As provided in Article 34 and 48 of Chapter 22 of the Municipal Code, the following described use of the following described real estate is allowed as a Special Use for an ambu- lance service at 715 kbrthvest 5th Street, in the City of Ri&nond, Indiana; mere particularly described; to wit: A part of lot rnnnbered ten (10) in Poe and Lynde's Addition to the City of Richnond, and bounded as follows, to wit: Beginning at t:He northeast corner of the Northwest Fifth Street and Center Street; running thence north along the east side of Northwest Fifth Street two hundred eighty-one and 92J100 (281.92) feet .to an alley running east and west; thence east along the south side of said alley one hundred forty-two and 61/100 (142.61) feet; thence south parallel with the east side of Northwest Fifth Street two hundred forty --nine and 42/100 (249.42) feet; thence west parallel. with the north Line of Center Street twenty-three and 50/I00 (23.50) feet; thence south parallel with the east line of Northwest Fifth Street thirty-t-x and 50/100 (37.50) feet to the north line of Center Street; thence west parallel with the north line of Center Street one hundred nineteen and 11/100 (119.11) feet to the place of beginning, excepting that part taken to widen West Fifth and Center Street. ALSO, six (6) feet of vacated alley inmiediately north and abutting said 'Tract 1, said six (6) feet of vacated alley being described in Plat Book 7, page 191, records of Wayne County, Indiana..:. SECTION 2. As a condition of the aforesaid Special Use and as an addi- tional restriction on said use, the following requirements shall hereafter and at all times be met by the owner, leasee or any person, film or corporation using said real estate. a. The site plan accon parrying the petition be identified as Exhibit "A' and made a part of Ordinance No. 28-1979. b. The Special Use authorization shall be considered null and void should the Special Use cease for a period of one (1) year or more. ORDINANCE NO. 23-1979 Page 2 SEC ON 3. The Zoning Administrator of the City of Ricl-mnd, Indiana, is hereby authorized and directed, upon enactanent and publica- tion of this Ordinance, to record and approve the issuance of a permit for the establishnmt of the use herein allo*,md. SECTICiN 4. This Ordinance shall be in full force and effect from and after its passage and approval by the ?Mayor, and publication as by law required. McDaniel, Attorney. They were requesting Special Use in an M-1 Light Industrial Zoning District for a proposed Ambu- lance Service on property located at 715 Northwest 5th Street. fifteen (15) letters had been sent to adjoining properties. Eight (8) were returned in favor and zero in opposition. The Plan Commission voted nine (9) to zero (0) in favor of granting this Special Use. Commissioners Hunter and Welch were absent.
