HomeMy Public PortalAbout09-09 Posting Notice for Special Meetings 1st Reading: 04/22/2009 2°d Reading: 0 5/1 3/2 0 0 9 Public Hearing:0 5/1 3/2 0 0 9 Adopted: 0 5/1 3/2 0 Q9 Effective Date: 0 5/1 3/2 0 0 9 Sponsor: City Attorney ORDINANCE NO. 0 9-0 9 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OPA-LOCKA, FLORIDA; AMENDING CHAPTER 2, SECTION 2-44 OF THE OPA-LOCKA CODE OF ORDINANCES ENTITLED "SPECIAL MEETINGS" BY AMENDING PROVISIONS RELATED TO POSTING NOTICE FOR SPECIAL MEETINGS OF THE CITY COMMISSION; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the Florida Constitution and Chapter 166, Florida Statutes, empower and authorize municipalities to revise, amend, restate, codify and compile existing ordinances; and WHEREAS, the City Commission of the City of Opa-locka ("City Commission") desires to amend Chapter 2 of the City of Opa-locka Code of Ordinances entitled "City Commission", by specifically amending Section 2-44 entitled "Special Meetings" relating to the City Commission of the City of Opa-locka("City"); and WHEREAS, the City Commission has determined that it will be in the best interest of the City to specifically amend Section 2-44 entitled "Special Meetings" relating to the City Commission. THE COMMISSION OF THE CITY OF OPA-LOCKA HEREBY ORDAINS: Section 1. The recitals to the preamble herein are incorporated by reference. Ordinance No. 0 9-0 9 Section 2. The City Commission of the City of Opa-locka hereby amends Chapter 2 Section 2-44 of the City of Opa-locka Code of Ordinances entitled "Special Meetings" as set forth herein: Sec. 2-44. Special meetings. (a) A special meeting of the city commission may be called either: By a majority of the members of the commission, the mayor or in his absence the vice-mayor, or the city manager. Whenever a special meeting is called, a notice in writing signed by the official or officials calling the meeting shall be served upon the city clerk. The city clerk shall within one hour thereafter, give both a verbal and written notice upon each member of the commission stating the date, hour and place of the meeting and the purpose for which such meeting is called. No other business shall be transacted at the meeting. At least twenty-four(24) hours must elapse between the time the city clerk receives notice in writing of the call of the meeting and the time the meeting is to be held. (b) Notice of any special meeting of the commission shall be posted by the city clerk simultaneously with service of notice on the city commissioners as follows: (1) Bulletin board located outside City Hall; (2) City-lib ; Any other location designated by the City Commission by resolution. • • • (3) If after reasonable diligence, it was impossible to give notices to each commissioner, such failure shall not affect the legality of the meeting if a quorum attends. The minutes of each special meeting shall show the manner and method by which notice of such special or emergency meeting was given to each member of the commission, or shall show a waiver of notice. All special meetings shall be open to the public and shall be held and conducted in the City Hall or other suitable city building. Minutes thereof shall be kept by the city clerk. Section 3. All ordinances or Code provisions in conflict herewith are hereby repealed. Section 4. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 5. This Ordinance shall, upon adoption, become effective as specified by the City of Opa-locka Code of Ordinances and the City of Opa-locka Charter.
