HomeMy Public PortalAbout034-1979 - SPECIAL USE IN R2 ONE FAMILY RESIDENCE AND R3 EIGHT FAMILIY RESIDENCE FOR MEDICAL OFFICE;1824 CHESTER BOULEVARDAMENDED SPECIAL ORDINANCE NO. 34-1979 AN ORDINANCE AUTHORIZING A SPECIAL USE IN AN R-2 ONE -FAMILY RESIDENCE DISTRICT AND R-3 DNE-TO-EIGHT FAMILY RESIDENCE DISTRICT FOR A MEDICAL OFFICE ON PROPERTY LOCATED AT 1824 CHESTER BOULEVARD, PURSUANT TO ARTICLE 48 OF CHAPTER 22 OF THE MUNICIPAL CODE COMMONLY KNOWN AS THE ZONING ORDINANCE DF THE CITY OF RICHMOND, INDIANA. WHEREAS, Article 21 of Chapter 21 and Article 22 of Chapter 22 of the Municipal Code allows medical offices by Special Use authoriza- tion as provided in Article 48 of said Chapter; and, WHEREAS, a notice was given and a public hearing on this Ordinance was conducted by the Richmond City Planning Commission the day of 1979, at which time remonstrances were heard fr❑ all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond Planning Commission was to 0 in favor of/in opposition to recommending the passage of Ordinance No. 34-1979; therefore, BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. As provided in Article 21 of Chapter 21 and Article 22 and 48 of Chapter 22 of the Municipal Code, the following described use of the following described real estate is allowed as a Special Use for a business office at 1824 Chester Boulevard in the City of Richmond, Indiana; more particularly described; t0 wit: Being a Mart of the Northeast Quarter of Section 29, Township 14 North, Range 1 West in the City of Richmond, Indiana, and being more particularly described as follows: Beginning at a cut cross found in the east line of the North- east Quarter of said Section 29 and being the centerline of United States Highway Number 27, said point being 742.50 feet south of the cut cross found at the northeast corner of said Northeast Quarter, (assuming the said east line runs north and south), and running thence, from said beginning point, south, along said east line, 107.18 feet to a cross cut; thence west, along the north line of Lots 8, 9, 10, 11, and 12 of the Crestdale Subdivision, First Addition, 497.00 feet to an iron pipe found at the northwest corner of Lot 12 in said Subdivision; thence north 10 degrees, 02 minutes and 40 seconds west, 31ong the east line of said Subdivision, 185.50 feet to an iron pipe found at the north east corner of Lot 15 to the east line of said Subdivision; thence north 33 degrees, 21 minutes and 40 seconds west, along the east line of Lot 47, Third Addition of the Crestdale Subdivision, 178.00 feet to the pipe found at the northeast corner of said Lot_47; thence north 0 degrees, 07 minutes and 30 seconds west, along the east line of said Subdivision, 90.30 feet to an iron pipe set at the northeast corner of Lot 49 of said Subdivision; thence south 89 degrees, 30 minutes and 20 seconds east, 373.95 feet to an iron pipe set; thence south, parallel to the east line of said Northeast Quarter, 312.07 feet to an iron pipe set; thence north 89 degrees, 48 minutes and 30 seconds east, 253.50 feet to the place of beginning, containing an area of 3.580 acres. Subject to: The right--of-way of United States Highway Number 27, and any easements of record. SPECIAL ORDINANCE NO. 34-1979 Page 2 SECTION 2. As a condition of the aforesaid Special Use and as an additional restriction on said use, the following require, merits shall hereafter and at all times be mat by the owner, leasee or any person, firm or corporation using said real estate: a. The site plan accompanying the petition be identified as Exhibit "A" and made a part of Ordinance No. 34- 1979. b. The Special Use authorization shall be considered null and void should the Special Use cease for a period of one (1) year or more. c. The,site plan accompanying the Ordinance be amended or corrected to show the proposed improvement on the driveway and any improvement made to the drive- way be done in accordance with the standards set in the Zoning Ordinance, stand- ards set by the Board of Public Works and Safety, and standards set by the Indiana State Highway Commission. (d) The Special Use would preclude any access drive through the Special Use property to Valley Drive in the Crestdale Subdivision. SECTION 3. The Zoning Administrator of the City of Richmond, Indiana, is hereby authorized and directed, upon enactment and publica- tion of this Ordinance, to record and approve the issuance of a permit for the establishment of the use herein allowed. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval by the Mayor, and publication as by later required. The petitioner, William H. and Emma H. Rodefeld, c/o 828 National Road West, was represented by Robert G. Burton, Attorney, who requested Special Use authorization for a proposed medical office for the practice of obstetrics and gynecology to be located at 1824 Chester Boulevard.' Two persons were pre- sent who voiced their concern over the added traffic problems. Nineteen (19) letters had been sent to adjoining properties; none were returned in favor and two (2) in opposition. The Plan Commission voted eight (8) to zero (0) to allow this Special Use with the following conditions: (a) The site plan accompanying the petition be identified as Exhibit "A" and made a part of Ordinance No. 34-1979. (b) The Special Use authorization, shall be considered null and void should the Special Use cease for a period of one (1) year or more. (c) The site plan accompanying the Ordinance be amended or corrected. to show the proposed improvement on the drive- way and any improvement made to the driveway .be done in accordance with the standards set in the Zoning Ordinance, standards set by the Board of Public Works and Safety, and standards .set by the Indiana State Highway Commission.
