HomeMy Public PortalAboutResolution 61-143RESOLUTION NO. 61 -143 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, DENYING A SPECIAL USE PERMIT TO GEROGE E. AND GRACE L. RUST TO EXPAND THE EX- ISTING REST HOME FACILITIES AT 5610 MCCULLOCH STREET, TEMPLE CITY, CALIFORN- IA, FROM 9 BEDS TO 20 BEDS THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: WHEREAS, George E. and Grace L. Rust, hereinafter referred to as Applicant, filed on March 30, 1961, an application for a spec- ial use permit, requesting permission to expand the existing rest home facilities at 5610 McCulloch, Temple City from 9 to 36 beds, and WHEREAS, on April 17, 1961, after notice duly given pursu- ant to law, a public hearing was held before the Planning Commission on April 17, 1961, at the hour of 7 :30 P. M., and following due de- liberation, by Resolution No, 61 -2 PC, said Planning Commission de- nied Applicant a special use permit for a 36 bed facility, and WHEREAS, on April 24, 1961, a public hearing was held be- fore the regular meeting of the City Council of the City of Temple City, at the hour of 7:30 P. M., at which time and place Applicant submitted a request for expansion from beds to 24 beds, which re- quest, constituting a substantial change from the request submitted to the Planning Commission of the City of Temple City, was by minute order of the City Council of the City of Temple City referred back to the Planning Commission for Public Hearing to be set for May 15, 1961, and WHEREAS, on May 15, 1961, after notice duly given, pursuant to law, a public hearing was held before the Planning Commission on May 15, 1961, at the hour of 7 :30 P. M., and WHEREAS, the Planning Commission adopted its Resolution No. 61 -3 PC, recommending the granting of a special use permit sub- ject to the following conditions: 1) That the Dumber of patient beds shall not exceed 20. 2) That a minimum of 20 car spaces developed to standards specified in the Temple City Ordinance shall be provided. 3) That parking area and access thereto shall be paved with asphaltic concrete or equal surfacing and the minimum width of paving on access driveways shall be 10 feet on one -way and 18 feet on two -way driveways. 4) That a solid concrete block or masonry wall 6'0" in height shall be constructed and maintained adjacent to parking areas and access driveways along all property line to within 20 feet of the front property line. 5) That the property be developed in accordance with a revised plot plan to be submitted; after said plot plan has been re- viewed and approved by the Planning Commission as being in substan- tial compliance with the conditions contained herein. 6) That curb, gutter and sidewalk shall be constructed in McCulloch Avenue for the width of the property in accordance with the standards and specifications of the City of Temple City. 7) That landscaped area and outdoor recreation space shall be provided and maintained; the extent of such areas to be as shown on the plot plan required under condition 5) above. 173 1 Res. No. 61 -143, page 2 8) One single or double faced unlighted sign not to exceed 16 square feet in size containing information about the rest home, may be erected and maintained within the front yard setback or else- where on the property. 9) That there are exceptional and extraordinary circum- stances applicable to the property of the applicant that do not apply Generally to the property or class of use in the same vicinity. 10) That the granting of the Special Use Perm/4t of the appli- cant is not detrimental to the public health, general welfare and convenience of the community and will not be injurious to the proper- ty in the same vicinity. 11) That this Special Use Permit shall not be effective for any purpose until the owners of the property involved have filed with the City Clerk of the City of Temple City their affidavit stating that they are aware of and accept all of the conditions of this permit, WHEREAS, the City Council of the City of Temple City fully considered the determination of the Planning Commission at its regular meeting held on May 22, 1961, and WHEREAS, the City of Temple City without obligation so to do noticed the applicant the City Council would place the matter re- specting the subject use permit on its agenda for the regular meeting of the City Council to be held August 28, 1961, at 7 :30 P, M., and WHEREAS, the City Council has carefully considered the sub- ject application for special use permit, NOW, THEREFORE, the City Council of the City of Temple City does hereby resolve as follows: SECTION 1. The City Council of the City of Temple City ex- pressly finds that the granting of a special use permit to the appli- cant George E. and Grace L. Rust to increase the existing rest home facilities from 9 beds to 20 beds at 5610 McCulloch Street, Temple City, California, will be detrimental to the public health, general welfare and convenience of the community and will be injurious to the property in the same vicinity, and the aforesaid request for a special use permit is denied.
