ORDINANCE NO. 77
AN ORDINANCE PERTAINING TO WATER SERVICE; APPLICATION
FOR AND VOLUNTARY TERMINATION OF SERVICE, ESTABLISHING
RATES BY RESOLUTION, PROVIDING FOR FEES, PROVIDING
FOR CHECKING METERS, PROVIDING FOR SHUTTING OFF WATER,
PROVIDING FOR TAKING WATER FROM HYDRANTS, ESTABLISHING
OWNERSHIP OF METERS, PROVIDING FOR UNLAWFUL MUTILATION
OF WATER PROPERTY, PROVIDING PENALTIES FOR VIOLATION
THEREOF, PROVIDING FOR ASSESSMENTS AGAINST REAL
PROPERTY FOR NONPAYMENT, AND REPEALING ORDINANCES
NO. 42, 62, AND 81.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL
AIRE, KANSAS.
Section 1. APPLICATION FOR AND VOLUNTARY TERMINATION
OF SERVICE
A. Whenever any person, corporation, partnership,
joint venture, or any entity shall request to purchase water
from the City of Bel Aire, Kansas they shall first be
required to make written application for such service in the
City offices upon a form furnished by the City Clerk for
that purpose. Failure to properly complete said form may
result in a refusal to furnish service to said applicant.
Upon completing said application and being furnished
service, the applicant therefore agrees to be responsible
for all payments due in connection therewith subject to all
conditions set forth hereinafter.
B. Voluntary termination of service will be effective
only upon written notice to the City made at the City Office
on a form provided by the City Clerk therefore. No other
voluntary termination notices will be effective. Applicant
will be responsible for all services rendered to the
effective date of such written notice.
Section 2. ESTABLISHING RATES BY RESOLUTION
Inside and outside City Water Utility Rates will be
established by resolution of the governing body. Any such
resolutions are hereby incorporated herein and made a part
of this ordinance as though set forth herein.
Section 3. INSTALLATION FEES
A. Inside City Limits.
Special meters, lawn sprinklers, etc., customer
requesting service will pay all expenses.
B. Outside City Limits
Cost plus basis. Customer requesting service will
pay all expenses.
Section 4. SIZE OF LINES
To be specified by City Engineer.
Section 5. CHECKING OF METERS
Cost of checking meters at customer request, if the
meter is pulled, tested and found to be in error and need of
repair, will be borne by the City. Should the meter be
accurate, a fee of $25 will be charged to the customer
making the request.
Section 6. SPECIAL METERS
Entire expense will be paid by the resident or property
owner.
Section 7. SWIMMING POOLS
The City will not at any time fill private swimming
pools from hydrants.
Section 8. DELINQUENT PAYMENTS
A ten percent (10%) fee will be added to the unpaid
balance each month as a "late charge." This will be the
policy unless prior arrangements have been made with the
Ci ty Clerk.
Section 9. SHUT OFF NOTICES
Water service will be terminated for nonpayment upon
notice to the customer at the billing address when the bill
has been unpaid for fifteen days from the date the bill is
mailed. A reconnect fee of $}O will be charged before water
service will be reinstated in addition to delinquency
charges.
When any customer has been previously notified of a
delinquency as set out herein and is delinquent a second
time, requiring notice, a $50 deposit will be required to
continue water service. Upon second notice, the water meter
will be pulled and not replaced until the deposit is paid in
full; Upon terminating the service, the deposit will be
returned to the customer together with interest at the
statutory rate less any outstanding water charges due to the
City.
Section 10. CHECKS RETURNED FOR INSUFFICIENT FUNDS
A $10 charge will be charged back to the account for a
check returned for insufficient funds.
Section 11. CONNECTION FEE
A $20 connection fee will be charged to each new
applicant, when they require water service from the City of
Bel Aire.
Section 12. TAKING WATER FROM FIRE HYDRANTS
It shall be unlawful for any person or persons
unauthorized by the City of Bel Aire to take water away from
any watering places or plugs, draw cock, or hose pipes
except for fire purposes, and for use of fire department in
case of fire or in any way use or take away any water for
private use without first paying and receiving receipt.
Section 13. SHUTTING OFF FOR REPAIRS
The City of Bel Aire reserves the right at any time to
shut off the water in their mains for the purpose of making
repairs or extentions or for other purposes, and City shall
not be liable for any damage by reason of the breakage or
repair of any pipes by reason of the stoppage of the water
in said Ci ty mains ,nor shall the Ci ty be responsible for
any damage caused to any homes, businesses, or personal
property due to routine repair or maintenance of the city
water system.
section 14. WATER METERS OWNED BY CITY
Water meters are owned by the City of Bel Aire and
shall not be tampered with or the seal broken except by a
duly authorized employee of the City Water Department.
section 15. MUTILATION OF WATER PROPERTY
It shall be unlawful for any person to remove,
obstruct, alter, or injure any fire hydrant, valve, valve
box, or cover, or in any manner injure any building,
machinery, or other implements belonging to the water works
system of the City of Bel Aire.
section 16. PROPERTY ASSESSMENT FOR NONPAYMENT
Any payments or fees due the City under this Ordinance
which remain unpaid for a period of 60 days from the date of
termination of services will be assessed against the real
property at which the services were provided. The City
Clerk shall notify the County Clerk to place any such unpaid
balances on the tax roles.
Section 17. PENALTIES
Any person violating any of the provisions in this
Ordinance upon conviction shall be deemed guilty of a
misdemeanor and shall be punished by a fine of not more than
$500 or, confinement for not more than one year or both such
fine and imprisonment.
Section 18. REPEAL OF ORDINANCES NO. 42, 62, AND 81
ordinances number 42, 62, and 81 of the City of Bel
Aire are hereby repealed.
Section 19. INVALIDITY OF ANY PORTION OF THE ORDINANCE
Should any portion of this Ordinance be found to be
invalid for any reason, it shall not effect the validity of
the remaining parts of this Ordinance and the same shall be
in full force and effect.
Section 20. EFFECTIVE DATE
This Ordinance shall take effect and be enforced from
and after its publication in the official city newspaper.
