WHEREAS, the Richmond Municipal Airport is currently zoned R-1 Single Family Residence District; and, WHEREAS, there is no zoning district classification within the City of Richamd's Zoning Ordinance relating specifically to the func- tion and operation of an airport facility; and, WHEREAS, the Board of Aviation Cemnissi.oners of the City of Richmond has determined that it is in the best interest of the public health, safety and general welfare that an Airport Zone District and an A-rnnrt Industrial Park District be created; and, WHEREAS, it is the intent and purpose hereof to amend Chapter 22 of the AUnicipal Code, commnly lmokm as the Zoning Ordinance, by add- ing Article 36 Airport Zone District and Article 37 Airport In- dustrial. Park District. WAERFAS, a study of this Ordinance was corxERtcted by the Richmond City Plan Commission the 64 day of 1979, at which time reronstrances were heard fro_parties interested in or affected by this Ordinance. UUMAS, the vote of the Riclmund City Plan Cananission was F to 3 in favor of reccamending the passage of Dr ce No. 59-1979. BE IT ORDAINED by the Common Council of the City of Rictnncnnd, Indiana, as follows: SECTION 1. It is hereby ordained that Article 36 Airport Zone District shall be added to Chapter 22 of the Municipal Code and read as follows: ARTICLE 36 AZ - Airport Zone District 36.00 PRINCIPAL P== USES: No building or structure shall be, erected, altered, enlarged or used which is arranged or designed, or used for other than the following uses; nor shall any property or i.mproveyent thereon be used for any but the following uses, except as provided herein and in Article 16. 36.001 Airports, aircraft loading fields. 36.01 ACCESSORY USFS: Any accessory uses, buildings or struc- tures, the functions of which aid and/or abets the opera- tion of an airport or aicraft landing.. field including but not limited to the following:' 36.011 Aircraft hangers. 36.012 Living quarters of persons employed cn the premises. 36.013 General offices, garages and storage buildings used in the administration and maintenance of the airport facility. 36.014 Passenger service and convenience facilities. AgRM General Ordinance No. 59-1979 Page 2 36.015 Fuel storage facilities. 36.016 Airplane repair and maintenance shops. 36.02 IIEIGHT, LOT AREA, FRONTAGE AND YAM REQUIRMI;NTS: Height, lot area, frontage and yard req Arernents for all principal and accessory.buildings, structures or uses shall be regulated by and in accordance with the rules and regulations of the Aeronautics Commis- sion of Indiana, Federal Aviation Administration, and the Board of Aviation Cum issioners of the City of Richmond_ SECTION 2. It is hereby ordained that Article 37 Airport Industrial Park District shall be added to Chapter 22 of the Amicipal Code and read as follows: ARTICLE 37 AIP - Airport Industrial Park District. 37.00 PRINCIPAL PFT4ffTTED USES: No building or structure shall be erected, altered, enlarged or used 4ddh is arranged or designed, or used for other than the following uses; nor shall any property or improve- ment thereon be lased for any but the follmAng uses, except as provided herein and in Article 16. 37.001 General: Any use, trhich use would not conflict with the operation of the airport because of its proximity to the airport facilities and which use does not violate the rules or.regulations of the Aeronautics Commission of Indiana or Federal Aviactian Admnistra- tion. 37.01 ACCESSORY USES: Accessory uses, buildings or structures customarily incidental to any aforesaid principal use shall be permitted in conjunction with such use so long as the accessory uses, buildings or structures do not violate any rule or regulation of the Aero=tics Concus- sion of Indiana or of the Federal Aviation. Administration. 37. 02 HEIGHT, LOT AREA, FRONTAGE AND YARD lTTkYF MENT� ; Height, of area, frontage and yard requirements for all principal and accessory buildings, structures or uses shall be regu- lated by and in accordance with the rules and regulations of the Aeronautics Commission of Indiana and the Federal Aviation Administration. SCION 3. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. The proposed ameruhmnt creates Article 36 A-Z Airport Zone District which permits airports and aircraft landing fields as a-principhil use and further provides for such accessory uses.that aid and abet an airport facility. The proposed mrendma t also creates Article 37, AIP Airport In- dustrial Park District that allows any use so long as it does not conflict with an airport operation and does not violate the rules or regulations of the Aeronautics Commission of Indiana or Federal Aviation Admitii.stration. During the public hearing, Mr. Robert Brooks, President of the Board of Aviation Commissioner's, W. Henry Kazkder, Executive Director of the Indiana Aeronautics C nissicn, Mr. Larry KTieg- bauo of ASE nkgineering, and Nam. Stanly Cix s of Canby Architects si6ke in favor of the Ordinance. Mr. Tan Cox; Mr. Robert Brower .and Mr. Robert Sever, Attorney, representing Mrs. Robert Kuhlman and Th�s. Sandra Jordan, all adjoining property Yxn-lers; spoke in opposition to the Ordinance, Mrs. Shirley Rodgers of the League of Toinm Voters, expressed concern over the need to preserve the prime agricultural land surrounding the Airport and urge all divi- sions of City and County Crivenmmt t:o work together in protecting this productive agricultural land. ARTICLE 37 ATP - Airoort Industrial Park District. 37.00 PRINCIPAL PE:tNTI= USES: No building or structure shall be erecte a tered, enlarged or used which is arranged or designed for other than the fclhztTing uses; nor shall any property or t7provanent thereon be used for any but the following uses, except as pro- vided herein and in Article 16. 37.001 General: Any use, which owing to a peculiar locational ne,requires close proximity to an airport or air- craft landing field and does not violate any rule or regulation of the Aeronautics Comnission of Indiana or of the Federal Aviation Administration. 37,01 ACCESSORY USES: Accessory uses, buildings or structures customarily incidental to any aforesaid principal use shall be permitted in conjunction with such use so long as the accessory uses, buildings or structures do not violate any rule or regulation of the Aeronautics CanmiS- sion of Indiana or of the Federal Aviation Ada-Laistration, 37.02 HEIGHT, 11JT AREA, FRONTAGE AND YARD Fdr : Height, of area, frontage and yard requirements for all principal and accessory buildings, structures or uses shall be regu- sated by and in accordance with the rules and regulations of the Aeronautics Ca3nission of Indiana and the Federal Avi.aticn Administration.
