The following members of Council were present: James Burke, Jack Youmans, Shirley Sessions, Anne Monaghan, Pamela O'Brien and Mallory Pearce. City Manager Tom Cannon was present. The Reverend Lee Bennett gave the invocation that was followed by the Pledge of Allegiance. Mayor Parker told everyone that Lee was being transferred to Macon. Parker presented Lee Bennett with a plaque from Council stating that Lee has attended just about every Council meeting and has prayed over us and asked the Lord for divine guidance to help us in our decisions. Parker said that Lee has been a good pastor. Lee told Council and the audience that he has loved living on Tybee and has made and will remember all of the good friends he has made. Mayor Parker introduced Attorney Dana Braun who is representing the City tonight because City Attorney Hughes is on his honeymoon. The Southern Company of Energy Solutions gave Council information on how to save money on the electric bills. The company's representatives are working with Cannon and with Davies when he comes to work on conservation issues. A copy of hand out will be placed in the Council file folder. Eric Thomas, Huc- A- Poo's, told Council that they were called here because of a misunderstanding. Thomas said that they goofed up; we are new at this and are learning as we go. Thomas said that when they renewed their license for 2001 that $50.00 was added on for the live music fee. Thomas said that there has only been one fight, that they have games for kids, poetry readings and movie night during the week. Thomas stated that the problem is lack of communication; they want to hear the concerns of the neighbors. The police come and tell us to turn down the music and we do. They have met with Cannon and got some good ideas, have tried to confront Loretta and she does not want to talk with us. There have been 4 bands so far and they have shut down at 11 or 11:30 P.M. when we could go until 2:45 P.M. Thomas said that they coach at St. Michaels' and help out at the YMCA. Parker asked Thomas to coordinate through Cannon and meet with the neighbors. Burke said that the first license was for a deli and they are a long way from that type of food. Thomas said that they have good food. Burke said that Council was deceived in the beginning. Thomas said that they did not lie. Sessions said it sounds as though that they followed the 1s` license but when renewed that got live music license. Monaghan said no. O'Brien said a ragae band played in November. Sessions asked that we try to work it out. Shep told Council that you can have 12 special events per year. Parker again stated the people involved need to get together. Sessions said the City needs to be involved. Youmans said a permit/license for live music does not come before Council for approval or denial. Parker answered correct but the incident in November should have set red flags. Mary Pitts asked if it does not fall under public nuisance? Pitts said process was not followed when issuing license so it is null and void. Braun answered that he cannot comment at this time but will look into the issue — if the issue is to revoke a license then there is a process that must be followed. Pitts told Council of the elderly and sick that live over by the establishment in a residential district. A discussion was held on the rezoning being null and void — Pitts; O'Brien agreed with Burke about being misled; asked what are we reviewing this 1 1 evening — O'Brien; Braun answered correspondence from Cannon on the noise issue — not here for consideration to revoke license — there is a process with evidence being provided - property rights in this license - formal notification; Gather information — Parker; Show cause — Braun. Pitts asked that the harassment at my house be stopped and that she objects to the loud music, find it very unfair. Rachel Perkins requested that Council look into reestablishing public access by Lighthouse Point Condo. There is an agreement between the City and Lighthouse Point that is recorded that states a five -foot easement. Parker said he will ask the City Attorney to look into this issue. Perkins said people used to be able to park along Polk Street and that now there are no parking signs posted on that street. City funds are being spent to study North Beach and the public needs access to that area. John O'Neill addressed Council about the drainage over on Bay Street stating that there has been a miscommunication. O'Neill said he tried to come up with a alternate plan but has since gone back to the original but would like to request that Council flip over the drainage to the east side of the property and that he has a price to get the work done. O'Neill asked that Council call off the City Attorney while he gets this worked out. Parker asked how much slack time. O'Neill answered as much as I can get a couple of weeks at least. McAfee said plans will have to be redesigned. Monaghan stated this came up a year ago, and why did it not go back to Planning Commission with new drainage plans? O'Neill answered he would welcome that idea. O'Neill asked why no one called him, that he found out about this from McAfee. Youmans said this is the new Tybee, the old Tybee is gone. Sessions said that Hughes made attempts to contact you. Henry Levy said that the information from CUTS that Council requested was put in their boxes. Beach task recommendations are as follows: 1. Immediate funding of the Erik Olsen proposal for permitting, engineering, and project management. 