Adjournment TIFFIN CITY COUNCIL REGULAR MEETING Mayor Phillips called meeting to order at 6:32 pm on Wednesday, October 12, 2011 at Springmier Library. Roll Call of members present: Chris Ball, Jim Bartels, Mark Petersen and Travis Weipert. Absent: Mike Gericke. Also present were Attorney Steve Greenleaf, Engineer Doug Frederick, Brett Mehmen, Public Works, Peggy Upton, Planning &Zoning and City Clerk Ruth Demuth. Motion by Bartels and seconded by Weipert for approval of Agenda. All ayes. Absent Gericke. Community Forum: Resident mentioned that gravel was washing down from the north on the east side sidewalk at corner of Goldfinch Dr. and Roberts Ferry Rd. Mayor Phillips asked Public Works Brett Mehmen to check into situation and report back. Mayor Phillips reported on planning by Tiffinfest Committee for 2012 celebration. Committee meetings would now be held every third Wednesday of month at the Springmier Library at 7:00pm. •■ Johnson County Sheriff Deputy inquired of Council members of any concerns. Inquiries made on calls made to local schools. Gratitude extended to department for resolution of recent cases in city. Motion by Ball and seconded by Weipert for approval'of minutes to September 14 and 28, 2011 meetings. All Ayes. Absent Gericke. Motion by Weipert and seconded by Bartels for approval of Receipts and Expenditures. Inquiry made of and discussion held on expenditures and insurance reimbursement on water plant motor damage and repairs.Three Ayes. Nay: Petersen. Absent: Gericke. Old Business: Motion by Weipert and seconded by Ball to open Public Hearing for the Woodfield Ridge Outlot B Retention Pond Land Conveyance. All Ayes.Absent Gericke. Mayor Phillips invited members of the Public for comments regarding city owned land possibly being conveyed to the landowners adjacent to the retention pond. Residents inquired on status of grading and progress of remediation work. Engineer Frederick replied that the repairs to the outlet structures and dredging the pond of fill was completed and that grading was not completed and that finish grading and seeding would be completed in spring of 2012. Contractor and Engineer prefer finish work in spring to avoid winter erosion. Council members asked Engineer to monitor progress of contractor. Inquiries were made on the value of the land. Attorney Greenleaf stated that Council will need to arrive at a"fair market value" and method of calculating values. Council persons suggested setting cost of land at .01 per square foot. Residents felt this was a fair and just cost for th&value of the land. Resident inquired on the city mowing and maintaining the 20' easement on the south side of the retention pond. Council members asked Public Works to make sure easement would be maintained by the mowing contractor. Discussion held on the area or areas that adjacent landowners may choose not to purchase. Attorney did report that neighbors did have the right to purchase those sections. Motion by Weipert and seconded by Bartels to close Public Hearing. All Ayes. Absent Gericke. Motion made by Petersen and seconded by Weipert to instruct Attorney to proceed with offers to sell land adjacent to the Retention Pond to landowners for the cost of.01 per square foot'and landowners to pay recording fees. City will make a 270 day offering period and purchase offer will need to be a 100% acceptance of offers. All Ayes. Absent Gericke. Motion by Ball and seconded by Weipert to read Resolution 2011-47 by title only. Motion by council person Ball and seconded by Council person Weipert to introduce for approval Resolution 2011-47 Resolution Approving Entering Into Contract with MSA Consultants Professional Services Agreement for Fringe Area Planning.All Ayes. Absent Gericke. Motion by Weipert and seconded by Bartels to approve Public Measure for Mayor Term to be included on the 2013 election ballot for public vote. All Ayes. Absent: Gericke. Motion by Bartels and seconded by Weipert to renew Real Estate contract with Tracy Reiten, Lepic-Kroeger`Realtors for another six months with no changes in terms for the city owned lots in Timber Ridge Estates Part Two. Decision to renew was decided at the September 28, 2011 Work Session. Discussion held. Three Ayes. Nay: Petersen. Absent Gericke. New Business: Motion by Weipert and seconded by Bartels to invest$500,000 new tax appropriation funds in CD's at U of I CCU at a rate of 1.35%. Investment Committee presented to Council members a listing of six financial institutions and current rates for