AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OPA-LOCKA, FLORIDA; AMENDING CHAPTER 2,
ARTICLE I, SECTION 2-8.4 OF THE OPA-LOCKA CODE
OF ORDINANCES ENTITLED "SEARCH COMMITTEE
ESTABLISHED" BY PERMITTING THE CITY
COMMISSION TO SERVE AS THE SEARCH
COMMITTEE; PROVIDING FOR INCORPORATION OF
RECITALS; PROVIDING FOR CONFLICT AND
REPEALER; PROVIDING FOR SEVERABILITY;
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, municipalities may enact reasonable regulations to promote the health,
safety and welfare of citizens; and
WHEREAS, the City Commission of the City of Opa-locka ("City Commission") desires
to amend Article I, Chapter 2, Section 2-8.4 of the City of Opa-locka Code of Ordinances
entitled "Search Committee Established" to permit the City Commission of the City of Opa-
locka ("City Commission") to serve as the search committee for purpose of soliciting and
screening the positions of City Manager, City Attorney and City Clerk; and
THE COMMISSION OF THE CITY OF OPA-LOCKA HEREBY ORDAINS:
Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The City Commission of the City of Opa-locka hereby amends Chapter 2,
Article I, Section 2-8.4 entitled "Search Committee Established" as set forth herein:
Sec. 2-8.4. Search committee established.
(a) There is shall be established a five-member search committee for the purpose
of soliciting, screening and recommending, when applicable, candidates to--the
city commission for the positions of city manager, city attorney and city clerk.

(b) The mayor and each commissioner shall appoint one member to the
committee shall mean the city commission or any other such committee
designated appointed by the city commission to solicit, screen and recommend
candidates for the positions of city manager, city attorney and city clerk. The
committee shall elect a chairperson and determine its meeting dates and times.
The committee shall notice and conduct its meetings in accordance with the city's
Charter and Code, and applicable federal, state and local laws. If the city
commission decides to appoint a search committee, Tthe name[s] of the
appointee[s] of the mayor and each commissioner shall be submitted to the city
clerk not later than ten (10) days of the position becoming vacant.
(c) The search committee shall make every effort to conduct a thorough local
and nationwide search for candidates for [the] positions of city manager, city
attorney and city clerk.
(d) In conducting its search for candidates and in making recommendations to
the city commission, the committee shall use, at a minimum, the qualifications for
the positions contained in Articles III, V and I, III and V, respectively, of the City
Charter as the criteria for evaluating each candidate.
(e) The committee shall convene and conduct its search and make a
recommendation, if applicable, of no more than five (5) candidates for the vacant

such time as the city commission makes appointments to the positions of city
manager, city attorney and city clerk.
Section 3. All ordinances or Code provisions in conflict herewith are hereby
repealed.
Section 4. If any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining portions of this Ordinance.
Section 5. This Ordinance shall, upon adoption, become effective as specified by the
City of Opa-locka Code of Ordinances and the City of Opa-locka Charter.