2. Pursue obtaining approval from cognizant agency that will manage this funding to expend funds prior to July 1, 2001. 3. Urge Mayor Parker, Burke Day, Eric Johnson and Jack Kingston to work toward getting the language changes to meet the needs of the Island. More discussion was held on the MRS lease. Brown said a clean copy came in this week to Tom Cannon. Parker said nothing has changes. O'Brien asked about her letter of April 17th. Parker said it was taken into consideration. Braun said that action on this agreement has already been approved and it is not an issue to action by the Council. Russell asked if the only change was the out of pocket expense. Russell also told Council that the MRS was trying to get grant money to help with the construction of the building. O'Brien asked about the building plans. Russell said he delivered another set this week to City Hall. Parker said the agreement will be signed tonight. Keith Gay commended City Manager Cannon for a job well done with Orange Crush. Parker said that Cannon, Chief Price and DPW all did a great job. Mayor Parker opened, asked for comments, and closed the following public hearings according to the laws that govern the hearings. Mary McCarthy petitioned Council for a variance for continuance of non- conforming use with the addition of a 20 X 30 addition at 1603 Butler Avenue PIN 4 -8- 18-3. Levy said the Planning Commission vote unanimous for approval. Jack Rosenberg thanked Council for the opportunity to be here and request a variance of a setback of 10 feet in order to place his front stairs at 204 14th Street PIN 4- 1 7 -18 -1. Rosenberg said he purchase the property in 1999 and in 2001 was told that the Land Development Code had a quirk concerning comer lots. Rosenberg stated that if he had to have the 2 20 -foot setbacks that his home would only be 14 feet wide. Letters from all adjacent property owners are in support of the variance. Sessions said that comer lots are addressed in the subdivision ordinance and asked Cannon and McAfee where is the other hidden. McAfee answered in the schedule of development. Levy said Planning Commission voted 7 in favor of the variance and 1 abstained. Mayor Parker opened the meeting for business legally presented. Pearce moved to approve the April 12th minutes as presented. Monaghan seconded. Vote by Council was unanimous. It was agreed that the City Attorney would research the beach access at North Beach. Monaghan moved to send the drainage request by O'Neill for Bay Street to the Planning Commission. Pearce seconded. Vote by Council was 5 in favor; 1 abstained (O'Brien). Pearce moved approval of the nonconforming use variance for McCarthy at 1603 Butler. Monaghan seconded. Vote by Council was unanimous. Youmans moved to approve the setback variance request of 10 feet fronting 14th Street from Rosenberg at 204 14th Street. Pearce seconded. Vote by council was unanimous. O'Brien moved to have Cannon approach Huc -A -Poo's and get an agreement for acoustical entertainment. Monaghan seconded. Vote by Council was unanimous. Burke moved to adopt the resolution for the painted bunting as the official bird of Tybee Island. Monaghan seconded. Vote by Council was unanimous. Pearce explained and moved for adoption of the resolution for Rosewood Park and Sally Pearce Nature Trail to be permanently protected as a conservation easement in order to get grants. Monaghan seconded. Youmans said that the first trail was Blue Heron. Pearce moved to amend his motion by adding the Blue Heron Trail. Vote by Council was 4 in favor (Sessions, Monaghan, O'Brien and Pearce); 2 opposed (Burke and Youmans). Action Items: O'Brien asked if the work for the bike path through Memorial Park will be done in house by DPW? Youmans asked that Council read the article in the Georgia Cities concerning skate parks. Mr. Davies will work on the long -term dune protection ordinance. Cannon told Council that he sent Hughes a draft for the referendum on the gym pool question by increasing the mileage. O'Brien asked for money amount of capital and operating expense. Braun explained that you cannot have a poll on the ballot, but you could have a