AN OPD L14ANU AMENDING ORDINANCE NO. 2245-1967.
WHEREAS, The Board of Public Works and Safety did on the 28th day of Decem-
ber, 1966, enter into a Franchise Agreement granting unto Clearview Cable
of Richmond, Incorporated, the right to construct and operate a community
antenna television system in Richmond, Indiana., which Agreement was amended
on the 23rd day of December, 1971; again on April 18, 1974; and amended
again on the 29th day of April, 1976; and
Wf-IEREAS, on the loth day of February; 1967, the Common Council of the City
of Richmond, Indiana, passed and adopted Ordinance Number 2245-1967 approving
and confirming a franchise agreement granting Clearview Cable of Richmond,
Incorporated, an Indiana corporation, the non-exclusive right, privilege
and authority to construct, maintain and operate a community antenna tele-
vision system in the City of Richmond, Indiana, and
WHEREAS, said franchise was assigned with the consent of the Board of Public
Works and Safety of said City, to Clearview Cable TV, a joint venture, and
WHEREAS, Clearview Cable TV has petitioned the Board of Public Works and
Safety of said City for a redetermination of rates as set forth in Section 17
of the Franchise Agreement; and
WHEREAS, The Board of Public Works and Safety has had public hearings on this
request for a rate redetermination; and
WHEREAS, The Board of Public Works and Safety recognizes that since the grant-
ing of said Franchise for the construction and operation of a CATV system and
the amendments thereof, there have been substantial increases in costs of
construction, maintenance and operation of CATV; and
WITQMAS, The Board of Public Works and Safety has adopted a resolution finding
a rate redetermination warranted, which resolution and other information per-
taining to the proposed rate redetermination have been transmitted to the
Common Council of the City;
VOW, THEREFORE, BE IT ORDAINED BY THE COAMM COUNCIL OF THE CITY OF RICIDIOND,
INDIANA:
That the Board of Works and Safety is authorized and directed, in the name of
and on behalf of the City of Richmond, Indiana, to execute an Amendment to
Franchise Agreement dated December 28, 1966, as amended December 23, 1971,
as amended April 18, 1978, and as amended April 29, 1976, a copy of which
Amendment is incorporated herein, made a part hereof and marked "Exhibit A";
and
That Paragraph 9 d (1), (2), and (3) of said Franchise Agreement shall be
amended to read as follows:

(1976-1979) and .30 for the 3 satellite signals - WC-N -- 1VTCG and Nickelodeon.
IA. Converters $25.00 purchase at office with installation instructions. If CATV
installs $5.00 extra. Manufacturer's warranty $10.00 exchange after -warranty
period. Lease on converters is S1.25 per month including service and repair.

2. Commercial Patrons
Charges shall be negotiated between Commercial
Patrons and the Company and will be non-
discriminatory as between classes of

That all other terms and covenants and conditions of the said Franchise Agree-
ment dated. December 28, 1966, and as amended December 23,
1971, April 18, 1974,
and April 29, 1976, are to remain in full force and effect.
