shall include , if under lease ,
rental , agreement for deed or similar land
contract, the person or persons actually in
possession and control of the premises.
C. Motor Vehicles Prohibited or Restricted in Residential

1 . It shall be unlawful for any owner, agent,
operator or person in charge of any bus, pole
trailer, semi-trailer, trailer, trailer coach
(house trailer) , truck and/or truck tractor, as
previously defined in this Code, to park, store,
or keep such motor vehicle on any public street,
avenue, alley, or other thoroughfare or any right-
of-way therewith within any residential district

any residential district in the City of Opa-Locka
to park on, cause to be parked on, or allow to be
parked on one's residential property or in the
streets , alleys , or parkways abutting one ' s
property, any bus, pole trailer, semi-trailer,
trailer, trailer coach (house trailer) , truck,
and/or truck tractor for a peziod exceeding six
(6 ) hours in any twenty-four hour period, -each
such period commencing at the time of first stop-
ping or parking, unless a permit is first obtained
from the Police Department, and/or as may be
otherwise provided in this Code.

Section 2. All ordinances or parts of ordinances inconsistent or in conflict herewith of the
City's code of Ordinances and/or Code of Zoning Ordinances are hereby repealed insofar as there is
a conflict or an inconsistency.
Section 3. If any section, sentence, clause or phrase of this Ordinance is held to be
invalid or unconstitutional by any court of competent jurisdiction,then said holding in no way effects
the validity of the remaining portions of this Ordinance.
Section 4. This Ordinance shall be codified in the City of Opa-locka Code of
Ordinances.
Section 5. This ordinance shall become effective in the manner provided by law.

WHEREAS, the City Commission of the City of Opa-locka, Florida desires to comply
with the Dade County Zoning Ordinances; and
WHEREAS, the City Commission believes it is in the best interest of the City and its
residents to amend section 8.2 (C) of the City's Zoning Ordinance to bring it into compliance with
Dade County's Ordinance.
NOW THEREFORE, BE IT DULY ORDAINED BY THE CITY COMMISSION OF
THE CITY OF OPA-LOCKA, FLORIDA that:
Section 1. Amendment. Section 8.2 (C) (1) and(2) entitled"Motor Vehicles Prohibited
or Restricted in Residential Districts," shall be amended to read as follows:
(1). It shall be unlawful for any owner, agent, operator or person in
charge of any bus, pole trailer, semi-trailer, trailer, trailer coach
(house trailer), truck and/or truck tractor, as previously defined in
this Code, to park, store, or keep such motor vehicles on any public
street, avenue, alley, or other thoroughfare or any right-of-way
therewith within any residential district for a period exceeding one
(1) hour, in any twenty-four-hour period, each such period
commencing at the time of first stopping or parking unless a permit
is first obtained from the Police Department, or unless loading or
unloading of materials, or except as permitted herein.
(2). It shall be unlawful for any owner of property in any residential
district in the City of Opa-locka to park on, cause to be parked on,
or allow to be parked on one's residential property or in the streets,
alleys, or parkways abutting one's:property, any bus, pole trailer,
semi-trailer, trailer, trailer coach(house trailer), truck, and/or truck
tractor for a period exceeding one (1) hour in any twenty-four-hour
period, each such period commencing at the time of first stopping
or parking, unless a permit is first obtained from the Police
Department, or unless loading or unloading of materials, and/or as
may be otherwise provided in this Code.
Section 2. Enforcement of Article Provisions. The enforcement of this article shall be the
responsibility of the code enforcement officer. The code enforcement officer shall enforce these
provisions in accordance with all other applicable statutes or ordinances.
Section 3. Repealer. All ordinances or parts of ordinances inconsistent or in conflict
herewith of the City's Code or Ordinances and/or Code of Zoning Ordinances are hereby repealed
insofar as there is a conflict or an inconsistency.
Section 4. Severability. If any section, subsection, sentence, clause,portion, or phrase of
this ordinance is held, for any reason,to be invalid or unconstitutional by any court of competent
jurisdiction, then said holding in no way effects the validity of the remaining portions of this
Ordinance.
Section 5. Codification. This Ordinance shall be codified in the manner provided by law.
Section 6. Effective Date. This ordinance shall become effective in the manner provided
by law.