separate survey done by someone. Monaghan said that number 12 survey for the 4 lanes of Tybee Road fits with the master plan. Section 2 -1 -1 Compensation for Mayor and Council — leave as is. Day and Johnson are doing a special study on the video poker issue. Hughes is working on the 4- year staggered terms of office. Safety issue Highway 80 — O'Brien speed limit should be dropped to 35 when coming on to the island. Session said this is truly a serious and dangerous situation. Parker said you must requests speed limit changes from DOT. Monaghan asked about a turning lane by 12 Oaks. Sessions asked Parker if he agrees with the concerns. Parker answered yes. Cannon said he will speak to the chief. Cannon presented Council with a list of the goals for 2001. Burke said he talked with Tom Coleman, Commissioner of DOT and he asked about a medium in the middle. Parker said he forwarded the letter from Harry Spirides to Dr. Stuart Stevens of the Department of Natural Resources. Sessions told Council that she spoke with Dwayne Harris and the sand dunes are out first line of defense. 1 1 1 Council agreed to have Mayor Parker sign the Local Government Participation Agreement with DOT for the signal design. Correspondence from Cal Looper thanking Mayor and Council for the support given to the Tybee Senior Games 2001 held in Jaycee Park. O'Brien said information was placed in each members box on May 1st concerning the Post Theater. O'Brien thanked Angela Byers, Shirley Sessions, Tom Cannon, Jim Kluttz, Frances Grayson, Cullen Chambers, Debbie Robinson, Barry Finch, Marlboro Packard, and Gloria Bennett for all heir had work and dedication. Jim Kluttz informed Council that at a special meeting of the Historic Society that it was voted on for the society to purchase the Post Theater on its own. Hughes will give an legal opinion on what step is next when he gets back because the sooner we purchase the sooner we won't have to pay the rent. Monaghan asked if we are at the end of the moratorium? Cannon answered yes May 12th is the 93rd day. O'Brien asked what have we done. Cannon answered quite a bit, the letter to H.G.B. &DeY. is finished by McAfee and will be in your boxes tomorrow. One we have looked at gaps and flow charts; two we are doing a build out by having each lot under current zoning counted and looked at to determine what can be built. Rachel Perkins counted each street. The next step is commercial. Cannon told Council that McAfee will be out of the office twice a week where no phones will disturb him while he is working on this issue. We will have a better base for the long -term growth issue. Pearce asked if Council could extend the moratorium? Braun asked that Council speak to Hughes when he gets home. Pearce moved to advertise for the extension of the moratorium holding the public hearing at he June 14th Council meeting. Sessions seconded. Vote by Council was 4 in favor of the motion (Sessions, Monaghan, O'Brien and Pearce); 2 opposed (Burke and Youmans). While discussing the toll for Tybee it was noted that Monaghan has a file on this issue. Levy the Planning Commission has been looking in to this and that we need some one who understands the issue — this could be a 5 to 8 years project. Cannon will speak with James Brown of DOT concerning the crosswalks and ask Brown to go see the barrack area at Fort Stewart. Youmans asked Cannon to let Mayor Adams know when he has the solution for this problem. Sessions asked about the beach rules signs. Cannon answered that DPW has started lowering sign at the north end and are moving south. After a lengthily discussion on the beach equipment ordinance it was agreed upon to leave as is for the time being. Cannon will look at the agreement with Sea Breeze Water Sports. Parker said that there is no problem is we just follow the ordinance. Cannon said business owners would like to have the city look into public transportation. This would be a cheap way to get their employees to and from work. Cannon said Michael Gibboni will investigate water and sewer lines in private drives. Cannon stated that he is still working on the residential parking zone ordinance. Cannon said that in a letter from Bill Farmer he requested that the cap for the number of meetings he attends be lifted. Cannon said he is not comfortable in doing this - need to see what are the benefits to Tybee — also more detail reports from Farmer on the meetings he does attend for Tybee. O'Brien asked that a transition plan be submitted with recommendations from Cannon; what are the most important meetings; reusing of the dredged sand. Youmans asked when Davies was coming to work. Cannon said on 1 1 the 14th. Youmans suggested that Davies attend the meetings with Farmer. Frieda Rutherford explained the 2 issues from Farmers meetings. 