As provided in Article 21 of Chapter 21 of the Municipal Code, the following described use of the following described real estate is allowed as a Special Use for a medical and/or dental office at 1851 Southwest "A" Street in the City of Richmond, Indiana; tyre particularly described; to wit: Being a part of the Northeast Quarter of Fractional Section 1, Township 13 North, Range 2 West in the City of Richmond, Indiana, and being more particularly described as follows: Beginning at an iron pipe at the northwest corner of Lot Number 9 in Benham Addition to said City of Richmond, Indiana, said point also being an the east line of South West 19th Street, and running thence, from said begisming point, north, along the east line of said South West 19th Street, 216.00 feet to an iron pipe on the interesection of said east line with the south line of South .�kst A Street; thence east, along said south line, 150.00 feet to an iron pipe on the west line of a twenty (20) foot wide public alley; thence south, along the west line of said alley, 216.00 feet to an iron pipe at the northeast corner of said Tot 9; thence west, along the north line of said Lot, 150.00 feet to the puce of begirming, con- taining mz area of 0.743 acres. As a condition of the aforesaid 5necial Use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner, leasee or any person, f5am or corporation using said real estate. a. The site plan accmVanying the petition be identified as &.habit "A' and made a part of Ordinance No. 55-1979. b. The Special Use authorization shall be considered null and void should the Special Use cease for a period of one (1)_ year or more. c. Additional parking facilities shall be developed in accordance with Article 41 of the Zoning Ordinance and shall be effectively screened where such parking facilities adjoin residential property by either a solid wall or greenery as a screening material. The Zoning Administrator of the City of Ricbmnd, Indiana is hereby authorized and directed, upon enactment and publica- tion of this Ordinance, to record and approve the issuance of a perroit for the establishDent of the use herein allowed. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval by the Mayor, and publication as by law required. The petitioner, Dr. Ronald E. Kettler, was represented by Stanley R. Combs, Agent, voho requested Special Use authorization for proposed medical and dental offices to. be located at 1.851 Southwest "A" Street. No one spoke in opposition to the request at the public hearing. Forty-four (44) letters were sent to ad- joining property owners with eight (8) returned in favor of the request and none returned in opposition. The Plan Commission voted eleven. (11) to zero (0) to allow the.Special Use with the following three (3) conditions; the first two (2) of which are presently written in the Ordinance: a. The site plan Ac6ampanying the petition be identified as Exhibit "A" and made a part of Ordinance No. 55-1979. b. The Special Use authorization shall be considered null and void should the Special Usecease for a period of one (1) year or more. . c. Additional parking facilities 'shall be developed in accordance with Article 41 of the Zoning Ordinance and shall be effectively screened inhere sueh parking facilities adjoin residential property by either a solid wall or greenery as a screening material.