review. Extensive discussion held. Three Ayes. Nay: Petersen. Absent: Gericke. Engineer Frederick presented updated information from Metro Planning Organization of Johnson County and IDIOT Traffic Study for decisions to be made on Ireland Ave and Hwy 6 Intersection Design. District IDOT still needs to approve -four way stop at Intersection before proceeding with plans. Attorney Greenleaf and Council person Bartels reported on meetings with affected landowners regarding acquisitions of land adjacent to the Ireland Avenue Extension Project. Motion by Weipert and seconded by Bartels to read Resolution 2011-49 by title only. Motion by Council person Weipert and seconded by Council person Bartels to introduce for approval Resolution 2011-49 Authorizing Payment for the Tree and House Removal for 251 &301 W Marengo Rd.for the Ireland Avenue Extension Project to Neuzil &Sons, Inc.for$23, 878.00. All Ayes. Absent Gericke. Public Works Mehmen reported completion of the waterline and valve box repairs at 320 Railroad St. by Freeman Construction. Inquiry made on the timeline for disposal of the 320 Railroad St. property. I _ Motion made by Bartels and seconded by Weipert to approve Tiffin Fire Dept to use house for training purposes. All Ayes. Absent Gericke. Mayor requested prior notification of date and time before training exercise. Discussion held on the requests for the sale of the garage doors. Motion by Ball and seconded by Bartels to authorize City Clerk to sell garage doors for fair market Palue. All Ayes. Absent Gericke. Engineer Frederick requested approval for Change Order#1 for Asphalt on Trails Phase Four at Jasper Avenue trail crossing. Motion by Weipert and seconded by Bartels to approve Change Order#1 for Trails Phase Four. Motion by Weipert and seconded by Petersen to read Resolution 2011-48 by title only. Motion by Council person Weipert and seconded by Council person Bartels to introduce for approval Resolution 2011-48 Approving Payment to Metro Pavers; Inc for Trails Phase Four Pay Estimate#2 for$25,814.28. All Ayes. Absent Gericke. Council members requested Financial Consultants, Northland Securities, placed on October 26, 2011 Work Session for discussions on financing Capital Improvement Projects. Proposals for planning and construction of Water Storage and Pressure Upgrade from four Engineering and Consulting firms'placed on October 2011 Work Session for review and discussion. Discussion on Village Pointe held. No formal action taken regarding preliminary plat or re-platting of Villages. City waiting for information from Attorneys on proceeding with Villages Development. Attorney Greenleaf explained his concerns of the future selling of Villages land and has asked the Planning and Zoning Commission to review the Sub-Dividers Ordinance 1998-218 and recommend revised language for future developments. Mayor Phillips inquired on steps city should take to eliminate title possession concerns in future. Request made to Attorney Greenleaf to develop legal document for city to approve at November 9, 2011 regular City Council meeting. Mayor Phillips updated Council members on Tiffin'Community Fund progress in planning next picnic shelter in City Parks. Inquiries made on planning for future concessions and restrooms at City Parks. Mayor Phillips explained that until Iowa DNR and Federal LawCon release the land at City Parks in exchange for wetlands in Villages Development no enclosed structures can be built on'the City Park land. Attorney reported that land from Villages has not yet been deeded over to the City. Information from the Johnson County Board of Supervisors presented to Council members regarding the update to the 28E Agreements for Library Services. Council members received a request from the Springmier Library for the purchase of computers. Council person Weipert representing the City on the Library Board suggested the request be reviewed by the Library Board and that such requests should already be inclusive in the 2011-2012 Library Budget.` City Clerk/Treasurer updated the Council members an the progress on installation of municipal and utility software and city funds balanced. The City Clerk reported on complaints received from residents who were upset and fearful of the city election campaign literature and post cards they have received via email or mail. Mayor pro-tern Ball reported on meetings with MPO Planning regarding future funds for road improvements for economic development. Motion by Weipert and seconded by Ball for .dj•urnmen . 8:3-p .