1. Interfacing with the CORPS for the sand — Fort Pulaski — Doug will include but the sand is not shoaling — sand point is 0 out in ocean. 2. Stakeholders — includes damages to the beaches because of the dredging. Youmans said the CORPS knows that putting the dredged sand on our beach is cheapest way to go. Pearce moved to adopt Section 10 -1 -26 Regulations of Parking in Individual Parking Spaces on its second reading. Monaghan seconded. Vote by Council was unanimous. O'Brien moved to adopt Section 10 -1 -43 Parking Lots on its second reading. Monaghan seconded. Vote by Council was 5 in favor (Burke, Sessions, Monaghan, O'Brien and Pearce); 1 opposed (Youmans). O'Brien moved to adopt Section 2 -5 -2 Court Costs on second reading. Pearce seconded. Vote by Council was 5 in favor (Burke, Sessions, Monaghan, O'Brien and Pearce); 1 opposed (Youmans). Pearce moved to adopt the ordinance on the Beach Task Force on second reading. Monaghan seconded. Vote by Council was unanimous. O'Brien said they must conform to the open meeting rules just like all other committees and boards appointed by Council. George Van Luven of GMA explained the liability insurance to Council concerning elected officials. Van Luven said Councils go to great pains to hire a City Attorney, to have professional staff and it is their job to keep you on track — follow recommendation of staying within confines of your scope of authority and you will have official immunity — the City has insurance to protect you. O'Brien questioned the letter from Parker to Chatham County Commission Chair Billy Hair concerning the pavilion stating that she hoped it had not been mailed. Parker answered that yes it had and Council got a copy to let you know that I was going to talk to Hair. O'Brien said a cost analysis needs to be done. Youmans said Parker cannot do anything by himself it must come before Council for a vote. Sessions stated that she would have liked to have a chance to discuss the issue before the letter was mailed. O'Brien asked why a letter concerning Beachside Colony dated February 13m 2001 about the approved hotel suites now being turned in to condos has just been received by Council. Cannon explained that condos have more setback standards and that Council voted for hotel suites. O'Brien stated that she does not believe that Hughes has the authority to change hotel suites to condos. Braun answered he did not know why the letter did not reach Council until now but Hughes intent was there by the CC: Mayor and Council. Sessions asked about the last paragraph. McAfee said that the parking is in the basement. Parker requested that Cannon and McAfee check on the entire situation since there has been changes in the restaurant, the addition of the deck — how does all of this effect parking requirements. Sessions moved go into executive session to discuss litigation and personnel. Pearce seconded. Vote by Council was unanimous. Sessions moved to reconvene the regular meeting, with Burke seconding. Vote by Council was unanimous. Pearce said that there is some unclaimed property over by Lighthouse Point that he would like the City Attorney to lay claim to for the City. 1 As there was no further business to come before Council the meeting was adjourned. Please contact June Johnson and let her know if you anticipate problems in meeting these deadlines. When I return on June 4th, we will discuss any adjustments that must be made. 1 1 1 2001 Goals for Tybee Island, GA Time lines for Implementation Goal #1: Operational Accountability & Enforcement This goal consists of three parts, as follows: • Code Enforcement • Refinement of Zoning Procedures • Completed Applications & more effective public hearings. Timeline for each part is as follows: Code Enforcement: • By 1 June 2001: Total revision of Chuck's job - description. • By 1 June 2001: Plan due from the appropriate department head on their portion of ordinance enforcement. • By 1 July 2001: Inclusion of enforcement activities in monthly activities report to Mayor and Council. Refinement of Zoning Procedures: • By 15 May 2001: Adoption of and communication to all applicants of new policy. This policy will state that no land use action will move forward without a completed application and supporting paperwork. 1 1 1 • By 15 June 2001: Development of first draft of a simple, user- friendly application and standard procedures /process. This draft to the planning commission for their suggested changes and revisions. • By 15 July 2001: New application and SOP in place and being used. Completed Applications & more effective public hearings: • By 15 June 2001: First draft of policy concerning citizen input at hearings sent to Planning Commission for their review and suggestions. • By 15 June 2001: First draft of policy to specifically limit public hearings to policy issues sent to Planning Commission for their review and suggestions. • By 15 July 2001: New policies in place. Goal #2: Land Preservation This goal consist of seven parts as follows: • Identifying state revenue sources. • Identifying physical areas to preserve. • Writing of a long -term land preservation plan. • Writing of an eco- tourism plan. • Identify private, corporate, and federal grant opportunities. • Prepare an educational and PR plan on the value of land preservation. • Establish trails and corridors linking the existing public green spaces on the island. 1 1 Time line for each part is as follows: Identifying State Revenue Sources: • By 1 June 2001: Contact DCA and GMA for a listing of state revenue sources available to municipalities. • By 15 June 2001: Review eligibility requirements. Identifying Physical Areas to Preserve: • By 1 June 2001: Review "green space" maps and identify open spaces adjacent to public lands. • By 15 June 200.1: Identify and prepare initial linear park connections between public lands. Writing of a long -term land preservation plan: • By 1 July 2001: Prepare an outline of what needs to be in such a plan. • By 15 July 2001: Contact MPC and private organizations for their inputs /ideas on a suitable plan. • By 15August 2001: Put out a call for citizen's volunteers in writing the plan. Prepare a public meetings schedule. • By 15 November 2001: Finish meetings schedule for information gathering. • By 15 January 2002: Finish first draft of plan. Put out for public review. • By 15 March 2002: Finish plans and send to council for approval. 1 1 Writing of an Ecotourism Plan: • Same timeline as for long -term preservation plan, with only the specific involvement of the Savannah Convention and Visitors Bureau, and the Tybee Tourism Council, as significant differences. Identify private, corporate, and Federal grant opportunities: • By 15 August 2001: Review and identify private, corporate, and governmental grant opportunities. • By 15 October 2001: Communicate with 10 best candidates in each category as to what funding they have available and how well Tybee Island qualifies in a particular category. Prepare an Educational and PR plan on the value of land preservation: • _By 15 November 2001: Prepare this plan by eliciting support during the summer public meetings. • By 15 December 2001: Finish first draft and get council input. • By 15 January 2001: Release plan Establish trails and corridors linking the existing public green spaces on the island: • By 15 March 2002: Same time line as writing of long- term land preservation plan. 1 1 1 Goal #3; Establish a 15 -Year Financial Plan; • By 15 July 2001: Query all department heads as to long -term capital needs. • By 15 August 2001: Finish first draft of plan and send to council and accounting firm for review. • By 15 October 2001: Publish final plan, starting in 2002, and going to 201Z Goal #4: Conduct an Annual Survey of Residents; • By 15 July 2001: Finish first draft of survey questions and send to council for their input and review. • By 15 August 2001: Send out annual survey. • By 15 September 2001: Publish results in The Tybee News. Goal #5; Update the abbreviated version of the Tybee Island Master Plan; • By 15 July 2001: Contact MPC and find out their timeline in producing the overall Chatham County master p /an. • By 15 March 2002: Same time fine as the land preservation goal. 1 Goal #6: Implement Internal Control Audit Recommendations: • By 15 August 2001; Implement all internal control audit recommendations in the Finance Department. • By 15 September 2001: Implement recommendations in all other departments. • By 15 September 2001: Implement all recommendations for 2000 regular audit in all departments. The above timelines were distributed to the department heads with the instructions to determine if they could meet their portion of the timelines in each goal. Section 10 -1 -26 is hereby amended to read as follows 10 -1 -26 REGULATION OF PARKING IN INDIVIDUAL PARKING SPACES (a) Whenever a vehicle shall be parked in an individual parking space, where a parking meter has been installed, the person parking that vehicle shall deposit one (1) or more quarters of United States money in that parking meter, if any meter displays the signal showing that legal parking is only permitted on such deposit. Section 020. NAME: The name of the committee shall be "The Tybee Island Beach Task Force" and is hereinafter referred to as the "Task Force ". Section 030. MEMBERSHIP: The beach Task Force shall consist of not less than ten nor more than twenty members appointed by the Mayor and Council, such appointees being. selected on the basis of their knowledge and interest in protecting and promoting the natural characteristics of Tybee Island, especially its beaches and shorelines, to serve three (3) year terms with a maximum of two successive appointments.
